What Kentucky's Fair Housing Law Means
Kentucky's Fair Housing Law forbids discrimination in housing because of a person's color, religion, race, sex, national origin, familial status or disability. It is unlawful for a real estate operator, broker, or sales agent to:
  • refuse to sell, rent, lease or exchange real property for discriminatory reasons
  • refuse to receive or transmit good faith offers to purchase or rent.
  • deny any services or facilities relating to real property transactions
  • represent that real property is not available for inspection, sale or rental when in fact it is
  • retain a listing with the understanding that the seller plans to discriminate
  • discriminate in the terms or conditions of sale or rental
It is unlawful to coerce, intimidate, threaten, or interfere with any person in the exercise or enjoyment of any housing rights. It is unlawful for a financial institution to:
  • discriminate in the granting, rates, terms, conditions or services of financial assistance in real estate transactions

    Cooperative Problem Solving for Crisis Housing Issues
    The purpose for forming the CPS Team was to bring together the expertise of landlords and tenants to creatively overcome the barriers created for low-income/protected class persons by certain rental application criteria (such as "income three times the rent" and certain credit/rental history/criminal criteria). The CPS Team primarily attempted to make "quick fixes" in application criteria barriers and immediately let some low-income protected/class citizens into the rental market. The CPS Team also outlined the scope of application criteria barriers as they saw it, made long and short term recommendations for lessening the application barriers and clarified the actions required. The CPS Team and the Southern Oregon Fair Housing Project (SOFHP) have succeeded in implementing short term goals and will be seeking resources to implement long term activity beyond the life of this grant.

    Fair Housing The Federal Fair Housing Act, passed in 1968 and amended in 1974 and 1988, protects individuals and families from discrimination on the basis of race, national origin, color, religion, sex, familial status (children in the home), and disability in all housing transactions, public and private. HUD's fair housing programs are the Fair Housing Initiatives Program (FHIP) and the Fair Housing Assistance Program (FHAP). FHIP received funding of only $20 million in FY05. The Administration has proposed to cut funding in FY06 to $16.1 million, a 20% cut. Through this already modest program, fewer than half of eligible fair housing centers are currently funded. With these already limited funds, non-profit organizations carry out the daunting tasks of educating the community (individuals, organizations, the housing industry) about the nation's Fair Housing Act and enforcing the Act with activities including testing. The Administration has also proposed to cut funding in FY06 for the Fair Housing Assistance Program to $22.7 million from $26.5 million, a 15% cut. This program funds state and local governmental agencies conducting fair housing, including civil rights commissions, etc. The Program The Federal Fair Housing Act, passed in 1968 and amended in 1974 and 1988, protects individuals and families from discrimination on the basis of race, national origin, color, religion, sex, familial status (children in the home), and disability in all housing transactions, public and private. HUD's Office of Fair Housing and Equal Opportunity (FHEO) is responsible for the administration of fair housing programs and for processing fair housing complaints. The Civil Rights Division of U.S. Department of Justice is responsible for litigating on behalf of the federal government in cases of fair housing violations.
