a News and events The Forbes Society is pleased to announce the publication of Dowling's Select Cases, 1828 to 1844: Decisions of the Supreme Court of New South Wales . At his death in 1844, Dowling left behind about 250 judicial notebooks from his time on the NSW bench. Among them was a collection that he called 'Select cases'. Dowling had intended to publish these as the first law reports in any Australian colony. Now, after a delay of 160 years, the Forbes Society intends to publish them. Edited by barrister Tim Castle and Macquarie University professor Bruce Kercher, this will be a single hard cover volume of 1120 pages containing 465 cases and a detailed introduction about the work of the court and the judges. Published in conjunction with the Council of Law Reporting for New South Wales, this limited edition volume will be available for purchase in late March 2005 at a retail price of $100 (inc. GST) plus $10 postage and handling. The third annual Francis Forbes Lecture was presented by Tim Castle of the NSW Bar and Professor Bruce Kercher of Macquarie University, under the chairmanship of Andrew Tink MP, Shadow Attorney General for NSW, in the Common Room of the New South Wales Bar Association on Thursday, 14 October 2004.

I. Introduction
Research in the history of crime and punishment requires the use of a variety of sources. Very often, it is necessary to consult sources beyond traditional cases and statutes. For this purpose, there are many finding aids, which can be used to locate pertinent primary materials. Also useful are topical treatises, bibliographies, historical compilations and online Internet sites devoted to the history of a particular subject. These secondary sources often also provide citations to primary and additional secondary sources. There are many, many more sources of information on this topic than can be listed here, so this guide gives only an overview of print, micro-media and Internet resources available to facilitate research in the history crime and punishment at the Georgetown University Law Center. Call numbers given are specific to the Edward Bennett Williams Library collection. The designation SPECL indicates the material is in Special Collections, and must be used there.

When legal history is taught as a seminar, the professor and the students agree on a general broad topic of the law, papers are written on various aspects of the details of the general topic. The purpose of the legal history seminar is to give each student the opportunity to go into the historical background of a single point of current law. By having all of the students write within the same general field, it is hoped that the students will see various aspects of their own specific topic and of the general topic from different points of view. Also, the entire field will be put into a historical perspective. The course begins with a lecture on the general subject by the professor, then the students present their draft papers to the class for discussion and comment, and then the first draft is rewritten in the light of consultation with the professor and of the classroom participation from the other students.

Comments to: will.hilyerd@louisville.edu Kentucky Legal History Bibliography Introduction Situated on the edge of the great regions of American historythe Old South, the Great Midwest, the Western FrontierKentucky's history (at least that falling after the days of Daniel Boone) has been neglected by America's most famous historians. The gaze of Francis Parkman, George Bancroft and Frederick Turner barely grazed the bluegrass plains, limestone creeks and smoky hollows of old Kentucky. However, the commonwealth's legal history has sparked more interest. As one of the American states most devoted to Jeffersonian democratic principles, the early history of Kentucky saw a sharp conflict between English legal traditions and popular discontent with the received common law principles of contact and property law. The law and the courts were the frequently the center of political struggles over monetary policy, land law and nationalism. More than any other state, early Kentucky legislators sought to explicitly promote a native strain of the common law by prohibiting by statute the citation of any British legal text that postdated the establishment of Virginia, Kentucky's mother state, in 1640, and by underwriting the publication of Kentucky statutes and case reports. The period between 1790 and 1851 saw the development of a whole body of Kentucky legal texts, including reports of cases, legal treatises and statutory compilations, and the later half of the century saw the development of modern digests, form books and treatises.

2350 BC: Urukagina's Code
This code has never been discovered but it is mentioned in other documents as a consolidation of existing "ordinances" or laws laid down by Mesopotamian kings. An administrative reform document was discovered which showed that citizens were allowed to know why certain actions were punished. It was also harsh by modern standards. Thieves and adulteresses were to be stoned to death with stones inscribed with the name of their crime. The code confirmed that the "king was appointed by the gods".
2050 BC: Ur-Nammu's Code
The earliest known written legal code of which a copy has been found, albeit a copy in such poor shape that only five articles can be deciphered. Archaeological evidence shows that it was supported by an advanced legal system which included specialized judges, the giving of testimony under oath, the proper form of judicial decisions and the ability of the judges to order that damages be paid to a victim by the guilty party. The Code allowed for the dismissal of corrupt men, protection for the poor and a punishment system where the punishment is proportionate to the crime. Although it is called "Ur-Nammu's Code, historians generally agree that it was written by his son Shugli.

Irish Studies Review 'This collection of previously published articles is an eclectic mix. The subjects dealt with vary from legal training to the penal laws; while the periods under discussion stretch from the present to the twelfth century. In truth, the contents of the book have only two binding elements: common author- ship and a relevance to the history and development of the law and legal administration in Ireland. Given these circumstances it would be impossible to offer here a full review of every item. 'here are, however, a number of points in general which should be highlighted, and a few matters which require specific attention.
The vast majority of those with an interest in any aspect of Irish history will find something to draw attention in this book, and will be the wiser for reading it. Afghan Legal History Project The Islamic Legal Studies Program (ILSP) at Harvard Law School launched a research initiative in the summer of 2003 to examine the legal history of Afghanistan. The Afghan Legal History Project (ALHP) brought together a group of five full-time researchers and a volunteer reading and discussion group that regularly generated feedback to the researchers as their work progressed. In addition, the project brought several scholars of Afghanistan and field experts to ILSP to conduct seminars and give lectures over the course of the summer to shape group discussion and research. The idea for such a project began with a visit by the Director of ILSP, Frank Vogel , to Kabul in the fall of 2002, where he immediately recognized that reconstruction efforts were crippled by a lack of understanding of numerous issues concerning the role of law in Afghanistan. Sensing the urgent need for knowledge of the Afghan legal system, not only through organizing readily available facts, but also through putting together a nuanced understanding of the complex history of the legal system, he inspired the creation of the Afghan Legal History Project. Making its primary lens Islamic law, the project attempted to focus on the unique role Islam plays in Afghanistan, in its various manifestations, and as it exists alongside and sometimes in opposition to customary law, tribal law, and positive law. The team's starting point was that Islamic legal history is an essential and hitherto under-utilized tool for understanding current events, and that Afghanistan in particular offers an extraordinarily dramatic yet exemplary and instructive chapter in modern Islamic legal history. Appreciation of the role of Islam in Afghanistan's legal past is vital to ongoing efforts to establish a viable legal system for the future of the country and its people.
