Our Pro Bono Policy
Pro bono contributions are an important part of Orrick's tradition and culture. While many firms have reduced their contributions, our commitment to legal volunteerism is absolute: Orrick is one of a shrinking number of firms that counts a lawyer's pro bono hours toward their billable requirement. Including pro bono work as "billable" is intended to emphasize the firm's deep commitment to pro bono work and to encourage the pro bono efforts of our associates. Our Pro Bono Efforts are Making a Difference Orrick attorneys and staff contributed 28,627 hours to pro bono matters in 2004, up nearly 30% from the year before. Impressive numbers, but far from the whole story.
  • Our efforts in 2004 earned awards from Lawyers' Alliance for New York and the New York Legal Assistance Group. Orrick was named the Yosemite Fund's 2004 "Corporate Protector." Orrick associates serve as externs at the Legal Aid Society of New York's Harlem neighborhood office. Serving as an extern is an excellent opportunity for associates to get valuable training and hands-on experience while bringing important skills and resources to Legal Aid's clients.

Defining Pro Bono
The Latin term "pro bono publico ", commonly shortened to "pro bono" means for the public good. The concept of pro bono work - ensuring access to justice for all persons regardless of their ability to pay - has developed over the centuries and generally means lawyers donating a percentage of their time to people on a low income who otherwise would not have access to legal assistance. Many people use the term pro bono to include work that would not traditionally be called pro bono work. One of the aims of the Victorian Pro Bono Secretariat at the Foundation is to move toward a single shared definition of pro bono publico in Australia. The Secretariat has slightly adapted The Law Council of Australia definition to meet our needs as follows: 1. A lawyer, without fee or without expectation of a fee or at a substantially reduced fee, advises and/or represents a client in cases where
(i) a client has no other access to the courts and the legal system or such access is inadequate; and/or

  • CorporateProBono.Org ( http://www.corporateprobono.org ) is a national initiative of the American Corporate Counsel Association and the Pro Bono Institute at Georgetown University Law Center. The Web site, launched in October 2000 and sponsored by numerous foundation and corporate funders, plays "matchmaker" by giving qualified nonprofits the opportunity to create a listing for their organization , which can then be searched and viewed by lawyers looking to volunteer their services. Volunteer lawyers can post their expertise and availability and there is a library of resources tailored to meet their needs.
  • Pro Bono Partnership ( http://www.probonopartnership.org ), winner of numerous legal service awards, offers pro bono legal services to eligible nonprofit organizations in the New York tri-state area that serve the poor and disadvantaged, primarily in the areas of health and human services, affordable housing, neighborhood revitalization, and economic development. Beyond providing pro bono legal services, the Pro Bono Partnership also offers workshops and materials on a variety of topics affecting nonprofit organizations and volunteer attorneys.

In addition to the Advice Desk Program , the Mediation and ADR Program , and the Low-Income Taxpayer clinic , all of which serve indigent clients, we offer the following pro bono programs: Public Interest Law Initiative (PILI) Serving Our Society (SOS)
PUBLIC INTEREST LAW INITIATIVE (PILI) Edward Kraus PILI Fellows working at the Law Offices will work on challenging criminal or civil litigation under the close supervision of one or more of ten of the Law Offices' clinical professors, each of whom is an experienced practicing attorney. They will participate in all aspects of the cases to which they are assigned. Thus, fellows will be involved in client contact, litigation strategy sessions, legal research and writing, drafting of pleadings and motions, discovery, settlement, trials or other court proceedings, etc. The two criminal defense attorneys represent defendants in serious felony cases (including appointed death penalty cases) in the federal and state trial and appellate courts. Three of the civil litigation attorneys concentrate on employment discrimination cases and civil rights matters but handle other types of civil litigation as well. One civil litigation attorney represents low income persons with disputes before the Internal Revenue Service, United States Tax Court, and the United States District Court. One attorney represents clients with Social Security disability issues, one attorney specializes in family law and one attorney represents people with immigration issues.

Several prominent law firms promote firm-wide pro bono programs in which lawyers are asked to handle a certain number of pro bono cases. These programs differ among the law firms but frequently include the following; Associate Service, where a law firm releases associates to work full-time for a period of time at a legal service provider; Matching Projects, where law firms agree to be matched with agencies serving poor people; and Legal Clinics, where law firms have established their own legal clinic programs, staffed and administered exclusively by the attorneys and other employees of the firm. PRO BONO INITIATIVE
Stanford Law School educates and trains many of the best lawyers in the country through its curriculum, faculty expertise, and programs. Just as the ethical codes of the American legal profession encourage attorneys to provide significant pro bono legal service throughout their careers, Stanford Law School encourages its faculty and students to advance the common good through pro bono legal services. The Law School established the Pro Bono Initiative to enrich the expertise of its renowned faculty, enhance the legal skills of our students, and simultaneously offer opportunities to serve the public. Students are encouraged to volunteer at least 50 hours of law-related pro bono work during their course of studies at the Law School. Clinical coursework over and above the number of hours set by clinical instructors may be counted toward the initiative. A student who meets the aspirational 50-hour goal will be recognized for their community service in written and online Law School communications and at graduation. Students are also rewarded with the hands-on legal experience and fulfilling public service gained from their work.

In October, the Federal Communications Commission (FCC) ruled that Bono's remark did not violate rules prohibiting indecent or obscene speech during broadcasts. The FCC reasoned that there was no violation because Bono was simply using the word "f" as a superlative, not in a sexual way. This month, during the Billboard Music Awards, "Simple Life" stars Nicole Richie and Paris Hilton were involved in the following exchange: Hilton told Richie, "Now, Nicole, remember, this is a live show, watch the bad language." Jokingly, Richie immediately exclaimed "F-!" She was bleeped. Later in the broadcast, Richie swore again, remarking, "Have you ever tried to get cow shit out of a Prada purse? It's not so f simple." This time, however, she avoided the bleep censor. Viewers heard her expletives loud and clear and some, especially parents of young children, were furious. Fox TV apologized, and has promised that it is "working to ensure it does not happen again."

Help Protect Your Rights to the Great Works in the Public Domain! On October 7, 1998, both the House and the Senate passed S. 505, the " carte blanche Everyone should be grateful to the efforts of Stanford Law professor Lawrence Lessig, who was the lynchpin in the constitutional challenge, supplying immeasurable amounts of his time, money, and extraordinary talent to the cause. Although the effort was ultimately unsuccessful, he succeeded in bringing the issue before the public, which I was wholly unable to do when the bill was being considered by Congress. If we are vigilant, we MAY able to stop the rent-seeking special interests the next time they seek to line their own pockets at the expense of our cultural development. Please visit Professor Lessig's web site for information and ideas about new approaches to promote the public domain in the light of this disastrous abdication of constitutional duty by the Supreme Court.
