Massachusetts Home Education Law and Practice Essential Facts for Parents and School Officials INTRODUCTION An overwhelming majority of Massachusetts schools have effective working relationships with the homeschooling families in their districts. Problems occasionally arise, however, for parents and school officials alike, due to lack of communication or misunderstanding about home education law and practice. Such problems can usually be readily resolved by referral to this fact sheet and to the Charles decision (see below). LEGAL FRAMEWORK The right of parents to educate their own children, subject to reasonable government regulation, is protected in all fifty states by the U.S. Constitution as well as by various Supreme Court and lower court decisions. Guidelines for home education in Massachusetts have most recently been clarified in the 1987 ruling of the Supreme Judicial Court known as Care and Protection of Charles , herein referred to as Charles. SCHOOL AGES The compulsory attendance statute, which requires attendance in an approved program, applies to home-educated young people from age 6 to their 16th birthday. Parents of a five-year-old who will turn 6 by December 31st should advise officials of their plans to homeschool before the beginning of the school year. Parents of children who will turn 6 after December 31st may wait until the next school year. NOTIFICATION As upheld by Charles , parents are required to seek approval of their local superintendent or school committee before beginning their home education program but may do so at any time, without waiting for the beginning of a new term. It is rare for him to be able to speak directly to the citizens. Whether you agree with him or not, he will certainly make you think. Mass. News: Is public education finished in Massachusetts? Silber: No. I believe the ideal structure is a system of public education. The purpose of vouchers and the purpose of charter schools should be to create competition that will result in the improvement of the public schools. Vouchers could offer the opportunity of giving children the choice of attending private schools or parochial schools. That’s very unlikely in the state of Massachusetts, though not in other states, because of our constitutional prohibitions against the mixture of church and state. Those barriers are so high in Massachusetts that it will be difficult to work that out. The other difficulty with vouchers is that there are limited numbers of schools to which children can go. If they go to a private schoolI mean a non-religious private schoolor to a school in a different community, how are they going to get there? There’s no public busing that’s going to pick them up and take them there. So the children who will be beneficiaries of such a program are children whose parents are better off than the other parents. So it’s the most privileged children who are going to be further privileged by most voucher programs. That’s why I don’t see the voucher program as a success except as it creates competition. And to the extent that we can create competition, to put the standard public schools on notice that they have to improve or they’re going to be in jeopardy, that’s fine.
