This site is named after the book Uniquely Gifted: Identifying and Meeting the Needs of the Twice-Exceptional Student , edited by Kiesa Kay. April 30, 2003 Mr. Speaker - I yield myself such time as I may consume. Mr. Speaker - Partisan battles are nothing new on the floor of this House. But there are many matters where broad bipartisan agreement and good will have traditionally been the rule. Education for disabled and special needs children has been one of those issues notable for its profound bipartisan consensus. Therefore, it is a sad day for this House as we consider the rule for H.R. 1350, the IDEA reauthorization.

Facing the Challenge
Every day life can be a constant challenge for children with disabilities. For some, the challenge is to be able to read and understand with the speed and ease of their friends. For others, the challenge is to overcome a disabling condition, which makes getting out of bed and getting dressed each morning, a major accomplishment. The things that most individuals take for granted each day are constant and continual challenges for these children. Facing the Challenge is about the real life stories of students with special needs who attend private, special education schools approved by the Massachusetts Department of Education. These stories are also about families; mothers, fathers, sisters and brothers whose lives are challenged and enriched by their disabled child or sibling. Statewide, over 6,000 children with disabilities from Massachusetts and around the world find the highly specialized education and treatment that they need to overcome their disabilities and face the challenge each and every day. With research demonstrating the overall success of school voucher programs in Milwaukee and Cleveland, and with the constitutional issue of public funding of religiously affiliated schools headed for resolution in a seemingly God-tolerant Supreme Court, defenders of the educational status quo have been reduced to fanning fears that government support of greater parental choice would transform public schools into dumping grounds for difficult-to-educate students. As the Parent of a Child With Special Education Needs, Are You Entitled to Damages? Ordinarily, a prevailing parent in an Individuals with Disabilities Education Act (IDEA) court action is only entitled to a compensatory education for his/her child and is not entitled to damages, which is money awarded in order to compensate for a loss. It is important for parents to understand from the outset that damages are not recoverable, so that they have realistic expectations when filing for due process or seeking the aid of an attorney. Eight of eleven Circuit Courts have held that damages cannot be recovered for IDEA violations. Only the Second and Third Circuits allow for the recovery of damages under IDEA. The Ninth Circuit has still yet to decide the issue; however, a California District Court, which is in the Ninth Circuit, has recently ruled that parents can recover damages in IDEA actions. In Goleta Union v. Ordway, 166 F.Supp.2d 1287 (C.D. Cal., 2002), the District Court held that the mother of a child transferred to high school without having his special education or behavioral needs met or his placement checked, was entitled to damages.

Reforms Crucial to Special Education
by Marie Gryphon June 14, 2002 Marie Gryphon is a policy analyst with the Cato Institute's Center for Educational Freedom. The Washington Education Association recently released a survey revealing that two-thirds of the state's special education teachers plan to quit over the next five years. Teachers of special needs children cited excessive paperwork and too many meetings as leading reasons for their decision to hit the road, exacerbating a serious existing shortage of qualified personnel. Predictably, the WEA used these results to call for two favorite union remedies, higher pay and smaller class sizes. Union President Charles Hasse said the survey confirms "a compensation and workload crisis among special ed staff." In fact, Washington's teachers and students would benefit most from a rarer prescription - fundamental reform. Washington is held hostage to a federal statute that governs nearly every aspect of special education. Passed in 1975, the Individuals with Disabilities in Education Act (IDEA) mandates a complex series of meetings, paperwork, notice requirements and legalistic due process procedures for developing each disabled child's educational plan.
