Basic Materials for Korean Legal Research
Updated February 24, 2004
Citation and Romanization
  • For a non-roman script language like Korean, correct citation of laws, articles, and cases in English language publications depends on a combination of standards for legal citation (in Korea and in the U.S.), U.S. standards for transcription of foreign language materials, and the transcription of Korean, specifically. Legal Citation
    • The Bluebook: a uniform system of citation. 17th ed. Cambridge, MA: Harvard Law Review Association, 2000.
This is the standard source for citation of laws, cases, and bibliographical citations in U.S. legal publications. Although there are examples and guidelines for many foreign countries, Korea is not discussed specifically. Pages 151-155 give general guidelines for citing foreign language materials.

Introduction Our standard Addendum contains 10 clauses: some constitute "good contracting" practice and others are explicitly required by our state's laws or included to enable us to comply with provisions of the law. These clauses are examples of "good contracting:" Representations and Warranties by Contractor; Venue; Governing Law; Entire Agreement; Modifications; and Addendum Controlling. They protect our interests by raising issues of general concern such as whether the Contractor is a business in good standing and has given the person who will sign the authority to do so on its behalf and bind it to the agreement; where the parties will file lawsuits if they ultimately have a dispute they can't otherwise resolve; making sure that everyone understands that the agreement contains all the terms of the transaction and that things that may have been discussed but did not make it into the final executed agreement are not part of the deal, among others.

Clicking on this link brings you to the Westlaw User Guide page, which contains free user guides in pdf format. There are "Topical research guides" covering areas such as labor and employment law, immigration law, insurance, international law and taxes. Most of the topical areas have at least two guides. One of the guides provides a list of frequently used databases in the subject area and the types of materials that the databases contain. The other guide provides research tips on how to find specific types of documents. Two other useful guides are the database guide and the research tip guide for Federal Statutes and Legislative History under "Westlaw database lists" on the main Westlaw User Guide page. Page eight and nine of the research guide provides a nice layout of the Congressional Lawmaking Process with references to the databases that are useful for finding documents at each step in the process. For example, step 6 is the bill is reported out of committee. The databases recommended for finding these documents are LH (Legislative History) and USCCAN-REP (U.S. Code Congressional and Administrative News-Legislative History Reports).
