  • The Poppink Act Changed the FEHA To Include Transgender People.
  • The Old Law Followed the Americans with Disabilities Act in Excluding Transsexualism and Gender Identity Disorders. Prior to the Poppink Act, FEHA defined "disability" to include the same list of exclusions found in the federal Americans with Disabilities Act (ADA). The ADA provides that the term "disability" shall not include: transvestism, transsexualism, pedophilia, exhibitionism, voyeurism, gender identity disorders not resulting from physical impairments, compulsive gambling, kleptomania, pyromania, and psychoactive substance use disorders resulting from current illegal use of drugs.

In this seminar, we will explore theoretical, doctrinal and practical dimensions of human rights law in Canada. The course includes an examination of prohibited grounds and grounds currently left unprotected, as well as exceptions and defences. The course will introduce you to pay equity. We will also deal with human rights procedure, interpretive principles, remedies, and jurisdictional issues. The focus is on Ontario and federal law. A basic understanding of administrative law is an asset, but not a prerequisite. The goals of this course are to familiarize you with domestic provincial and federal human rights schemes, to analyse current anti-discrimination theory and doctrine, and to develop applied legal research skills
