  • The Department for Consitutional Affairs (previously the Lord Chancellor's Department) provides the latest rules and reports as well as progress on legislation (under the "Legal Policy" section). The new forms (75 of them) are available on the Court Service site (which can be accessed from the DCA site), in pdf format. These can be completed on line and printed out, ready to be sent to the courts, although they are not available in Word (or other word-processable) format.
  • The Civil Justice Council is an Advisory Public Body, established by the Access to Justice Act 1999 as a continuing body with responsibility for over-seeing and co-ordinating the modernisation of the civil justice system as laid out in Lord Woolf's report "Access to Justice". The Council meets at least three times a year to discuss and agree formal responses to consultation papers. It provides advice to the Government on the effectiveness of aspects of the civil justice system. The chairman is Lord Phillips, Master of the Rolls and Head of Civil Justice. The main work of the council is carried out through subcommittees: Alternative Dispute Resolution (ADR), Enforcement, Fees, Funding, Litigant Information and the reform of Housing and Land.     During the first half of 2005, donor states have contributed substantial sums to the cost of creating the Extraordinary Chambers in the Courts of Cambodia for the Prosecution of Crimes Committed during the Period of Democratic Kampuchea (ECDK). The Chambers' imminent establishment is a welcome step toward legal accountability for up to two million victims of the 1975-79 genocide. Although funding for the Cambodian government's share of the budget is yet to be fully secured, it is not too early for the Group of Interested States (GIS) to turn its attention to a number of outstanding issues concerning the composition and operation of the ECDK. How these matters are addressed will determine the effectiveness, fairness, and impact of the trials in Cambodia and beyond. By design, the Extraordinary Chambers is part of the Cambodian judicial system, with Cambodians constituting a majority of its judges and legal staff. Nonetheless, as Prime Minister Hun Sen and others have repeatedly affirmed, Cambodia requires international resources and expertise. Crimes of this magnitude are of concern to all humanity. The international community has an interest and a responsibility to ensure that they are prosecuted and tried credibly. In particular, the Group of Interested States, including those donors who have contributed virtually all of the ECDK's funds, must monitor closely the tribunal's establishment and operation, and act expeditiously to remedy any problems that threaten the integrity of the proceedings.

    Domestic Violence Legal Issues Should be Incorporated Throughout Law School Curricula
    Domestic violence legal issues should be incorporated into law school curricula as a core component of legal education. It may be easy to understand the benefits of raising these issues in clinical programs, which train students to represent or assist victims in the community. A more subtle need, however, is to alert lawyers to the ways in which domestic violence issues crop up in seemingly unrelated fields of law. Lawyers who practice any kind of family, criminal, tort, financial (including wills, trusts and estates, and tax law) or poverty law are likely to have cases complicated by domestic violence. Understanding how to spot domestic violence issues will assist lawyers to represent clients properly. Therefore, these issues must be raised not only in specialized clinics, but also throughout the curricula. Domestic Violence Legal Issues Should Be Raised in Core Curriculum Courses
    Historically, domestic violence issues have not been raised in law school courses or addressed in mainstream legal journals. Traditional law school textbooks do not include domestic violence issues, and many law school professors do not incorporate domestic violence issues into their courses. Failure to address these issues penalizes all students. Regardless of the professional track a student chooses, it is likely that he or she will be faced with legal problems related to domestic violence as a practicing attorney. Since all students will benefit from an understanding of domestic violence issues, it is necessary to incorporate these issues into core curriculum courses.

    Rule of law and human rights
    The Rule of Law and Human Rights Department supports the development of a well-functioning and transparent legal system in Albania, in conformity with contemporary European standards. Through its work, the Department aims to foster a culture in which citizens seek and receive effective legal remedies. Legislative support The Department has provided expertise to the parliamentary committees on Property Law Reform with regard to property restitution and compensation, and supports other legislative processes. As a result of the Department's efforts, Albania passed a Law on the Restitution and Compensation of Property on 15 September 2004. A joint OSCE-State Committee on Restitution and Compensation of Property was subsequently established, which provides support for the implementation of the Law. Institution building and transparency of legal processes The Department has produced a report on the legal sector which looks at all major law-related institutions in Albania and includes recommendations on projects to increase transparency in courts and various other bodies. One of these is a project to improve transparency in legislative drafting, where the Department is working with the Ministry of Justice in developing public participation in drafting. This project also involves assisting the work of the Ministry's Law Reform Commission.

    WITNESS PROTECTION TRAINING FOR CROATIANS ZAGREB, CROATIA, JUNE 10, 2005 - The United States recently funded two workshops entitled "Witness Protection - The International Experience" for 100 Croatian legal professionals and law enforcement officials. The workshops were organized by the American Bar Association/Central European and Eurasian Law Initiative (ABA CEELI) and the International Criminal Investigative Training Assistance Program (ICITAP) in cooperation with the U.S. Marshals Service, the Croatian Police Academy, and the Croatian Judicial Academy. These workshops are part of the project "Improving Capacity for Adjudicating War Crimes in Croatia", implemented by ABA CEELI and funded by the United States Department of State. The cost of mounting these two workshops was approximately $50,000. Participants took part in workshops held in Zagreb June 1-3 and in Opatija June 6-8. The objective was for them to gain additional practical expertise on important witness protection issues such as interviewing witnesses, entering the witness protection program, physical security, and regional cooperation. Practices learned will strengthen Croatia's ability to address cases involving war crimes, organized crime, narcotics, and trafficking in persons.

    Judicial Reform Index for Bulgaria

    Background CEELI has worked with local partners to promote the rule of law in Bulgaria since 1991. Legal professionals today work in a much more transparent environment, but challenges remain in combating corruption, enforcing judgments and ensuring access to justice for all members of society. CEELI began providing assistance in Bulgaria in 1991 and has had a continuous presence on the ground ever since. CEELI's program is currently led by a Sofia-based Country Director and benefits from the expertise of one rule of law liaison in Sofia, and two criminal law liaisons, one in Sofia and the other in Blagoevgrad. In addition, a talented staff of local legal professionals supports both the rule of law and criminal law reform projects.
    Judicial Reform CEELI developed the Judicial Reform Index (JRI) as a tool to help assess a cross-section of factors important to judicial reform and help technical assistance providers in designing their judicial reform programs, as well as monitor progress toward establishing an accountable, effective and independent judiciary.

      In this section The Justice Initiative views the Khmer Rouge Tribunal (KRT) as the last best chance for justice for the victims of the atrocities committed during the period of Democratic Kampuchea, and has actively worked to improve the process and ultimate product. Our aim is to ensure that the trials will be fair, credible, and transparent, that Cambodians have ownership over the process and receive a measure of justice from the trials, and that the tribunal positively impacts upon the judicial process in local courts of Cambodia. Since late 2003, every few months the Justice Initiative has taken International Technical Advisors to Cambodia to work with NGOs and the Government Task Force on the Khmer Rouge Tribunal. Our hope is that the experience of experts from other international and hybrid courts—dealing with atrocities in East Timor, Rwanda, Sierra Leone, and the former Yugoslavia—can help Cambodia incorporate the best lessons and practices from those courts into the KRT. The visits also provide an opportunity for us to collaborate with Cambodian NGOs and to gather information on local needs concerning the KRT. The Justice Initiative has also helped produce Working Papers on topics essential to the KRT’s functioning, such as on the nomination of judges and the treatment of witnesses and victims.     Introduction
    The English-speaking nations share the English language, the common law, and male circumcision as part of their history and culture since the late 19th century. This page incorporates relevant legal reference material from the several English-speaking nations. Some definitions: A "botched" circumcision is one that is poorly done and has obvious unexpected results. "Wrongful circumcision" is circumcision done without valid informed consent. Conclusions / Recommendations Lessons Learned and Future Challenges Domestic Laws Can Create Strong Legal Platforms Training Is Critical Law enforcement, NGOs, worker organizations, government monitoring agencies, and service providers are learning more and more about the signs of trafficking and forced labor. This study finds that identification of victims increases as those likely to encounter survivors gain expertise in the various signals of forced labor conditions. Furthermore, expertise in identifying and supporting survivors strengthens eradication efforts by increasing law enforcement knowledge about forced labor and trafficking operations as well as by empowering survivors to seek justice and rebuild their lives. The numbers of professionals with trafficking and forced labor expertise is still relatively small, but growing. Their experiences serve as a vital resource for the creation of training materials as well as their dissemination. Building up the numbers of trained and seasoned professionals is crucial to minimizing inadvertent risk of harm to victims or rescuers through inappropriate interventions (such as confronting a trafficker while the victim is still under her or his control). With time, training should be extended both in breadth and depth to more agencies and professionals in order to identify, liberate, and support survivors. In particular, worker and employer organizations are important audiences to target for training on the signs of forced labor. Because victims are often isolated, these sectors may have access to victims and could function as monitors.
