  • September 2005 On September 15, 2004, Senator Robert Byrd introduced S. 2808, a bill to amend the United States Code to make the date of the signing of the United States Constitution a legal public holiday.  President George W. Bush signed the bill into law on December 8, 2004 designating every September 17 th as Constitution Day. Coalition of Immokalee Workers (CIW) Project, Spring 2005
Lucas Benitez of CIW presents testimony on the condition of migrant farmworkers at the hearing In early March of this year, the International Human Rights Clinic arranged for a hearing in front of the Inter-American Commission on Human Rights and prepared the written submissions on behalf of its client, the Coalition of Immokalee Workers (CIW). Days later, CIW reached an historic agreement with Taco Bell to increase wages, improve conditions and work with others in the industry to improve life for farmworkers in Florida. CIW representatives said the hearing helped Taco Bell, and its parent corporation, Yum! Brands, better understand the human rights implications of corporate tomato purchasing policies. On March 3rd, CIW testified in front of the Commission on the dire situation in Immokalee. The Clinic was responsible for coordinating the hearing and putting together the factual and legal submissions to the Commission. The Clinic also helped prepare the oral presentations and mooted CIW leader Lucas Benitez and Cathy Albisa of the National Economic and Social Rights Initiative (a member of the CIW support group). Mr. Benitez gave a solemn account of the sweatshop-like conditions in Immokalee and detailed the deficient and discriminatory labor regime in the United States (which often exempts agricultural workers entirely). He also explained how the economic structure of the industry promulgates human rights violations. Large corporate “buyers”, like Taco Bell, drive down wholesale costs which place economic pressure on intermediaries (“growers”) to cut costs in the only place they can: labor. In the words of the Clinic’s submission, “this creates an economic incentive for growers to at best exploit and at worst enslave workers.” Ms. Albisa placed Benitez’s factual testimony in the context of Inter-American Human Rights law, which requires the United States to respect and ensure human rights.

    New licences will be needed from 24 November under the Licensing Act 2003. Businesses had until midnight to apply for automatic extensions to their existing licences, and those which did not could now face delays getting them. Many small businesses may face a "gap in trading", the Department of Culture, Media and Sport said. It's been quite a burdensome process, often requiring lawyers to come on board to complete the process
    British Retail Consortium It said the new law has been introduced to modernise the UK's licensing laws and reduce bureaucracy. A spokeswoman said up to a quarter of the 190,000 businesses that needed to reapply failed to do so. "They can still apply, but they could face a gap in trading," she said.

    Some women in Jordan are regarded as their family's property Parliament in Jordan has overwhelmingly rejected a proposed law imposing harsher punishments for men who kill female relatives in what are known as "honour killings". It was the second time since June's elections that the lower house, the Chamber of Deputies, quashed the bill on such killings, which are mostly carried out by brothers and fathers against women who have had sex outside of marriage. Islamists and conservatives opposed to the new law said it would encourage vice and destroy social values. Another bill - allowing women to divorce their husbands - was referred to a parliamentary legal committee for further review. In August, the upper house, or Senate, upheld both bills, after they were rejected by the lower house. The bills now are expected to be debated jointly by both chambers. Correspondents say that if lawmakers continue to reject the amendments, only intervention by the Jordanian monarch, King Abdullah, can ensure they come into effect.

SEPTEMBER 2005 The library is experiencing noise and vibration as the arches on the south facade are demolished to connect the new construction to the old. The forms have been removed and the dramatic front curve of the new addition begins to take shape. AUGUST 2005 Concrete for the foundation walls is brought in a mixer, and pumped overhead into the waiting forms. Ground is officially broken with the pouring of footers and erecting of forms to take the concrete for the basement foundation and walls. Progress continues to be made in excavating the job site.

    China's anti-secession law: the good news

    GULF BREEZE, FloridaThe United States and Taiwan should welcome China's efforts to formally define and codify its position on relations with Taiwan. While it may not offer the answer some in Taiwan would hope for, it does mean movement by Beijing's leaders toward the rule of lawone of the legitimate concerns Taiwan's leaders have about China's ability to abide by future agreements. Taiwan's leaders are correctly wary of any negotiated settlement with China because historically China has changed agreements too easily by executive fiat. The recent altering of the Hong Kong Basic Law is an example. Involving the National People's Congress in the process is positive step. While the NPC used to be a pure rubber stamp for the Communist Party, over the past 25 years it has increased, in fits and starts, its voice in internal decision-making. That began when the NPC played a role in calling to account government incompetence in the Pohai Gulf oil rig disaster of 1979, and began to grow in voice and power until it was severely constrained again after the Tiananmen demonstrations in 1989. Over the years younger, more active and more competent people have been elected to its ranks, and while it has not reached the point of being able to "check-and-balance" the Communist Party or even the government, the NPC is moving in that direction. This new anti-secession law could give the NPC more leverage in national decision-making.

For the referendum result to be binding, at least 50 per cent of eligible voters had to take part. But only 26 per cent turned out - a victory for the Vatican, which had urged people to stay at home. The outcome means that Italy retains Europe's strictest law on embryo research and IVF. It was introduced last year to stamp out the IVF "free-for-all" that had pre-dated the legislation. "The Italians are going back to the Middle Ages," comments Ian Gibson, a British MP who backs increased liberalisation in embryo research. "It's absolutely ridiculous."
