    About The NJ Family Leave Act (FLA)
    Click here to download the "Family Leave Act" (34:11B-1 Short title) [134KB PDF The New Jersey Division on Civil Rights enforces the New Jersey Family Leave Act (NJFLA), which requires covered employers to grant eligible employees time off from work in connection with the birth or adoption of a child or the serious illness of a parent, child or spouse. The NJFLA's definition of "parent" includes a parent-in-law or a stepparent. The NJFLA provides for up to twelve weeks of leave in a 24-month period. The 24-month period begins on the first day of the employee's first NJFLA leave.     What does the Americans with Disabilities Act do? The Americans with Disabilities Act (ADA) ensures that people with disabilities, such as severe mental illness, have legal protection against discrimination in the workplace, housing and residential settings (including treatment facilities such as hospitals), public programs, and telecommunications. The ADA's goal is to give the 54 million Americans with disabilities full and equal opportunities (President Bush's New Freedom Initiative, 2002). Back to top What are State Protection and Advocacy programs? Back to top What is an advance directive? If you frequently seek and use mental health services, you may want to establish an advance directive. There are two general types of advance directives: instructional, such as living wills, and proxy, such as durable power of attorney. Each directive is a legal document that lets you describe what services you want to receive if an illness renders you unable to make decisions about your care. Give a copy of the directive to your usual service provider(s) so that it can become part of your medical record. Laws about advance directives vary from State to State. Work with a lawyer, paralegal, or advocate to write your advance directive.

    In the 15 years since the Americans With Disabilities Act was signed into law, there have been major improvements in making public places and services more accessible to people who live with physical impairments. Jeff Markowitz, Associated Press

    The law, intended to ensure equal rights for the disabled, has brought a host of changes in workplaces, transportation, communication and other areas. Companies must make reasonable attempts to accommodate workers with physical impartments, while buildings, transportation and other public facilities must be accessible to all. But even as the ADA is slowly driving changes enabling more people with significant mental and physical disabilities to live independently, the effects of exclusion are still felt, particularly in employment. That's because the ADA, which became law on July 26, 1990, is a significant yet imperfect piece of legislation, Mary A. Crossley, the new dean at the University of Pittsburgh School of Law, said yesterday.

    Introduction to DD Services
    Approximately 84,000 people with developmental disabilities (DD) live in non-institutional settings in Tennessee. Conditions resulting in DD include mental retardation and severe, chronic disabilities such as cerebral palsy, spina bifida and autism. An estimated 44,000 people in Tennessee have mental retardation, while 40,000 have severe, chronic disabilities other than mental retardation. The Tennessee General Assembly responded to the needs of people with DD in 2000 by making substantial changes in mental health laws recommended by the Title 33 Revision Commission. To create an agency home for people with DD, lawmakers renamed the Department of Mental Health and Mental Retardation, the Department of Mental Health and Developmental Disabilities (DMHDD). The new law reaffirmed that people with mental retardation were eligible for services and required that people with DD other than mental retardation become eligible for services on March 1, 2002.

    Consumers have the right to considerate, respectful care from all members of the health care system at all times and under all circumstances. An environment of mutual respect is essential to maintain a quality health care system. Consumers must not be discriminated against in the delivery of health care services consistent with the benefits covered in their policy or as required by law based on race, ethnicity, national origin, religion, sex, age, mental or physical disability, sexual orientation, genetic information, or source of payment.     Rationale
    Consumers want to be treated with respect and they want to be treated fairly. An environment of mutual respect is essential to maintain a quality health care system. Incidences of discrimination real and perceived mar the relationship between consumers and their health care professionals, plans, and institutions. Multiple consumer surveys (Levinson et al., 1997; Davis et al., 1995; Edgeman-Levitan and Cleary, 1996) have found that many consumers' complaints about the current health care system have their root in the perception that people believe they are not being treated with respect.
