With Disabilities The Individuals with Disabilities Education Act (IDEA) mandates that States provide a free and appropriate public education for all students with disabilities if the State receives Federal support for educating students with disabilities. IDEA gives enforcement authority not only to the Federal and State Departments of Education, but also to individuals. Therefore, if a parent, youth advocate, or department of education worker finds that a detained or confined youth is not receiving adequate educational services, IDEA can be used to secure appropriate education for this youth. Previous studies emanating from litigation and professional literature in this area document the inadequate educational services received by youth in custody. IDEA serves as an ideal tool to access educational services for youth with disabilities because it requires public schools and State-operated programs, such as juvenile correctional facilities, to provide each eligible child with adequate special education and related services. The Individuals With Disabilities Education Act Although nearly all States have compulsory education laws and provide educational services through local school districts, Congress recognized the special needs of students with disabilities when it passed IDEA in 1975. IDEA mandates that all eligible students receive a free and appropriate education in the least restrictive setting possible.

Regulatory Changes Cloud AYP
Claims of overall improvements on the state Adequate Yearly Progress (AYP) report cards required by No Child Left Behind (NCLB) are clouded by regulatory and statistical adjustments that have made it easier for many schools to report gains.
The National Education Association (NEA) tallied AYP results for 41 states (as of November 9, 2004) and found fewer schools failing to make AYP for at least one year. The number of failing schools in these states declined from 23,273 in 2003-04 to 17,831 in 2004-05. Thirty-two states reported more schools making AYP, while nine reported fewer schools making AYP.

South Carolina, for example, set a modest goal of 17.6 percent proficiency in English/language arts and 15.5 percent proficiency in math for 2003-04 and achieved that in just over half of its 1,039 public schools. Next year, South Carolina schools must more than double the percentage of students scoring proficient, to 38.2 percent for English and 36.7 percent for math.

Subchapter 1: GENERAL PROVISIONS Each school administrative unit operating schools shall: 1. Identification. Identify all children within its jurisdiction who require special education; 2. Records. Make and keep current records of exceptional students, as required by rules established by the commissioner, and institute procedures which guarantee the confidentiality of these records in accordance with state and federal law; 2-A. Assist advocates for developmentally disabled. Assist the Protection and Advocacy Agency for the Developmentally Disabled in Maine in conducting an investigation, pursuant to Title 22, section 3554, by providing access to relevant case records, notifying parents or guardians of these investigations and by requesting parental consent for access to case records by the agency. Parents or guardians may refuse to consent to the examination of these records; 3. Diagnosis and evaluation.

In recent years, much attention has been given to the rights of people with disabilities. Legislation and efforts of many consumer groups have spurred facilities modifications to ease access for people with physical impairments, affirmative action to increase employment opportunities and television programming to include realistic role portrayals for people with disabilities. These developments - resulting from the recognition that people with disabilities are indeed valuable and equal members of society - have helped people who have disabilities lead happier, more productive lives. The hospitality industry is also beginning to respond to the needs of disabled travelers and recreationists. Schools grapple with degree to which they're responsible for social, as well as academic, skills.
She was a bright 9-year-old with a high IQ and a flair for creative writing. When she grew anxious and refused to do homework, her parents and school were at a loss. No one considered it a learning disability, until sixth grade when she tried to commit suicide. She was diagnosed with Asperger's Syndrome, a neurological disorder that can interfere with basic social skills.
Still, looking at her academic record, officials in her Maine school district said that while she needed extra support, they saw no reason to place the girl - known as L.I. in court documents - in special education. After all, she'd been able to learn despite her difficulties.
But her parents disagreed with the decision, and have filed a civil rights suit in federal court in Maine.
