Liechtenstein Time and Date Liechtenstein Government Back to Top According to the Constitution, the government is a collegiate body and consists of the head of government and four governmental councilors. The head of government and ministers are appointed by the Prince, following the proposals of the Parliament. Amendment to the Constitution or new law have to be adopted by Parliament, signed by both the Prince and the head of government, and published in the Principality's Law Gazette. Prince Hans Adam II is the head of state. He in entitled to exercise his right to state leadership in accordance with the provisions of the Constitution and of other laws. He represents the state vis-à-vis foreign states. He signs international treaties either in person or delegates this function to a plenipotentiary. Some treaties under international law only become valid when they have been ratified by parliament. The Prince's involvement in legislation includes the right to take initiatives in the form of government bills and the right to veto parliamentary proposals. The Prince has the power to enact princely decrees. Emergency princely decrees are possible when the security and welfare of the nation is at stake. A countersignature by the head of government is, nevertheless, required. The Prince has the right to convene and adjourn Parliament and, for serious reasons, to adjourn it for 3 months or to dissolve it. On the basis of the names put forward by Parliament, the Prince nominates the government, district and high court judges, the judges of the Supreme Court, and the presidents and their deputies of the Constitutional Court and of the Administrative Court of Appeal.

The tiny principality of Liechtenstein announced Thursday that it was bringing a case in the World Court against powerful Germany for violation of national sovereignty. Foreign Minister Ernst Walch summoned the German ambassador, Reinhard Hilger, to Vaduz from his embassy in Bern, Switzerland, to give him the news, the government said in a statement. Liechtenstein, with a population of 32,000, has been furious with the government of its 82 million neighbors to the north since 1999, when a leaked German intelligence report alleged that the picture-postcard principality was an international money-laundering center. It was reported that German agents eavesdropped on businesses in Liechtenstein through one of its monitoring centers in Germany's southern Black Forest. The respected German weekly magazine Der Spiegel said the 30-page intelligence report alleged that Latin American drug bosses, Italian Mafia and Russian organized crime acted under the protection of a close-knit web of senior Liechtenstein government officials, judges, politicians, bank directors and financial advisers. Despite its size and lack of natural resources, Liechtenstein is one of the world's richest countries, primarily because of its thriving financial services sector. A number of international reports in recent years have named the principality as a haven for money laundering. New laws tightening controls on banking came into force Jan. 1.

    In a judgment delivered at Strasbourg on 28 October 1999 in the case of Wille v. Liechtenstein, the European Court of Human Rights held by sixteen votes to one that there had been a violation of Article 10 (freedom of expression) and of Article 13 (right to an effective remedy) of the European Convention on Human Rights. Under Article 41 (just satisfaction) of the Convention, the Court awarded the applicant 10,000 Swiss Francs for non-pecuniary damage and 91,014.05 Swiss Francs for legal costs and expenses. 1. Principal facts The applicant, Herbert Wille, a Liechtenstein national, was born in 1944 and lives in Balzers (Liechtenstein). In 1992 a controversy arose between His Serene Highness Prince Hans-Adam II of Liechtenstein (hereafter "the Prince") and the Liechtenstein Government on political competences in connection with the plebiscite on the question of Liechtenstein's accession to the European Economic Area. At the relevant time, the applicant was a member of the Liechtenstein Government. Following an argument between the Prince and members of the Government at a meeting on 28 October 1992, the matter was settled on the basis of a common declaration by the Prince, the Diet and the Government. In May 1993 the applicant did not stand for election of the new Diet. In December 1993 he was appointed President of the Liechtenstein Administrative Court (

The case was referred to the Court, as established under former Article 19 of the Convention , by the European Commission of Human Rights (Òthe CommissionÓ) and by the Liechtenstein Government (Òthe GovernmentÓ) on 24 and 27 October 1998 respectively, within the three-month period laid down by former Articles 32 ¤ 1 and 47 of the Convention. It originated in an application (no. 28396/95) against the Principality of Liechtenstein lodged with the Commission under former Article 25 by a Liechtenstein citizen, Mr Herbert Wille, on 25 August 1995. The CommissionÕs request referred to former Articles 44 and 48 and to the declaration whereby Liechtenstein recognised the compulsory jurisdiction of the Court (former Article 46); the GovernmentÕs application referred to former Article 48.     PR(03)36: Liechtenstein maintains residence requirement for bank directors
    The EFTA Surveillance Authority delivered yesterday a reasoned opinion to Liechtenstein due to the breach by that State of Article 31 of the EEA Agreement. Article 25 of the Liechtenstein Banking Act states that at least one member of the management board and of the executive management must be resident in Liechtenstein and must be provided with an adequate power of attorney, enabling them to represent the institution in relation to administrative authorities and the courts. Article 31 EEA provides for the abolition of all restrictions on establishment between the EEA States, including restrictions on the right of nationals of the EEA States to set up and manage undertakings under the same conditions as are laid down by the law of the EEA State of establishment for its own nationals. Further, all covert forms of discrimination, including residence obligations, which, in practice, achieve the same discriminatory results, are prohibited. This is one of the fundamental principles of the EEA Agreement. Article 33 EEA allows derogations from the fundamental freedom of establishment on grounds of public policy, public security or public health.     According to article 2 of the Liechtenstein Constitution, “ the Principality is a constitutional hereditary monarchy on a democratic and parliamentary basis; the power of the State is inherent in and issues from the Reigning Prince and the people…” The structure of the State is characterized by the dualism of the Reigning Prince and the people. Neither the monarchic nor the democratic principle dominates. The Reigning Prince and the people stand together at the same level.
