The development of a virtual online space where lawyers can advertise, chat, make and answer posts, send and receive e-mail, find clients and communicate with them, has happened so fast that most codes governing lawyer conduct have not had a chance to catch up. That does not mean that there are no rules governing online conduct. It means that you may have to look farther than the published Canons or Rules of Professional Conduct in a jurisdiction to find the policies that exist or are being developed to govern lawyer conduct in Cyberspace. Since legal ethics rules vary by jurisdiction, it is not possible to generalize with complete confidence about what requirements now exist. But it is possible to identify trends and to use certain jurisdictions as examples of those trends. That is the approach taken here. Published rules generally do not address online realities because they were adopted before lawyers went online. The old Canons of Ethics were first adopted by the American Bar Association in 1908. The Model Rules of Professional Conduct were promulgated by the American Bar Association in 1983. The first law related site on the World Wide Web was the Cornell Law School site, and it opened its virtual doors in 1993. Most lawyers did not discover the Web until years later. This example shows several things. First, it demonstrates that regulatory authorities are unlikely to understand the Internet as well as some of the practitioners who are on the cutting edge. Second, it shows that regulatory authorities are likely to regulate by analogy, and what analogies they choose will make a big difference in the outcome. Since they tend not to understand Cyberspace that well, their analogies may be flawed. Third, there is a big need for greater understanding of Cyberspace among legal regulators and, only after that education is complete, a need for new regulations designed to adjust the law in ways that will not curb development in this new area unnecessarily.

Introduction
The rules that regulate lawyers' conduct are generally promulgated by the ABA and then adopted by states. The earliest standards adopted by the ABA were the Canons of 1908. In 1969/1970, the ABA adopted the Code of Professional Conduct. Many states adopted this Code. Some of these states switched to the Model Rules of Professional Responsibility when the ABA adopted them in 1983; others retained the Code. Thus, both the Model Rules and the Code of Professional Conduct are still published. They appear in several sources (see Standards and Opinions, below). Amendments to the ABA standards are noted in the annual ABA Reports and in the monthly ABA Journal . The ABA's Standing Committee on Ethics and Professional Responsibility and its predecessor committees have issued ethics opinions since 1924 (see Standards and Opinions, below) In Minnesota, the relevant rules are the

Welcome. I first became interested in the practical application of legal ethics in law school. As an alternative to a written final exam, my buddy, John Gray, and I collaborated on a project to demonstrate our comprehension of the then-intricate rules of attorney advertising by writing and producing un ethical legal radio advertisements which systematically violated each and every rule. Later, John Carver and the University of Denver College of Law gave me the opportunity to teach Legal Professional as a Lecturer in Law at DU. About the same time, I joined the Colorado Bar Association's Legal Ethics Committee, one of the finest groups of professionals with whom I have ever been associated. I have been a member of the CBA Ethics Committee continuously since 1986, and have served longer as the in-house ethics adviser for our firm. Between teaching, CBA Ethics Committee work, analyzing our firm's own day-to-day ethics and legal practice issues, representing other attorneys as a counselor or advocate, serving as an expert witness and lecturing, I have amassed a fair amount of research on legal ethics and issues related to the practice of law.
