The recent arrest of a Florida man on charges of unauthorized use of a wireless network could set legal ground rules for open Wi-Fi access. A man sitting in a Chevy Blazer in a residential neighborhood reportedly was poking around nearby wireless networks in violation of computer crime laws, according to local police. This appears to be the first arrest in which the sole offense was allegedly accessing a wireless network without prior authorization, and it's already being viewed as a probable test case. CNET News.com interviewed legal scholars to ask what rules apply to Wi-Fi (also called 802.1x) hot spots. Is it legal to use someone's Wi-Fi connection to browse the Web if they haven't put a password on it?

Judges refuse to overturn Net obscenity law

A special three-judge panel declined to overturn a 1996 federal law prohibiting anyone from sending obscenity across the Internet. The New York panel on Monday rejected arguments from Barbara Nitke , a fine art photographer who specializes in sadomasochistic imagery, who had filed suit in December 2001 to overturn the law. The lawsuit had targeted the Communications Decency Act's restrictions dealing with obscenity and community standards, arguing that applying old-fashioned geographical rules about what's acceptable makes no sense on the Internet. The judges agreed that Nitke was right to be worried about being prosecuted under the lawbut concluded that she did not provide sufficient evidence to justify striking down that portion of the CDA.

IRS Ups Mileage Rate
IR-2005-99, Sept. 9, 2005 WASHINGTON — The Internal Revenue Service and Treasury Department announced today an increase to the optional standard mileage rates for the final four months of 2005. The rate will increase to 48.5 cents a mile for all business miles driven between Sept. 1 and Dec. 31, 2005. This is an increase of 8 cents from the 40.5 cent rate in effect for the first eight months of 2005, as set forth in Rev. Proc. 2004-64. “This is about fairness for taxpayers,” said IRS Commissioner Mark W. Everson. “People are entitled to deduct the real cost of operating a vehicle. by David P. Currie And it's hard, isn't it? Don't let them tell you law is easy; it's as intellectually challenging as anything you'll encounter. That they pay us to think about such questions is one of the wonders of the Western world. For, as you've discovered, you can't really understand the law by reading books, listening to lectures, and memorizing rules. You'd only forget them, and they'd change them anyway. You can't understand the law until you make it your own by restating it, arguing about it, applying it to new situations. It's the process that counts, not the material.
You should be proud of your profession too. The practice of law has come in for a good deal of ribbing, some of it in good fun (I'll spare you examples), some overgeneralizing from the misbehavior of a small minority to which you will never belong. But the law is a noble profession. The rule of law is one of our proudest boasts, the product of democratic self-determination, the bulwark of our freedom. As Burke said, where the law ends, tyranny begins. But the law doesn't administer itself. Rights cannot be protected without advocates to assert them. It is the peculiar responsibility of the legal profession to assert those rights and to defend and uphold the law. As my colleague David Strauss said only the other day, "Doctors protect people against the ravages of disease. Lawyers protect people against the ravages of injustice."
