The Criminal Justice Process: An Overview
A case progresses through the criminal justice system in many steps, or stages ( Click here to view a flow chart ). The overview that follows might suggest that the administration of justice is an orderly flow that begins with the investigation of a criminal offense and ends with a prison sentence. However, due to the specific circumstances of each case, some proceed more quickly than others. INTRODUCTION Criminal justice in the United States exists to control and prevent crime. Criminal cases are those that involve the commission of acts that are prohibited by law and punishable by a jail or prison sentence. Law enforcement agencies are charged with the prevention of crime and the apprehension of criminal offenders. Courts have the duty to assure justice and due process through determining innocence or guilt of the accused and sentencing those who are convicted. The role of correctional agencies in this process involves the control, custody and supervision of persons convicted of crime.

Background In recent armed conflicts, such as the wars in Bosnia, Kosovo and East Timor, hundreds of thousands of refugees and internally displaced persons (IDPs) were forced to flee from their homes and leave behind their properties. In many cases, these abandoned properties were destroyed by military forces as part of a deliberate strategy to prevent the return of refugees and IDPs. In others, abandoned properties were systematically taken over by other groups and occupied illegally or on a temporary legal basis. In some instances, the lawful owners were forced to sell their property in exchange for exit documents or simply at gunpoint. White-Collar Crimes
White-collar crime is a term that was first used by a sociologist in 1939 to describe criminal activity by members of the upper classes in connection with their professions. His point was that this type of crime was barely acknowledged by the criminal justice system and rarely prosecuted. Today, the most common definition of white collar crime no longer focuses on the social status of the offender but rather on the type of conduct involved: illegal acts using deceit and concealment to obtain money, property, or services, or to secure a business or professional advantage. The federal government has passed a variety of laws in the last fifty or sixty years to deal with the problem of white collar crime, using its jurisdiction under the commerce, postal and taxing powers of the federal Constitution to reach all levels of business activity. White-collar crimes follow the general principles of criminal liability in that each crime requires a bad act, a criminal intent, and causation. The defenses to white-collar crime are the same ones applicable to all crimes and include incapacity, insanity, intoxication, and duress. Of particular note for white-collar crime prosecutions is the defense of entrapment. Entrapment occurs when the government has enticed a person to commit a crime he or she otherwise would not have committed. The majority of courts look at the defense of entrapment through the eyes of the individual defendant and the focus becomes the propensity of that defendant to commit the crime in determining whether he or she has been entrapped. Other courts focus on the government's conduct from the perspective of whether it is outrageous in terms of convincing a person to commit a crime.

Community Rights Communities have the right to know when violent criminals move into their neighborhood, but they do not have the right to deny legally-obtained housing to criminals who have served their sentences.

The Michigan Health Care False Claim Act
All health care providers, including chiropractors, need to understand the Michigan Health Care False Claim Act, MCL 752.1001-1011. This act prohibits fraud in obtaining benefits or payments in connection with health care coverage and insurance; prohibits kickbacks or bribes in connection with such coverage and insurance; prohibits conspiracies in obtaining benefits or payments; and provides for enforcement and penalties. The actions prohibited by the act may apply to both the provider and patient, or any other "person." "Person" is defined as an individual, corporation, partnership, association, or any other legal entity. Part 1003 of the act states that a "…person shall not make, or present or cause to be made or presented…a claim for payment of health care benefits knowing the claim to be false" …or, "knows falsely represents that the goods or services were medically necessary in accordance with professionally accepted standards." In addition, a person is prohibited from making a "false statement or false representation of a material fact…for use in determining rights to health care benefits." It is important to note that "knowing" or "knowingly" does not include making a mistake or error, unless there is "a systematic or persistent tendency to cause inaccuracies to be present."

Report of the Independent Expert In the early 1990s, the Sub-Commission appointed a special rapporteur to consider the right to restitution, compensation and rehabilitation of gross violations of human rights and fundamental freedoms and to prepare draft guidelines on this question. Between 1993 and 1997 three versions of basic principles and guidelines were prepared (see E/CN.4/Sub.2/1993/8, 2 July 1993, section IX; E/CN.4/Sub.2/1996/17, 24 May 1996; and E/CN.4/1997/104, 16 January 1997). At its 1998 session, the Commission adopted resolution 1998/43 in which it noted with interest the positive experience of countries that had established policies and adopted legislation on the question and called once more upon the international community to give due attention to the right to restitution, compensation and rehabilitation for victims of grave violations of human rights. In that same resolution, the Commission established the mandate of an independent expert to prepare a revised version of the draft basic principles and guidelines and to submit the revised daft to the Commission on Human Rights at its 1999 session, with a view to adoption by the General Assembly. Good morning, Chairman Feingold, Senator Thurmond, and distinguished members of the subcommittee. Thank you for the opportunity to present the views of the administration on the proposed amendment to the Constitution of the United States to establish basic rights for victims of violent crime.
The administration strongly supports S.J. Res 35, the Victims’ Rights Amendment. There is broad-based support for the Amendment across the country. Democratic and Republican leaders, liberal and conservative scholars, and Americans of every persuasion have rallied in support of this important cause. Crime victims encourage your support in our struggle for human dignity and fair treatment.

has broad responsibility for the enforcing the civil law of New South Wales, as well as providing Court security and running the jury system.
In particular the responsibilities of the Sheriff today are to:
