Message from the Chair
Legal Aid Ontario (LAO) provides access to justice for people across Ontario. LAO contributes to the health and stability of society as a justice and social service partner. In 2004, we provided more than one million people, often the most vulnerable in the province, with high quality legal aid services. Our clients include seniors, persons with disabilities, youth, single parents, the mentally disordered, the homeless, and residents in the most remote parts of Ontario. LAO is grateful for the Ontario government's commitment to justice and to the Attorney General of Ontario for publicly acknowledging the vital role of legal aid services to the justice system. We have a presence in every region of Ontario, in every courthouse and before every tribunal where significant losses of freedom, income, security or housing are at stake. We play a key role in ensuring confidence in those government institutions which affect the lives of the most vulnerable Ontarians and their families. March 1999 Violence as a Public Health Problem Position Statement: Because of the prevalence of physical and psychological violence in our society, nurses frequently care for the victims, the perpetrators, and the witnesses of physical and psychological violence. In addition, nurses also may be at risk for experiencing violence in the workplace. As members of the largest group of health care providers, nurses should be aware of assessment methods and nursing interventions that will interrupt and prevent the cycle of violence. In particular, the American Association of Colleges of Nursing (AACN) recognizes domestic violence as a special form of violence with a high incidence and prevalence requiring health care interventions. AACN recommends that faculty in educational institutions preparing nurses in baccalaureate and higher-degree programs ensure that the curricula contain opportunities for all students to gain factual information and clinical experience regarding domestic violence. At a minimum, this content should include:
  • acknowledgment of the scope of the problem;

Presentations
It is important that SM-Leather-Fetish groups understand the relationship between the SM community and law enforcement authorities, as well as the numerous legalities that can affect group functions. Once this is accomplished, groups can dispel myths, educate members, and constructively interact with law enforcement as the need arises. This presentation will focus on three aspects: (1) interacting with local law enforcement, (2) avoiding legal trouble, and (3) group considerations.
The Alleged Domestic Violence Call
It is important for SM-Leather-Fetish practitioners to understand law enforcement and the numerous legal issues that can affect us - specifically the response to an alleged domestic violence call. Once this is accomplished, you can constructively interact with law enforcement officers if the need arises. This presentation will focus on two aspects: (1) constructively dealing with officers, and (2) avoiding legal trouble. This workshop does not deal with the "cycle of abuse" or actual domestic violence; instead it is about consensual SM being misinterpreted as domestic violence by law enforcement.

A report of the ad hoc Committee on Legal and Ethical Issues in the Treatment of Interpersonal Violence Table of Contents Introduction Section IV: Collateral Issues Section I: Professional roles Section V: Forensic Psychology ... Section III: Treatment This introduction provides a brief review of the issues faced by psychologists working in the areas of interpersonal violence. The problem includes the perception of a harassing backlash against psychologists who have been involved in interpersonal violence cases and issues. In particular, some psychologists who work with child or elder maltreatment, spousal / partner battering, and adults who recall memories of childhood abuse have been targets or personal and organized harassment. The forms of harassment have included personal threats and picketing of offices, media campaigns, as well as ethic and licensing board complaints and lawsuits. Psychologists who find themselves subjected to a nuisance or unsubstantiated grievance may experience vulnerability, loneliness, PTSD symptoms, or professional and financial consequences. They often experience isolation and secondary traumatization. Our committee was particularly concerned with various organized efforts developed to help alleged perpetrators of interpersonal violence and others pursue board actions, ethics complaints and nuisance lawsuits against psychologists who have served as therapist, forensic evaluator, expert witness, or client advocate for victims of interpersonal violence. Templates to file such complaints have been developed by various groups. In addition, our committee was concerned about the negative perceptions portrayed in the media and among consumers about psychologists and psychotherapy. Such perceptions could have far reaching implications for policy and practice. For example, malpractice insurance carriers may attempt to deny converge to psychologists working with clients who have experienced various forms of interpersonal violence.

Violence and the Family: Report of the APA Presidential Task Force on Violence and the Family Executive Summary
The American Psychological Association's Presidential Task Force on Violence and the Family was convened to bring psychological research and clinical experience to bear on the troubling problem of violence in the family and to make recommendations for solutions. The task force faced a formidable challenge: Although considerable work has been done in areas such as child abuse, partner abuse, dating violence, elder abuse, and adult survivors of childhood abuse, only recently have the disparate forms of abuse that occur in the home been considered as part of a unified field of study with important cross currents and linkages. Furthermore, because standard definitions of key terms have not been adopted, communication across disciplines has been difficult, and much confusion has arisen when researchers and journalists attempt to draw conclusions by comparing studies in which different definitions are used. Title: Domestic Violence Tracking Project Phase II
Applicant/Beneficiary: Saskatchewan Justice DESCRIPTION: The aim of this project is to conduct an evaluation of policies and procedures in police-reported domestic violence cases. Through an examination and evaluation of current policies and procedures in domestic violence cases, the project will provide both, information on current practices, as well as recommendations for changes where necessary. The results of the tracking survey will be used to improve policy, programs and procedures in response to domestic violence. It will also be used to promote new approaches to dealing with reported incidents of family violence.
Title: Elder Abuse - The Hurting Times
Applicant/Beneficiary: DESCRIPTION: The objective of the project is to promote awareness and knowledge about elder abuse among health care professionals, older adults and the general public and develop an innovative support program for victims of elder abuse that is available in their community through their peers. This objective is being achieved through the provision of information sessions on elder abuse to interested peer advocates volunteers and other seniors in their communities, as well as the development of a Speakers Bureau and working with the media.

Violence against womenrape, sexual assault and domestic violenceaffects women worldwide, regardless of class or race. Violence not only affects women in the home, but in the workplace, school and every arena of life. Legal Momentum has long been an advocate of women's right to live free from violence. As the chair of the National Task Force to End Sexual and Domestic Violence, Legal Momentum was a proud leader of the original push to pass the Violence Against Women Act (VAWA) in 1994, as well as VAWA II in 2000, which strengthened the law and reauthorized it through 2005. Currently, Legal Momentum is working hard to eradicate discrimination against victims of violence in housing and in the workplace. Also, the organization is fighting for welfare reform that addresses the needs of violence survivors, and rejects the push for coercive marriage promotion. Legal Community Against Violence provides legal assistance to advocates and community leaders seeking local and statewide regulatory solutions to prevent gun violence.
  • We provide gun violence prevention activists with the legal expertise and support they need to spearhead initiatives for stronger gun policies.
    We advise state legislators and agency officials requesting legal analysis of legislative and regulatory options to prevent gun violence.
    We assist mayors, city council members, county supervisors and other local officials in developing policies to enhance the safety of their communities and stimulate positive changes at the state and federal levels.
    We help government attorneys to assess the adequacy of existing laws and develop recommendations for new laws and regulations to prevent gun violence.
    Law enforcement officials consult us for legal information to strengthen the enforcement of laws already in effect and to evaluate the viability of potential new violence prevention strategies.

A Transformative Public Legal Education Project Introduction
West Coast LEAF has received a grant from the Law Foundation to carry out the Project: Civil Legal Rights of Abused Women: A Transformative Public Legal Education Project. The project will be managed by the BC Institute Against Family Violence, in conjunction with the Vancouver Custody and Access Support Society. WCL has formed a project management committee consisting of: Heather Paton, chair, Public Legal Education Committee, WC LEAF; Alison Brewin, Executive Director, WC LEAF; Penny Bain, Executive Director, BCIFV; and Nancy Drewitt, Ajax Quinby (Munroe House), and Zara Sulemann (currently with Immigrant Services Society). The project will also have an advisory committee consisting of volunteers from the Public Legal Education Committee, VCASSA and other representatives of women's advocacy organizations. Purpose Overall Objectives : The overall objective of the Project is to ensure that BC women who experience violence in intimate relationships have access to legal information and education to assist them to resolve civil legal issues related to custody and access.

What special protections do I have as a victim

of domestic violence applying for or receiving public assistance?
What is a waiver? Why would I need a waiver? ... What if I am denied a waiver? What special protections do I have as a victim of domestic violence applying for or receiving public assistance?
If you are a victim of domestic violence, you may be eligible for a waiver of certain public assistance program requirements that would place you or your children at further risk or make it more difficult for you to escape from violence . All applicants and recipients of public assistance must be screened for domestic violence pursuant to the New York Family Violence Option (FVO).
You may also be referred to counseling and supportive services. Your participation in these programs is not mandatory. You cannot be sanctioned (i.e. lose your public assistance benefits) for failing to comply with the referrals.

GENDER PROJECT PUBLICATIONS
Zikhethele: Using the Law to end Domestic Violence The Domestic Violence Act 116 of 1998 came into operation on 15 December 1999. This new Act was generally welcomed for trying to fill in gaps in the preceding legislation. Unfortunately, the Act is quite complicated and not always easy to understand. For this reason, the Gender Project, in association with Tshwaranang Legal Advocacy Centre, has produced a booklet to explain the new legal provisions in accessible language. The booklet also sets out other legal options available to victims of domestic violence, such as making a case with police, getting divorced from the abuser and claiming maintenance for young children.
Pamphlet produced by the Gender Project, 2000 The Gender Project has produced an information pamphlet which sets out the different ways in which the law can deal with sex work. The pamphlet explains which acts are currently against the law in South Africa, and then briefly defines the different legal options, namely decriminalisation, legalisation and criminalisation. It also explains the practical implications of each legal model. The Gender Project has also completed a paper on the possible implications of legalisation for outdoor sex workers in South Africa.
