Government and Politics
The 1968 constitution proclaims that Mauritius is a "democratic state" and that the constitution is the supreme law of the land. It guarantees the fundamental rights and freedoms of the people, including the right to hold private property and to be free from racial or other discrimination. Fundamental rights can only be suspended during wars or states of emergency, which must be duly declared by the parliament and reviewed every six months. The political structure is patterned to a large extent on the British system. As in Britain, the political party that can gain support from a majority in parliament chooses the prime minister, who, along with the cabinet, wields political power. The constitution also provides for three important commissionsthe Judicial and Legal Service Commission, the Public Services Commission, and the Police Service Commissionas well as an ombudsman. The commissions oversee the appointment of government officials; the ombudsman investigates official misconduct. The country's legal system is based on the Napoleonic Code and English common law. The Supreme Court heads the judicial system and has the power to interpret the constitution and to judge the constitutionality of legislation brought to its attention. Appointed by the prime minister and president, the chief justice helps select five other judges on the court. The Supreme Court also serves as the Court of Criminal Appeal and the Court of Civil Appeal. Mauritius continues to refer legal and constitutional matters of undeterminable jurisdiction to Britain's Privy Council. Lower courts having original jurisdiction over various kinds of cases include the Intermediate Court, the Industrial Court, and ten district courts.

GOVERNMENT Mauritian politics are vibrant and characterized by coalition and alliance building. All parties are centrist and reflect a national consensus that supports democratic politics and a relatively open economy with a strong private sector. Parliamentary elections were held July 3, 2005.
. Mauritius became a republic on March 12, 1992. The most immediate result was that a Mauritian-born president became head of state, replacing Queen Elizabeth II. Under the amended constitution, political power remained with parliament. The Council of Ministers (cabinet), responsible for the direction and control of the government, consists of the prime minister (head of government), the leader of the majority party in the legislature, and about 20 ministries.
The unicameral National Assembly has up to 70 deputies. Sixty-two are elected by universal suffrage, and as many as eight "best losers" are chosen from the runners-up by the Electoral Supervisory Commission using a formula designed to give at least minimal representation to all ethnic communities and under-represented parties. Elections are scheduled at least every 5 years. Mauritian law is an amalgam of French and British legal traditions. The Supreme Courta chief justice and five other judgesis the highest judicial authority. There is an additional right of appeal to the Queen's Privy Council. Local government has nine administrative divisions, with municipal and town councils in urban areas and district and village councils in rural areas. The island of Rodrigues forms the country's 10th administrative division.

    This entry gives the basic form of government. Definitions of the major governmental terms are as follows:
    Anarchy - a condition of lawlessness or political disorder brought about by the absence of governmental authority.
    Commonwealth - a nation, state, or other political entity founded on law and united by a compact of the people for the common good.
    Communism - a system of government in which the state plans and controls the economy and a single - often authoritarian - party holds power; state controls are imposed with the elimination of private ownership of property or capital while claiming to make progress toward a higher social order in which all goods are equally shared by the people (i.e., a classless society).
    Confederacy (Confederation) - a union by compact or treaty between states, provinces, or territories, that creates a central government with limited powers; the constituent entities retain supreme authority over all matters except those delegated to the central government.
    Constitutional - a government by or operating under an authoritative document (constitution) that sets forth the system of fundamental laws and principles that determines the nature, functions, and limits of that government.

    The Chagossians demand urgent reparation from Britain Can they ever become masters of their own destiny?
    For 19 days last month the former inhabitants of the Indian Ocean islands of the Chagos Archipelago staged a demonstration outside the British High Commission in Port Louis, Mauritius, to press for immediate consideration of their claims to compensation from the British government.
    From November 5 to 23, over two hundred Chagossians, children and adult of both sexes, maintained the vigil until the British government agreed to receive a delegation to London for talks. It has been officially announced that the Under Secretary of State at the Foreign and Commonwealth Office, Baroness Amos, will see the Chagossians in London on December 14.
    While the Chagossians are pressing for compensation for their unlawful eviction from their islands 36 years ago, the Mauritius Government has for its part, been demanding the restoration of the country’s sovereignty over the Chagos Archipelago as was the case up to 1965.
    Prior to Mauritius’s accession to independence in the sixties the British government took away Mauritius’s jurisdiction over the Chagos Archipelago. Since then the return of the Chagos to Mauritius, endorsed by a UN resolution, has been the battle cry of every Opposition party in Mauritius, and most dynamic among them, was Paul Bérenger, now Deputy PM and Finance Minister.

And so, from now on, we shall have to think more and more about the younger readership. It is therefore very pertinent that we ask ourselves the question: Do the young people of Mauritian origin in the UK need a newspaper of their own like Mauritius News? Reflections: * Together, we are united. * Unity means strength. * Strength means respect! We do not have the money to ingratiate politicians for a lobby. Our lobby is Mauritius News! The younger generation of UK Mauritians and elsewhere will have to fight for their right to retain the Mauritian citizenship which is being denied to many of them who have applied for it. According to one press report in Mauritius, 36,000 applications from young people from overseas who are eligible for Mauritian nationality have been turned down by the Mauritius Government without giving any reason. Yet, people from other countries are given Mauritian citizenship for one reason or another. Mauritius News has in the past campaigned for dual nationality to be extended to all overseas Mauritians and their children until this was approved by the Mauritius Government in 1999, but which it refuses to implement in practice.

    - Mauritius has set up a commission to examine ethnic riots sparked by the death of a Creole reggae singer in police custody after he was detaimed for smoking marijuana at a protest to legalise the drug.
    A senior official said the government had asked the director of public prosecutions to investigate the singer's death to determine whether it was the result of police brutality. "The commission of inquiry could last for several months as many witnesses and opinion leaders have agreed to participate," said the official, who asked not to be identified. Joseph Reginald Topize, or "Kaya," died in jail on February 21. He was arrested three days earlier for smoking marijuana at a political rally calling for decriminalisation of the drug. His death sparked four days of riots in the capital Port Louis and other towns on the Indian Ocean island as Creoles clashed first with police and then with members of the majority Hindu population. Three people, including another reggae singer, were killed by police during the riots.
