The Individuals with Disabilities Education Improvement Act (IDEA 2004), 20 U.S.C.  1400 et seq., provides federal funds to assist state and local agencies in educating disabled children. IDEA 2004 conditions the receipt of such funds upon a state's compliance with certain goals and procedures. State legislatures and departments of education have enacted statutes and promulgated regulations respectively to ensure compliance with IDEA 2004 requirements. IDEA 2004 and its implementing regulations require schools to conduct functional behavioral assessments (FBAs) but provide little to no guideance on what an FBA is or how to conduct one.     VIII. Mandatory Continuing Judicial Education for the Kentucky Judiciary Rule 8.000 Purpose
    Only by continuing their legal education can members of the judiciary fulfill their obligation to competently serve the Commonwealth. These rules establish minimum requirements for such continuing judicial education and the means by which the requirements shall be enforced. (Adopted effective July 8, 1983) (back to top) Rule 8.010. The Commission - Functions and membership The Mandatory Continuing Judicial Education Commission shall consist of fourteen (14) members. Mountjoy, chairwoman of the Kentucky Board of Education, is being awarded the Distinguished Service Award by the National Association of State Boards of Education (NASBE). The award is annually given to a state board of education member in recognition of outstanding service to public education.
    "Kentucky is a national leader in the standards-based reform movement, and Helen Mountjoy has been involved with the landmark Kentucky Education Reform Act (KERA) since its conception. Perhaps more importantly, she has been an instrumental leader in successfully putting these visionary policies into practice. Her legacy of leadership and service on behalf of public school students is one that future state leaders would do well to emulate," said Brenda Welburn, NASBE Executive Director.
    Under Mountjoy's leadership, the Kentucky Board of Education has established a new statewide assessment system and student performance standards. In addition, the Board rewrote the Commonwealth?s special education regulations, instituted a single, statewide standardized student and district data management system, and has increased public outreach and engagement regarding state education decisions.
    Mountjoy has served on the Kentucky Board of Education since 1991, having been re-appointed by the Governor in 1994, 1998, and 2002. She has served as Board chairwoman since June 1998.

    The Regulation on Kentucky Teaching Certificates - 704 KAR 20:670 - went into effect for teacher education candidates admitted to a Teacher Education program beginning January 1, 1998:

    Kentucky Primary Programs: Principals' Beliefs About Early Childhood Education And Selected Demographic Characteristics Cathy S. Jording, Ed. D. (Return to Contents) The Kentucky Education Reform Act (KERA) of 1990 mandated a non-graded primary program for the first four grades of the elementary school (kindergarten, first, second, and third grades). Teachers were to use developmentally appropriate early childhood education practices and principals, serving as instructional leaders, were to ensure education program success (Chance, 1991). For principals of Kentucky elementary schools, the mandated primary program approach presented new strategies for the implementation and development of educational practices for children through age eight. The principals needed advanced skills in the teaching and learning processes and a thorough understanding of the practical application of child growth and development (National Association of Elementary School Principals, 1990). Also, they needed expertise in contemporary and traditional teaching and learning processes and an understanding of "learning readiness" (National Association of Elementary School Principals, 1990, p.34). The Kentucky elementary school evolved from desks in rows, quiet classrooms, and structured time frames of subjects into a child-initiated, multi-age, multi-ability, active classroom program. Principals were required to ensure program success, regardless of whether their educational knowledge and beliefs were based in traditional or developmentally appropriate practices (Kentucky Department of Education, 1991).
