General Legislative Provisions
This first part of the review examines statutory provisions that have implications for, but do not necessarily address directly, students with disabilities or special education. Various provisions in state statutes grant charter schools varying levels of authority to govern themselves and to make decisions regarding the operation of the schools, including decisions related to personnel, curriculum, and expenditures. The extent of a charter school's operational autonomy will have an impact on how special education programs are implemented in these schools. As described in the following paragraphs, statutory provisions that give higher levels of autonomy include ones that allow or require charter schools to (1) operate independent from local school districts, (2) make their own personnel decisions, (3) be exempt from state and district education laws and regulations, (4) assume liability for their actions, and (5) receive their funding directly from the state. For a wider range of protection, states should require posting pesticide notification signs for outdoor pesticide applications as well. Students who play sports or people continually on the lawns represent a high risk when applications occur on school property. Dermal exposure can occur when a football player gets tackled, a soccer player slides to make a block or a student sits on the grass to eat lunch or watch a game. Inhalation exposure can occur when a player breathes in kicked up dust and dirt and pesticide residues. Public awareness and concern about the effects of pesticides on public health and the environment is increasing, especially with regard to the impact of pesticides on the health of children. This public concern has given rise to the development of alternative methods of pest control. One system of pest control which has received considerable attention is integrated pest management or IPM. IPM is a philosophy of pest control which has been defined in various ways by diverse groups. The U.S. Environmental Protection Agency (1993) provides the following definition: "IPM programs use current comprehensive information on life cycles of pests and their interactions with the environment. This information, in combination with available pest control methods, is used to manage pest damage by the most economical means, with the least possible hazard to people, property and the environment. IPM programs take advantage of all pest management options possibly including, but not limited to, the judicious use of pesticides." Because IPM can effectively and economically reduce pest populations, while minimizing pesticide exposure, numerous crop-specific IPM programs have been developed and implemented in agricultural settings. The IPM approach has also been adopted by schools throughout the country to manage urban pests. While individual schools and school systems have adopted IPM programs, a number of states, (including Montana, Illinois and Washington, have developed state policies to encourage the use of IPM in schools and other public buildings. Other states (Texas, Michigan, West Virginia, Florida and Oregon) have mandated the use of IPM in public schools. While the Commonwealth of Massachusetts supports an active agricultural IPM program, the state has passed no policy concerning the practice of IPM in public buildings or schools.

Education Reform in Massachusetts Education Reform in Massachusetts Craig Bolon 30 August 2000 Education reform in Massachusetts was driven by the McDuffy school finance lawsuit, originally filed in 1978. In its McDuffy decision, the Massachusetts Supreme Judicial Court said that Massachusetts funding disparities harmed the quality of education for some students, denying them education to which they were constitutionally entitled. This June, 1993, decision was widely anticipated, and the Massachusetts Education Reform Act was signed less than a week after the decision was released. A group called the Massachusetts Business Alliance for Education, organized in 1988 and led by John C. (Jack) Rennie, then CEO of the former Pacer Infotec, Inc., of Burlington (now the AverStar division of Titan Corp., San Diego, CA), and S. Paul Reville, then director of the Worcester Public Education Fund, wrote the reform bill sponsored by the Education Committee of the legislature. In 1991 the Business Alliance produced a document entitled "Every Child a Winner." A story from the May 2, 1993, Northwest edition of the Boston Globe quoted Rep. Mark Roosevelt as saying that the House education reform bill then pending "is essentially [the Business Alliance document]." In publications of Mass Inc., Rennie is quoted as saying, "We bought change." Most of this work was carried out in secret. As late as December, 1992, then Lt. Gov. Cellucci was calling on the Education Committee chairs, Sen. Thomas Birmingham of Chelsea and Rep. Roosevelt of Beacon Hill, to disclose their bill. Almost all the controversy generated by this legislation focused on its funding formulas. Until 1993, the public had hardly any knowledge of its sweeping changes in school policy and regulation.
