The American Bar Association recently made the rule less restrictive. It permits but does not require lawyers to disclose confidences to prevent, quote, "reasonably certain death or substantial bodily harm." Introduction to legal ethics
    A legal practitioner is bound by the general principles of professional conduct set out in section 64 of the Legal Practice Act 1996 Each practitioner must:
    • Act in accordance with the general principles of professional conduct. Discharge obligations in relation to the administration of justice. Supply legal services of the highest standard, unaffected by personal interest.
    Legal practitioners have to balance duties to the law, the court and the client.
    • Duty to the law: A legal practitioner is part of the administration of our legal system. They may not agree with some of it and are entitled to lobby for its reform, but they must obey the existing laws. Duty to the court : A legal practitioner must act with honesty, integrity and candour and must discharge all duties owed to a court or tribunal, including undertakings. Duty to client:

    A Plug for Inns of Court
    At my American Inn of Court last night, we hosted a delegation from Gray's Inn , led by Master Sir Duncan Ouseley, who shared some thoughtful remarks about the importance of judicial independence and the rule of law. Two students from Santa Clara mooted a contract case against some pupils from Gray's Inn, and two US judges joined Sir Duncan on the moot court bench. I strongly recommend that law students check to see if they can participate in an Inn near them. Particularly for 2Ls/3Ls, it's a great way to begin the transition to practice. The lawsuit financing industry survived an important appellate court ruling . Critics of the industry say it is a form of predatory lending and that it deprives the plaintiff of control over the suit. Supporters say the industry provides plaintiffs money to stay afloat. Typically, the financer pays a sum to the plaintiff and collects a large fee if the plaintiff wins and collects nothing if the plaintiff loses. Model Rule 1.8(e)

    Return to Articles legal.online Column 45, November 1998 In Search Of Ethics On The Internet By Robert J. Ambrogi Lawyers get a bum rap. Seen by many as ruthless and greedy, they practice perhaps the most ethical of professions. Bound by strict codes of conduct, almost everything they do from counseling clients to marketing their firms must conform to prescribed standards. The Internet is critical to helping not just lawyers, but also the broader public, understand these rules more thoroughly. Here is a look at some of the sites that do just that. The American Legal Ethics Library http://www.law.cornell.edu/ethics , from Cornell's Legal Information Institute, contains the full text of the professional-conduct codes or rules for most U.S. states, as well as the ABA's model code. Some are published by the LII, others are included through links to state bar or court sites. In addition, several law firms have contributed narratives on professional-conduct law in their respective states. So far, the narratives cover California, the District of Columbia, Florida, Illinois, New York, Pennsylvania and Texas, with other states to be added. Law Journal EXTRA! Professional Responsibility

    COURSE COVERAGE
    The basic ethics seminar course covers a traditional ethics curriculum in a relatively traditional order. It begins with the client-lawyer relationship, proceeds through a lengthy analysis of the tension between the client-lawyer relationship and the lawyer's obligations to the justice system and society, and concludes with discussions of economic issues (billing, advertising and solicitation, legal services and pro bono work). The course specifically addresses both bias and substance abuse in the profession, and has among its recurring themes the pressures faced by young law firm associates, the effect of a law firm's "culture" on the ability to practice ethically, and the tension between acting morally while remaining within the bounds of legal ethics. Course coverage also focuses on several practice areas often unrecognized or minimized, which we find will directly impact working lives of many of our students. The most significant of these issues are:
    • the ethical dilemmas facing insurance defense counsel;
