Rivals embroiled in smallpox vaccine suit The pharmaceutical firm Acambis has developed a smallpox vaccine, , which it supplies to the US and other governments under a special agreement with the U.S. Food and Drug Administration (FDA). Acambis also has another type of smallpox vaccine, , still in development. In August 2005 the Danish vaccines maker Bavarian Nordic A/S sued Acambis, alleging that Acambis stole Bavarian's trade secrets to develop MVA3000. Bavarian claims that the weakened strain of smallpox the MVA vaccine is based on was protected by Bavarian's patent. Acambis counters that the strain was given to it by the National Institutes of Health (NIH), so Bavarian's suit against Acambis is without merit. Whether or not the suit proceeds, NIH officials will no doubt be facing some awkward questions regarding what happened. Wednesday September 21, 2005 | |
