Overview and Definitions
Family and divorce mediation ("family mediation" or "mediation") is a process in which a mediator, an impartial third party, facilitates the resolution of family disputes by promoting the participants' voluntary agreement. The family mediator assists communication, encourages understanding and focuses the participants on their individual and common interests. The family mediator works with the participants to explore options, make decisions and reach their own agreements. Family mediation is not a substitute for the need for family members to obtain independent legal advice or counseling or therapy. Nor is it appropriate for all families. However, experience has established that family mediation is a valuable option for many families because it can: 1. increase the self-determination of participants and their ability to communicate;

Why Collaborative Family Law Beats Mediation
The Polyannas agree that mediation and arbitration are like the new age dawning. The cynics say the attorneys who rush to alternative dispute resolution are like rats leaving the sinking ship of our justice system. The truth lies somewhere in between. There are distinct differences between the various types of alternative dispute resolution. These distinctions are frequently and insufficiently drawn. Arbitration which, in many ways, mimics traditional trial procedure, arguably provides a legitimate way to judge shop and sometimes a cheaper and more expeditious method for the disposition of a case. Counsel fees may be less, but the savings are offset by the cost of paying for an arbitrator. Mediation is distinguishable from arbitration in that the parties choose to retain all authority for their own final decision making. This process is distinguishable from both arbitration, where the authority is delegated to an individual chosen by the parties, and court, where the citizenry has delegated the authority to a judge, paid for by the taxpayers. Mediation is zealously advocated from the right by fathers' rights groups, who vociferously object to the payment of child support and alimony, and on the left by therapists and others, who hope for a kinder, gentler process. In the middle, there are many professionals who put on the mediator's hat as a way of marketing new services and developing a new source of revenue.

By Brandy Carestia Cutting Mediation presents parties with a unique opportunity to reach a final settlement of their claims, contrasted with the risk and uncertainty of further litigation, trial, and appeal. Our clients, who possess the most knowledge about their conflicts and have the greatest interest in resolving them, are best equipped to fashion a solution to their problems. Consequently, mutually acceptable resolutions crafted through mediation almost always result in higher client satisfaction than protracted litigation. In addition to the sense of accomplishment derived from personally shaping the resolution of their claims, our clients also reap benefits of early settlement including avoiding additional expense, time, stress, and often disappointment on both sides that result after a verdict. This unique opportunity for negotiated settlement is now mandatory in nearly all Montana jurisdictions prior to trial, and often prior to a trial setting, as well as in the appellate process. The following suggestions are intended to assist lawyers in making the mediation process more successful for their clients.

Mediation is where you and your spouse conduct your own settlement talks but you do so in the presence of someone who is trained to help you avoid derailment. The mediator doesn't try to sell anybody on anything but does make certain time-tested procedural suggestions to help you decide on how you and your spouse want to proceed. Spouses in litigation wish they weren't. Whatever happens in mediation is confidential and cannot be used later in court. The mediator is not a judge and does not have the power to decide anything. The mediator is only there to help the two of you in creating a tailor-made settlement of your choosing. The presence of a neutral and impartial third party creates a dynamic that should help achieve a level of communication with your spouse that you would most likely not be able to reach on your own. This is because techniques are used to get your spouse (perhaps for the first time) to actually listen to what you are saying. Prior to mediation, most people just keep going around and around in the same verbal cul de sac and continuously debate the same issues. The fact is that those very issues are part of what brought you into conflict in the first place. You weren't going to change that party's mind then and you aren't going to change that party's mind now unless something happens to make that person realize that it just might benefit him/her to consider alternatives. That's where the mediator comes in.

Long Distance (Shuttle) Mediation Because of geographical separation, domestic violence, or the preferences of the parties in mediation, a new technique has come into existence, which allows mediation to take place by mail, fax, phone and e-mail. This is done by co-mediators or mediators in two locations. In divorce cases, it is preferable that the two mediators be of different gender. Each party talks to both mediators during his or her session and at the end of the other party's session. Some parties find it to painful or uncomfortable to meet face-to-face. Often, they are geographically separated. After the fact-finding stage, the reports of each individual session are put in writing and relayed to the other party. Both parties have full opportunity to explain their point of view, their wants and needs. Each party responds to the memoranda that have been forwarded to that party. The receiving party can revise, modify, and/or subtract to anything that has been sent. Both parties are always current with the items that have been resolved and with the items where agreement has yet to be reached. Each party talks to both mediators during his or her session and at the completion of the other party's session.

Arbitration and Mediation Merrill B. Emerick, Esq Arbitration and mediation are two forms of alternative dispute resolution where cases are resolved without the parties ever going to court. There are also other types of alternative dispute resolution, such as early neutral evaluation, but these two are the most common. Although the names are often used together, they are actually quite different. Both have the same goal, that being the conclusion of litigation without ever going to court. Arbitration is either binding or non-binding. Binding arbitration occurs where the parties agree to have an independent third person decide the dispute between them. This person is usually a retired judge or an experienced attorney. The agreement may occur before there is any dispute when the parties enter into some form of written agreement that provides that if there are any disputes, rather than going to court, the matter will be submitted to an arbitrator to decide the dispute. The arbitrator's decision is binding. Usually, there is no right to appeal, and the arbitrator's decision may be made into a judgment. It will then have the same effect as though a judge or jury had decided the case after a trial. Parties sometimes decide to submit their claim to binding arbitration after a lawsuit has already been filed. In this case, the parties enter into a stipulation that the dispute will be decided by an arbitrator and the decision will be binding. Sometimes statutes require that disputes be submitted to binding arbitration. For example, under the California Insurance Code, a dispute between an injured motorist and his or her own insurer must be decided in binding arbitration where the motorist's injuries were caused by a driver who had no insurance and the injured motorist had uninsured motorist coverage under his or her automobile insurance policy.
