Business Law Pro Bono:
Involving the Other Half of the Profession
By James L. Baillie M ost lawyers who provide pro bono services are litigators and they are providing litigation-oriented services. But more than half of all lawyers are not litigators and they participate in pro bono at a much lower level. Involving that other half of the profession in pro bono services is a challenge. But it is a challenge that can be met through pro bono programs that call on their skills. Pro bono programs seeking more volunteers to help with these clients, especially in family law, have noted the resistance of business lawyers, including lawyers on corporate legal staffs. Efforts have been undertaken to recruit, train and retain "non-litigation" lawyers to provide family law and other traditional litigation services. There have been some successes. Some non-litigators have enjoyed expanding their legal skills and helping these clients. Some have become outstanding volunteers. But they are the minority. As early as the 1970s, corporate legal staffs began pro bono programs, often in partnership with local legal aid or pro bono programs. But after initial bursts of enthusiasm, many of these programs have declined.

Message from the Associate Dean DukeSpring 2003 Duke Law Magazine features community service. Public Interest is broadly defined at Duke Law School. This Office is for all the students of the school whether or not they expect to spend part of their professional career in the public sector. Lawyers are looked to as leaders in their communities and most are called upon frequently to serve their communities over the course of their careers. Indeed, they are exhorted to do so by the Codes of Professional Responsibility of state bars. Lawyers have many opportunities to serve. The two most obvious ones are careers in the public sector - government and non-profit legal advocacy - and law firm pro bono. However, lawyers also serve as legislators crafting laws, as advisors on non-profit boards, as members of public commissions, and in countless other ways. This public spiritedness of the profession is encouraged and cultivated among Duke Law students. Indeed, most students come to Duke Law already steeped in the ethic of service. These days, the best students are active in community service in high school and college. They do not want to take three years "off" from public service while in law school. Through the Office of Public Interest and Pro Bono, students can maintain their service ethic and engage in intellectual debate on the pressing issues of the day.

The Commission on Immigration Policy, Practice and Pro Bono consists of thirteen (13) individuals appointed by the ABA President. The Commission directs Association efforts to ensure fair and unbiased treatment, and full due process rights, for immigrants and refugees within the United States.     Introduction The preparation of lawyers who recognize the importance of their public service obligations is an important objective of the William S. Richardson School of Law. In 1992 the William S. Richardson School of Law adopted a Law Student Public Service graduation requirement. The class of 1995 was the first graduating class obliged to fulfill the requirement. The Law Student Public Service (better known as "Pro Bono") Program introduces the concept of pro bono service to law students and is an integral part of the academic program at the law school. It provides law students the opportunity to address unmet legal needs in the community while enriching their legal education. The Pro Bono Program at the William S. Richardson School of Law was one of the first law school pro bono programs in the nation and is thought to be the first student-initiated mandatory program in the nation. In April 1991, a student organization, Advocates for Public Interest Law, presented a formal proposal to the faculty. Recognizing both the long tradition in the legal profession to serve the underprivileged and to ensure legal access for all as well as a national movement in its infancy toward mandatory pro bono service in the legal profession, the student leaders wanted the law school to foster in all law students a life-time professional commitment to public legal service by creating a pro bono graduation requirement.

    We do not accept applications for pro bono cases from individuals through our offices nor do we issue a list of individual solicitors undertaking pro bono work. However, it may be possible to offer guidance as to an appropriate course of action. The SPBG delivers free legal advice through a number of projects under the LawWorks banner: LawWorks Clinics promotes partnership between Law firms and Community Advice agencies. It produces written materials for individuals and law firms, arranges training sessions and provides support for lawyers and clinic workers. LawWorks for Community Groups provides free business law advice to not for profit community groups through a network of volunteer lawyers. Tthe work must be non-urgent and non-contentious.
