"I would like a baby very much. I wanted to give birth to it," pleaded 29-year-old Ma Weihua to her lawyer on March 29 at Lanzhou Chengguan Detention Center, Northwest China's Gansu Province.
The medical document showed that Ma's abortion surgery was forced. [baidu] Ma was seven weeks pregnant when she was apprehended by the Anti-Drug Group of the Lanzhou Chengguan Public Security Bureau for heroin possession (an offense punishable by death in China) as she arrived in Lanzhou from Urumqi, capital of Northwest China's Xinjiang, January 25. But on February 18, Ma was given an abortion without her consent by a doctor who used a general anesthetic. According to the 49th item of the Criminal Code of China, pregnant women are exempted from the death penalty. Ma was carrying 1.6 kilograms of heroin when she was stopped by police. According to South China Weekend News, a Guangzhou-based newspaper, Ma presented her reasons for carrying the heroin to the anti-drug group. While working in Urumqi, Ma said she received a phone call from a friend, Sa Liha, whom she met in Sinkiang, asking her to transport some drugs to Lanzhou, capital of Gansu Province.

Recommendations The following recommendations are offered for consideration by those needing to articulate a well-considered perspective on the ethical, legal, human rights and public health dimensions of the criminalization of HIV transmission/exposure: (1) Lobby for strong, accessible, and enforceable legislation protecting confidentiality and freedom for discrimination for people living with HIV/AIDS and vulnerable groups, and promoting and protecting access to prevention information and materials, as well as care, treatment and support. This should include affordable access to post-exposure prophylaxis, and the necessary information and support, for survivors of rape or other sexual assault posing any appreciable risk of HIV infection, and for workers who have any appreciable occupational exposure. National guidelines or a protocol on providing services and treatment to those exposed (including training of health care workers, police, and prosecutors who will interact with sexual assault survivors) should be developed. (2) Undertake educational campaigns on HIV/AIDS, including how it is and is not transmitted, that target both the general public and public health authorities, police, prosecutors, lawyers, the judiciary, and legislators and other policy-makers. While acknowledging that police, prosecutors, legislators are pressured to "do something", such educational approaches should repeat the need for a reasoned approach. They should also reiterate that the handful of cases that receive media attention do not represent the most common instances of transmission (which is by people unaware of their infection), and that responding to such cases should not be allowed to divert resources and support from proven strategies for fighting the epidemic.

The Policy and Advocacy Committee of the AIDS Committee of Toronto developed the first policy of any community-based organization in Canada on the use of criminal sanctions as a response to the transmission or threatened transmission of HIV. Abstract:
Many writers in recent decades have objected to the utilitarian aspects of substantive criminal law that cannot be squared with modern, retributivist versions of criminal justice. One particular target of the retributivists has been the use of strict liability, especially as it is applied in statutory rape cases. This article is an effort, not to take sides between utilitarians and retributivists, but to historicize the ideas and assumptions on all sides of the debates in criminal law, including the debate about strict liability in statutory rape.

That's why, for the past two years, I've been teaching my lecture courses and seminars on criminal law with a website, the Penal Law Web . Even if you're not a criminal law teacher, read on. The general approach underlying the Penal Law Web can easily be adapted to other legal subjects, especially those revolving around codes or other systematic statements of law, such as restatements. Read on also if you feel woefully underskilled, understaffed, or underpaid to set up a law web. If I can do it, for free with nothing more than the web browser you're using right now to read this, so can you. Don't read on if you think that a course website shouldn't do more than post assignments and manage e-mail chats. The Penal Law Web doesn't do either. Webs Not Casebooks For several years, I kept getting increasingly frustrated with the casebook I was using in my criminal law class. Medical Interventions and the Criminal Law:
Lawful or Excusable Wounding?

One difficulty in dealing with the concept of medical treatment in Canadian criminal law is to reconcile some of the dictates of the Criminal Code which have ancient origins, with the reality of modern medicine. Such a situation arises when we ask whether a surgical operation is prima facie legal or illegal. This may be considered a rather narrow and esoteric question, but it has and will become increasingly important with the development of modern medical technology. The initial presumption of legality or illegality may determine the final characterization of a given medical intervention as lawful or unlawful. This is particularly important in such areas as non-therapeutic human medical research and live-donor organ transplantation. This enquiry explores the present situation in Canadian criminal law with respect to the legality of medical interventions and makes some recommendations for change.
