T he Tenant Housing division at DLS provides legal services to tenants who are being treated unfairly by their landlords. Types of cases we accept: Other cases may be accepted or rejected at the discretion of the clinic review counsel, according to geographic and financial criteria, and details of the particular case. Types of cases we do not accept: We do not represent tenants who are not covered by the Tenant Protection Act. This may include tenants in the following situations:
  • Tenants who wish to bring a claim against other tenants Tenants in public housing or school residences Tenants who share a kitchen or bathroom with their landlord
We do not accept any claims by landlords, nor do we give out advice to landlords. If you are a landlord who needs advise, please call the Landlord Self-Help Centre at (416) 504-5190 or 1-800-730-3218.

Equal Access To Justice Tenant's Rights Landlord-tenant relationships in Delaware are governed by two separate codes, the Residential Landlord-Tenant Code and the Mobile Home Lots and Leases Act . The Residential Landlord-Tenant Code, found beginning in Chapter 51 of Title 25 of the Delaware Code, generally applies to all private, non-commercial landlord-tenant relationships where the rental unit is not a mobile home in a mobile home park. Consequently, the Mobile Home Lots and Leases Act, found at Chapter 70 of Title 25 of the Delaware Code, applies to the rental of a mobile home in a mobile home park. All subsidized housing rentals in Delaware are governed by the Delaware Residential Landlord-Tenant Code. However, there are Federal regulations which also apply to these tenancies which may give the tenant greater or lesser rights in certain instances. If you have a problem with your landlord you should contact CLASI as soon as possible to see if you qualify for our assistance.

Koch (1988): This state court case challenged proposed middle and upper income housing developments in the Lower East Side on grounds that the site was a former Urban Renewal site and former tenants had a right to return to any housing built on the premises.     We are approaching the end of the first round of radical changes in the statutes relating to HUD's housing programs, with the eventual enactment of a Fiscal Year 1996 appropriations act for those programs. That act will make a series of changes that will produce implementation decisions at the local level and give rise to new legal issues to be addressed over the next 12 months. Sometime within that same period, it is likely that Congress will make additional changes in federal law, either through housing authorization legislation now being considered or by a FY 1997 appropriations act. That legislation, whatever its final form, will raise additional issues to be examined and dealt with locally. This article is intended to begin a discourse about what impact these changes will have upon people who participate or seek to participate in HUD's housing programs. How these problems should be addressed will vary. Some may raise sufficient questions of illegality that they would be appropriate for litigation. Others might be resolved favorably through state legislation or local government ordinances. Still others will be decided by local housing authorities or subsidized landlords by some process in which tenants and applicants will have to fight to make their voices heard and have their interests protected.

    Part 2
    The saga of the ongoing efforts to radically change the statutes relating to HUD's housing programs continues. The Fiscal Year 1996 appropriations act for those programs, which would have made several significant changes, was vetoed by the President. In its place, Congress enacted the Balanced Budget Downpayment Act that kept the government running until March 15, 1996. That act not only made funds available but also amended the substantive housing law for Fiscal Year 1996 in several respects, including:
    • Suspending federal preferences
    • Granting HUD unfettered discretion to manage and dispose of HUD-owned multifamily projects
    • Imposing minimum rents
    • Loosening up ceiling rents and deductions for earned income
    • Delaying reuse of certificates and vouchers
    • Mandating HUD to renew expiring Section 8 contracts
    • Virtually repealing the single-family mortgage assignment program.
