The Ohio Legal Rights Service (OLRS) has written many publications about different issues that affect people with disabilities. These publications are available to download at no charge from the OLRS Web site. Most publications are also available in hard copy and special formats upon request ( contact OLRS for more information). The following is a list of publications about housing and people with disabilities. The information provided in any OLRS publication is not a substitute for legal advice. Renters Have Important Legal Rights
A rental contract between a tenant and a landlord is called a lease. Whether the contract is written or oral, it is still enforceable. Lease periods of more than one year must be in writing. It is always a good idea to have your lease in writing so that the agreement is clearly outlined in case of a dispute. Read your lease before you sign it. If there are terms in the lease you do not like, change them before you sign. Kansas law prohibits certain terms in lease agreements. A lease cannot:
  • waive your legal rights as a tenant; or require you to pay for the landlord's attorney fees if the landlord sues you.
These clauses cannot be enforced by the landlord even if they are included in the lease you sign. By law, both you and the landlord must conduct an inventory of the apartment within five days of your taking possession. The inventory should list the condition of the apartment, furniture and appliances at the time you move in. Take as much time as you need to thoroughly inspect and write down the condition of all areas of the apartment. You and the landlord should sign and date the inventory and keep a copy.

    SECONDARY SUITES:
    A Call for Safe and Legal Housing
    Secondary suites are an innovative response by British Columbians to their housing needs. Safe, legal secondary suites can provide a healthy and affordable alternative form of housing for the growing number of renters in the province today. The majority of secondary suites are considered illegal as a result of municipal zoning by-laws which favour single-family dwellings. This bias has proven to be a nightmare. Tenants are threatened with the loss of their home, homeowners risk defaulting on their mortgages, and communities are divided by bitter debate; all the consequence of municipal and provincial government inaction. The appropriate and necessary response to the current unsatisfactory situation would be province-wide legalization of secondary suites as a right in all single-family dwellings.
    The Housing Situation Today
    In British Columbia today, decent, affordable rental housing with secure tenure is an increasingly scarce resource, largely as a result of land speculation and a dramatic increase in population. Average net in-migration to B.C. for the five-year period between 1986 and 1991 was 25,000 people each year. In 1994 alone, net in- migration to the province climbed to over 50,000. The “free market” failure to create new rental housing in response to the growing demand, and the steady erosion of the existing rental supply due to demolition, renovation, and condominium conversion, have greatly exacerbated an already critical situation.

    Resident Participation in Public Housing:
    Making It Effective
    The New York City Housing Authority (NYCHA) will receive $3.8 million annually, for the next two years, to turn over to its resident advisory structure. How these resources are used is an important question. NYCHA is the nation's largest housing authority, and reputedly the best. But its participation structure has not been effective in representing resident interests over the recent period of federal and local policy shifts, with potentially adverse effects on residents. The stakes are particularly high in New York City. In a tight rental market, the city relies heavily on public housing as its primary low-income housing resource: 182,000 units in 342 developments a twelfth of the city's rental units house nearly 600,000 residents. The preservation of this stock as a low- income housing resource will depend on how residents weigh in on NYCHA plans and decisions. This paper reviews the recent record of resident participation and offers recommendations for more effective resident involvement.
    Policy Background
    Housing authorities para-governmental bodies that localities create to develop, own, and manage public housing under federal funding have existed since the 1930's. But visible failures in many large cities and a two-decade, federal withdrawal from housing have left them with a backlog of capital needs and inadequate federal subsidies, both for operations and capital improvements.

The Regulatory Agreement for these projects will include an addendum requiring that the project be operated in compliance with HOME requirements for affordability, tenant protections, housing quality and income determinations.     9.0 TERMS AND CONDITIONS
    9.1 Supervision of Works The Council will clearly state in the offer of assistance if the work is to be carried out on an agency basis otherwise the responsibility for supervision of works rests with the applicant in conjunction with any suitably qualified and indemnified professional or agent he may appoint for that purpose.
    9.2 Payment of Assistance: conditions as to carrying out of the works
    The assistance will only be paid if –
  • the assisted works are completed within twelve months from the date of approval of such further period as the Council may allow.
  • the assisted works are carried out in accordance with such specifications as the Council determine
  • the assisted works are carried out by one of the contractors who estimates accompanied the application
  • the assisted works are executed to the satisfaction of the Council, and
