    Introduction These pages provide a brief overview of Anglo-American legal history including the nature of Anglo-Saxon folk law with its ritual oath swearing, blood feuds and ordeals, the development of royal justice and the debate over the causes of legal centrism, the origins of the common law in the writ system and some Massachusetts legal history. Anglo-Saxon folk law In 1818, the defendant in a rape-murder trial threw down a gauntlet and announced he would defend the case "by my body" to a startled Court of King's Bench (Ashton v. Thornton (1818) 1 B. & Ald. 405). The defendant had opted for an obsolete trial by battle that remained the law of England until it was repealed by parliament the same year. Trial by battle was the legal successor of the blood feud which was used to settle disputes by the Anglo-Saxons before the Norman conquest of England in 1066. Under this arrangement people organized themselves into groups called households, swearing oaths of mutual protection. If someone was injured or property was stolen, all the members of his household would take an active part against the violator's household. The result could be violent blood feuds and vendettas. However, since the blood feud could be very unpleasant and destructive the parties often met to settle the dispute before a special public assembly called a moot. Hostages could be exchanged to create trust and an atmosphere conducive to settlement negotiations. Social scientists speculate that the blood feud decreased the level of violence and fostered peaceful dispute resolution because the consequences of any one transgression were so severe.

    Encountering the Past: History at the Yugoslav War Crimes Tribunal

    Robert Donia received his Ph.D. in history at the U-M in 1976 specializing in Southeastern Europe. He is a frequent consultant to the International Criminal Tribunal for the former Yugoslavia. He lives in San Diego, California and is an adjunct assistant research scientist, Center for Russian and East European Studies at the U-M. The International Criminal Tribunal for the former Yugoslavia (ICTY) has been in business a little over 10 years. Many critics, led by Bush Administration officials, have argued that the proceedings have dragged on too long and that ICTY should conclude its work in the next few years. I disagree. Well below the radar of the international media, the tribunal's recent judgments have demonstrated a thorough, careful and conservative application of international humanitarian law to the crimes of the Yugoslav conflict. This development should be hailed, rather than scorned, by Americans and their government. When the trials began, most judges were wholly unfamiliar with the history and culture of the region in which the alleged crimes were committed. Appointed by the UN Secretary General, judges have come from China, Guyana, Jamaica, Korea, Malta, Morocco, the United States and over two dozen other nations, but none from the region of the former Yugoslavia. As part of their cautious approach to decisions, judges have carefully considered the implications of the region's history in the cases they try. International law and regional history have met one another in the Hague tribunal's three courtrooms. In an unusual series of confrontations between rival interpretations, the prosecution and defense have each engaged historians as expert witnesses to aid the judges in reaching their decisions. The tribunal's caution and thoroughness can be seen at the nexus of law and history in its recent judgments.

Lipstadt's "Denying the Holocaust: The Growing Assault on Truth and Memory" dissected a fringe, relatively isolated phenomenon of hard-core deniers. By the time she walked into a British court in 2000 to defend herself against a libel suit filed by one of those deniers, David Irving, Holocaust denial had been so transformed as to have become a critical part of the mushrooming global anti-Semitic movement.     History of the Old Court House
    Santa Clara County was once part of Spain, and then part of Mexico. Prior to California being admitted to the union, our local court was held in Juzgado (a combined court, mayor and jail building) from about 1805 to 1850. The Juzgado was located at what is now the intersection of Market and Post Streets in downtown San Jose. The adobe building was inadequate for the increased community usage and was destroyed in July 1850. Later, after the formation of Santa Clara County on April 25, 1851, a number of buildings served as courthouses.
    The eighth courthouse is the building known now as the Old Courthouse, still in use and located across from St. James Park in downtown San Jose. In 1866, Valley residents began erecting this Neo-Classical monument in an attempt to persuade the California government to re-locate the state capital to San Jose. San Jose did not regain the capital, but this effort resulted in the construction of one of the most prestigious courthouses in the United States. This courthouse has served the public well for over a century. Today it serves as one of the numerous Superior Court of California facilities in Santa Clara County.

    The diversity of our student population and our small class sizes, ranging from 6 to 50 students in each class, is significantly different than the traditional law classroom setting. It provides opportunities for rich and challenging discussions of legal and social issues.
    The following list offers course descriptions for both elective and required courses that have been offered in recent years. Electives may not always be offered on a regular basis.
    Administrative Law
    Administrative agencies permeate American society. They regulate such areas as advertising practices, unemployment insurance, the quality of food and interest rates. This course studies the functions of these local, state, and federal agencies from a theoretical, political, and practical perspective. Emphasis is placed on the interplay between agencies, special interest groups, legislatures, the executive branch, and the judiciary.
    Advanced Legal Concepts
    An overview of the methodology utilized in problem solving, applicable as well in the various components of the California Bar Exam. Extensive exercises build skills in approaching essay questions, multiple choice questions, and the performance section of the exam.
    Children's Rights
    This course surveys cases and materials on the rights children possess within different settings or stages in their lives. For example, the rights of children within the hospital setting, while at home and within the family, while at school, at work, or when they have been arrested or have been made wards of the courts will be covered. The course will also touch on the varied problems of children and their rights when injured, neglected, or abused.

    Introduction
    At the conclusion of the war, the Allied nations formed an International Military Tribunal charged with the task of prosecuting Nazi war criminals. The United States Prosecutor, Robert Jackson, articulated the three areas of prosecution to be pursued: It is my purpose to open the case, particularly under Count One of the Indictment, and to deal with the Common Plan or Conspiracy to achieve ends possible only by resort to Crimes against Peace, War Crimes, and Crimes against Humanity. (Trial of the Major War Criminals before the International Military Tribunal. Volume II. Proceedings: 11/14/1945 -11/30/1945.) Crimes against Humanity" was the category for the brutal murder of millions of innocent civilians. No specific international agreements existed, simply because the signatories to the Geneva and Hague agreements had never imagined that the kinds of atrocities the Tribunal would have to consider could ever be an issue among civilized nations. There were four main prosecutors representing the United States, Great Britain, France and the Soviet Union. The first issue of the Tribunal was to deal with the charge of "Crimes Against Humanity," specifically the Nazi conspiracy to exterminate the Jews of Europe. The trial opened on November 20, 1945. Justice Robert Jackson, the United States' chief prosecutor, gave the

    The Utah Code is the compilation of the laws of the state passed by the legislature. There are two print versions of the Utah Code: The Utah Code Annotated, 1953 ed. is a hardbound, multi-volume set that contains the Utah Code together with commentaries or explanations at the end of each section of the Utah Code. These commentaries are not part of the official code but may be helpful in interpreting the law. They include a legislative history, collateral references, cross references, compiler's notes, annotations, and comparable provisions. The Utah Code Unannotated is a softbound, five-volume set that contains only the actual text of the current laws of Utah and is published each year to incorporate changes made in Utah's laws by the Legislature. The current text of the Utah Code is available on the Utah Legislature's website . Print copies of the code are available at Utah State Law Library and many public libraries. The Utah State Law Library also has a complete historical collection of Utah Codes.

    Senate Tries Supreme Court Justice Samuel Chase On November 30, 1804, for the third time in its brief history, the Senate began an impeachment trial. The first trial in 1798 and 1799 had involved a senator previously expelled on grounds of treason. Because that senator no longer served, the Senate dismissed the case citing lack of jurisdiction. The second trial, in 1804, removed a federal judge for reasons of drunkenness and probable insanity. More than the first two proceedings, however, third trial challenged the Senate to explore the meaning of impeachable crimes. Samuel Chase had served on the Supreme Court since 1796. A staunch Federalist and a volcanic personality, Chase showed no willingness to tone down his bitter partisan rhetoric after Jeffersonian Republicans gained control of Congress in 1801. Representative John Randolph of Virginia orchestrated impeachment proceedings against Chase, declaring he would wipe the floor with the obnoxious justice. The House accused Chase of refusing to dismiss biased jurors and of excluding or limiting defense witnesses in two politically sensitive cases. Its trial managers hoped to prove that Chase had "behaved in an arbitrary, oppressive, and unjust way by announcing his legal interpretation on the law of treason before defense counsel had been heard." Highlighting the political nature of this case, the final article of impeachment accused the justice of continually promoting his political agenda on the bench, thereby "tending to prostitute the high judicial character with which he was invested, to the low purpose of an electioneering partizan."
