The National Assembly's Jan 2 approval of a law authorizing the formation of a special tribunal to hold accountable the architects of the murderous Pol Pot regime is a landmark that if implemented with goodwill and integrity by both the UN and the Cambodian government could chart new frontiers for international law and justice.
COMMENT
Potentially it could also have a profound effect on Cambodian society by taking the first step to ending its culture of impunity and exorcising the ghosts of the past.
However this legislative landmark, which finally addresses the tragedy that has haunted Cambodia since 1979, does not satisfy some human rights organizations.
But according to analysts, the draft law unanimously passed by the National Assembly does not seriously alter the main substance of the prior agreement with the UN.
Critics of the joint UN-RGC MOU which has underpinned the KR trial draft law have homed-in on weaknesses of the Cambodian judiciary. But after such a tortured process of negotiations and often acrimonious ping-pong between the UN and Phnom Penh, some shortcomings are the product of mutual suspicion and acceptable compromise.
Undeniably, the credibility of the tribunal will hinge on Hun Sen's capacity to allow the tribunal to make decisions he disagrees with and its resistance to the political manipulation that plagues Cambodian courts.

However, for busy people with plenty of things to do, you may find this of some use. 1492-Columbus finds land in the New World (the present Bahamas). 1497-John Cabot sights the North American continent. 1507-The name "America" is the name erroneously given this new continent, apparently in honor of the Italian explorer, Amerigo Vespucci. 1521-Ponce de Leon lands in what is now Florida to attempt to settle it. He is wounded in a fight there, and dies in Cuba. 1565-First European settlement of North America occurs in St. Augustine, Florida. 1584-Sir Walter Raleigh discovers land he calls Virginia, after the virgin queen, Elizabeth. 1587-Virginia Dare is born, first English child born in current United States.

Legal History of Three Mile Island
Three Mile Island-1 (TMI-1) , came on line in September 1974 at a cost of $400 million. Legal intervention was conducted by the Environmental Coalition on Nuclear Power (ECNP) based in State College. Three Mile Island-2 (TMI-2) came on line in December 1978, and was grossly over budget and behind schedule. Legal intervention was conducted by the ECNP and Three Mile Island Alert (TMIA). The plant had been on-line for just 90 days, or 1/120 of its expected operating life, before the March, 1979, accident. One billion dollars was spent to defuel the facility. Three months of nuclear power production at TMI-2 has cost close to $2 billion dollars in construction and cleanup bills; or the equivalent of over $10.6 million for every day TMI-2 produced electricity. The above mentioned costs do not include nuclear decontamination and decommissioning or restoring the site to "Greenfield." The loss-of-coolant, core melt accident began on March 28, 1979, at 3:56 a.m. The plant came within 30 minutes of a full meltdown. The reactor vessel was destroyed, and large amounts of unmonitored radiation was released directly into the community. Later in the day at 4:30 p.m., a press conference was convened by of Lt. Governor William Scranton:

Aims
Because of the widely different juridicial and historical background of the students, this course is a reading course. The students choose, individually or in small groups, a topic in the field of continental legal history on which they read some books and articles. Through these readings and through discussions the students can obtain a deeper insight into the historical dynamics and evolutions of the chosen topic.
Previous knowledge
A good knowlegde of European History in general and in particular of good knowlegde of European Legal History.

This course will survey American legal history from colonial times to the end of the Civil War, emphasizing the ongoing relationship between legal development and general social, economic, political and intellectual trends. Topics to be covered in this process include the early New England legal codes, the origins of American slavery, the place of women in colonial law, the Salem witchcraft trials, the rise of the American legal profession in the eighteenth century, the impact of economic growth and industrialization on early nineteenth-century American legal doctrine, the development of the American prison system, the codification movement, and the methodology of American legal education prior to the Civil War. Legal Studies and Criminology Option
The Legal Studies and Criminology Option is intended for students who wish to develop a broad understanding of the impact of law and the legal system upon society through legislatures, courts, law enforcement agencies and the penal system. It is designed especially for students with interests in careers related to these institutions, such as the legal and para-legal professions, policing, corrections, and social work. The Legal Studies and Criminology Option is open to students in General or Honours Academic Plans. Courses for the Option are divided into Interdisciplinary Courses (Section 1), Legal Studies (Section 2), and Criminology (Section 3). Part A in the Legal Studies section includes courses considered to be foundational to an understanding of legal systems. Students are required to select a minimum of two courses from this section. Section B contains courses that focus on specific types of legislation and courses that deal more generally with political, ethical and legal issues relevant to modern social life. Students must select a minimum of two courses from Section B. The Criminology side of the Option (Section 3) focuses on crime and the criminal justice system. Part A contains courses that critically examine theory and research on crime and delinquency. Part B courses deal with a variety of topics related to crime and the administration of the criminal justice system, conflict resolution, victimology, and the criminal law. Students must complete a minimum of two courses from Part A and two courses from Part B of Section 3 Criminology Courses.

LHR 17:1 (Spring 1999) The People versus Zephyr Davis: Law and Popular Justice in Late Nineteenth-Century Chicago
Abstract
In Chicago in 1888, Zephyr Davis was tried, convicted, and executed for the murder of Maggie Gaughan. The case sparked considerable public interest; mobs threatened to kill Zephyr before the law could act, and a variety of groups used different moments in the case as an opportunity to protest the workings of law. This article uses the Davis case as a way of examining the relationship between formal law and popular, or extra-legal, expressions of justice in late nineteenth-century Chicago. In addition to the lessons it teaches about the intersection of law and popular justice in that specific place and time, the case raises more general questions about the rule of law and its relation to justice.

Legal Requirements/Court Cases The most current language of the federal mandate concerning inclusive education comes from the 1997 Amendments to the Individuals With Disabilities Education Act (IDEA). These federal regulations include rulings that guide the regulation. The IDEA r equires that children with disabilities be educated in regular education classrooms unless "the nature and severity of the disability is such that education in the regular classes with the use of supplementary aids and services cannot be achieved satisfac torily." This means that schools have a duty to try to include students with disabilities in the regular general education classes. http://www.ed.gov/offices/OSERS/IDEA/q_and_a.html. The IDEA states:
"Each State must establish procedures to assure that, to the maximum extent appropriate, children with disabilities ... are educated with children who are not disabled, and that special education, separate schooling, or other removal of children with disa bilities from the regular educational environment occurs only when the nature or severity of the disability is such that education in regular classes with the use of supplementary aids and services cannot be achieved satisfactorily." 20 U.S.C. 1412(5)(B). Dr. Susan Etscheidt, professor of special education at UNI and one of five Iowa administrative law judges, notes that in one of the first court cases to question the legal interpretation of the 1990 IDEA the Supreme Court said no one is excluded from t his requirements; everyone is entitled to a free and appropriate public education (FAPE).
