By Drew Cullen Published Thursday 24th January 2002 16:58 GMT British consumers will be on the wrong side of the law for the first time if they buy overseas DVDs or computer games 'unauthorised' for the UK and play them on their PCs at home. This is the major implication of a ruling in the High Court yesterday over the sale in the UK of 'mod-chips' for the Sony Playstation. Channel Technology Sony last month won an injunction to stop the company from selling or marketing PS mod-chips. While not disputing the facts, Channel Technology argued that the mod-chip "was not 'specifically' designed to circumvent the copy-protection mechanism of the PS2 console, but also dealt with defeating the region control aspect of the same protection, and thus allowed arguably legal functions such as the use of imported games". Judge Jacob disagreed. Although extremely sceptical of Sony's claims, he ruled, according to Channel Technology's paraphrased account, that:

It was the only journal which offered the reader coverage of comparative law as well as public and private international law. It was created by the merger of three journals, including the Quarterly of the Society of Comparative Legislation and International Law which started in 1894. The ICLQ has maintained its pre-eminence as one of the most important journals of its kind, encompassing Human Rights and European law. It moves across the boundaries that divide the law, in a way that provides analysis which is much needed at a time when formal distinctions, in scholarship and between jurisdictions, are becoming less relevant. In our highly advanced technological age, the duplication of original works of authorship has become almost effortless. While at one time, manuscripts or books had to be copied laboriously by hand, it is now possible within several minutes to produce high quality reproductions of entire works. Similarly, audio tapes, videos, and computer programs can all be reproduced quickly, effectively, and cheaply. The purpose of this essay is to explore the halachic implications of making or using unauthorized duplications and to inquire if there are precedents which could serve as grounds for the protection of an author's or creator's proprietary rights. Halachic literature is rich in detailing the rights - and limitations - of an author to his original work. Not surprisingly, the People of the Book were constantly involved in determining what type of protection could be granted to an author or publisher. A cursory scan of seventeenth through nineteenth century rabbinical haskamot (approbations), customarily printed in the prefatory section of rabbinic works, will reveal that these approbations served two distinct purposes. Firstly, the writer of the approbation would put a "seal of approval" on the work by testifying to the erudition and competence of the author. Secondly, the rabbinic authority would declare a ban against publication, for a fixed period of time, of the same work by another publisher. Rabbi Moshe Sofer

Date Last Visited: April 7, 2005 Canadian Constitutional Documents Canada's basic law derives not only from a set of documents known as Constitution Acts, but also a set of unwritten laws and conventions. This comprises of all the acts passed since 1867 up to and including 1998. As a result, all constitutional documents during that time period have the force of law. There are other documents that relate to Canada's development as a country, such as those predating Confederation, which do not hold the force of law, as each act was superseded by the other until the passing and proclamation of the Constitution Act, 1867. Some of these documents include the Charter of Hudson's Bay, the Royal Proclamation, 1763 and the Quebec Act, 1774. This site contains the full-text of these rare constitutional documents.

Defense of natural law theory and natural rights against egoist attacks by Wendy McElroy from The Freemason.

    The Non-Absurdity of Natural Law
From The Freeman, February 1998, Vol. 48, No. 2, pp.108-111 by Wendy McElroy There is an immense difference between disagreeing with a theory and considering it to be absurd. The former can be a respectful process that encourages discussion: the latter implies that anyone who holds the theory must be a fool. In vernacular language, the difference can be expressed as, 'is the other guy wrong, or is he just stupid?' Natural Law has always had vigorous opponents who believed, with the early 19th century English philosopher Jeremy Bentham, that the theory was nonsense upon stilts. Indeed, Sir Robert Filmer's Patriarcha critiques Natural Law/rights theory that existed prior to 1640. Before the turn of the 20th century, however, the accusation of absurdity was usually hurled at advocates of individual rights by those who were hostile to individualism. Or, at least, by those who wished to assign a higher priority to some other social consideration such as utilitarianism. Within the individualist tradition itself, Natural Law remained a prevailing and well regarded theory. But in the late 19th and early 20th centuries, Natural Law theory came under sustained and derisive attack by those within the individualist tradition. The situation was especially contentious in the United States where individualists who espoused what Benjamin Tucker called 'society by contract' began to deride natural rights as being patently absurd. The leading wedge of ridicule was Tucker's individualist-anarchist periodical
