Contacting a lawyer All sorts of court cases can require people to give evidence as a witness to help establish the truth of the claims being made. We are most familiar with the criminal law situation where someone charged with an offence pleads not guilty and a trial is held to try to prove the charge. Witnesses, usually including any complainants involved, provide information about what happened or about some other aspect of the case – either for the prosecution or for the defence. However, witnesses may also be required in what are known as civil cases. These are cases between individuals or bodies rather than involving the police as in criminal cases. They can involve all sorts of issues such as suing someone for negligence or defamation, a dispute between neighbours, breach of contract, etc. Other civil cases may require you to give evidence in the Employment Court, Family Court, Environment Court, a Disputes Tribunal and so on. You may also be asked to give evidence at an inquest (an inquiry into how someone died) at a Coroners Court. Criminal cases in a District Court may be heard before a judge alone or a judge and jury. Those in the High Court are usually heard before a jury, though sometimes a judge alone will hear them.

Notes on Jehovah's Witness Custody Cases Author Unknown Abstract In the United States there are over 1,000 custody cases fought annually involving Jehovah's Witnesses. Most involve a young couple in which the mother is converted to the Witnesses, severely alienating the father, and resulting in a divorce. Because the non-Witness fighting for custody is typically the father, the author recounted primarily the difficulties encountered in these kinds of cases. The major concern of the fathers is that raising their children as Jehovah's Witnesses is not conductive of achieving the goals that most fathers deem important for their children. These include normal social involvement in school, attending college, pursuing a career, being able to utilize appropriate medical treatment, and the development of tolerance toward humans of a variety of religious faiths and orientations. The author reviewed the literature relative to the problems and child custody trends and discussed the most appropriate strategy for the non-Witness to prevail in court on this manner. LEGAL ISSUES IN TAKING TAPE RECORDED WITNESS STATEMENTS By Ralph Thomas STATEMENT PREFERENCES A fellow member on the private-eye mailing list recently posted a message concerning the right way to open a recorded witness statement and what preferences should be used. This was in respect to his lawyer client pointing these things out as problems with the recorded statement: My lawyer client felt that the problem I had with my preface was....... A. That I did NOT offer the witness an opportunity to provide a written statement in lieu of an audio recording....on the recording itself. B. That I did not record an advisory informing the witness that he was under no obligation to speak to me. C. I did not TWICE seek the wit's specific consent to the statement. When he first told me these things, I thought, like Julius thought, that something must have changed somewhere..... so I asked the other lawyer for his opinion. Like I reported in my orginal post... he did not see anything wrong with the way I was doing things. And once again, like Julius, I am still wondering if there has been a new decision..... or was my lawyer client just overly cautious. Domestic Violence Legal Issues Should be Incorporated Throughout Law School Curricula Domestic violence legal issues should be incorporated into law school curricula as a core component of legal education. It may be easy to understand the benefits of raising these issues in clinical programs, which train students to represent or assist victims in the community. A more subtle need, however, is to alert lawyers to the ways in which domestic violence issues crop up in seemingly unrelated fields of law. Lawyers who practice any kind of family, criminal, tort, financial (including wills, trusts and estates, and tax law) or poverty law are likely to have cases complicated by domestic violence. Understanding how to spot domestic violence issues will assist lawyers to represent clients properly. Therefore, these issues must be raised not only in specialized clinics, but also throughout the curricula. Domestic Violence Legal Issues Should Be Raised in Core Curriculum Courses Historically, domestic violence issues have not been raised in law school courses or addressed in mainstream legal journals. Traditional law school textbooks do not include domestic violence issues, and many law school professors do not incorporate domestic violence issues into their courses. Failure to address these issues penalizes all students. Regardless of the professional track a student chooses, it is likely that he or she will be faced with legal problems related to domestic violence as a practicing attorney. Since all students will benefit from an understanding of domestic violence issues, it is necessary to incorporate these issues into core curriculum courses.
