disability law: an overview
States may pass disability statutes so long as they are consistent with the ADA. Other statutes prohibiting discrimination against individuals with disabilities include the Fair Housing Act, Rehabilitation Act, Air Carrier Access Act, and the Individuals with Disabilities Education Act. Under the Fair Housing Act, it is unlawful to discriminate in any aspect of selling, renting, or denying housing because of an individual's disability. Owners are further required to make reasonable exceptions in their housing policies so as to afford equal housing opportunities to those with disabilities. The Rehabilitation Act prohibits discrimination on the basis of disability in programs conducted by Federal agencies, in programs recieving Federal financia assistance, in Federal employment, and in the employment practices of Federal contractors. Its standards mirror those of the ADA. Under the Air Carrier Access Act, air carriers are prohibited from discrimination against qualified individuals with physical and/or mental impairments.

Introduction
Anyone who has a mental illness and/or is receiving services related to their mental illness in Alaska can use this booklet. This booklet explains some of your rights in the areas of employment, housing, voluntary and involuntary commitment to a treatment center, and your rights as a prisoner in the Alaska Department of Corrections. No booklet can answer all of your questions. The Disability Law Center of Alaska strives to update its materials on a regular basis, and this handout is based upon the law at the time it was written. It is not intended to and does not replace an attorney's advice or assistance. The law changes frequently and is subject to various interpretations by different courts. Future changes in the law may make some information in this handout inaccurate. Do not take any action based only upon this handoutalways check with your attorney.

MISSION STATEMENT The Center for Public Representation is organized as a self-sufficient public interest law firm to promote change in the quality of lives of individuals with disabilities in Massachusetts and to pursue the systemic enforcement of legal rights on a statewide and national basis. The Center's primary purpose is to serve people who have or are considered to have disabilities. The Center also may assist, to a limited extent, other people who are institutionalized, discriminated against, or otherwise denied fundamental human rights. The Center will undertake this mission consistent with its nonprofit, tax-exempt status. The Center for Public Representation is a public interest law firm which has been assisting people with disabilities, both in the community and in institutional settings, for over thirty years. Its staff of ten attorneys and two paralegals work in its Northampton and Newton offices, although much of the Center's activities occur throughout Massachusetts and in other jurisdictions. Through its systemic advocacy over the past two and half decades, the Center has been a major force in promoting improvements in services for citizens with mental disabilities throughout the country.

Rosenberg, PhD The legal concept of the “eggshell plaintiff,” when explaining the causation of a plaintiff’s claimed psychological injury, may be an archaic and a misleading paradigm. The “thin skull” or “eggshell plaintiff” rule—often described as the “defendant takes the victim as found”—protects the rights of individuals whose preexisting fragility makes them particularly susceptible to injury. This rule provides that when a defendant’s tortious conduct causes harm that, due to the person’s preexisting physical or mental condition, is of a greater magnitude or different type than might reasonably be expected, the defendant is liable for all harm caused by the tortious conduct.     What is the purpose of the Americans with Disabilities Act (ADA)? The ADA, signed into law July 26, 1990, bans discrimination based on disability. It gives individuals with disabilities civil rights protections like those provided to individuals on the basis of race, sex, national origin and religion. It guarantees equal opportunity for individuals with disabilities in employment, public accommodations, transportation, state and local government services and telecommunication relay services. Why is the ADA needed? The Civil Rights Act of 1964 does not cover people with disabilities. Until passage of the ADA, federal protections against discrimination based on a person's disability were scattered and very limited. Congress concluded that discrimination existed against people with disabilities, and they were sometimes denied equal, effective and meaningful opportunities to participate in society. How is disability defined by the ADA? The ADA defines disability to mean a physical or mental impairment that substantially limits one or more of the major life activities of an individual, having a record of such an impairment, or being regarded as having such an impairment. This is the same definition included in section 504 of the Rehabilitation Act of 1973, the Fair Housing Act Amendments and the Air Carrier Access Act. What does the ADA cover?

    The LIBRA Project asserts the civil rights of persons with psychiatric disabilities by combating stigma, providing education, and promoting equality and reasonable accommodation in the workplace. The program is the only one of its kind in the nation, and serves as a resource for other advocates throughout the Bay Area and across the country.
    Project Services
    • Legal advice and counseling : The LIBRA Project provides legal services to individuals with psychiatric disabilities who have employment-related problems, including free counseling, referrals, and technical assistance. Where resources permit, the Project also offers limited representation, such as letters to employers, assistance in negotiations regarding accommodations, and assistance with filing EEOC charges.
