CER and Education Reform In The News KANSAS EDUCATORS TURN TO WEB TO CREATE UNIQUE 'VIRTUAL' SCHOOL by Rebecca S. Weiner
New York Times , August 16, 2000 In one Kansas school district, educators are using the Internet to reach out to families that might otherwise turn their backs on public education. Through the vehicle of a unique "virtual" school, teachers and administrators in the Basehor-Linwood School District are providing families that teach their children at home the guidance of public school teachers, the validation of state standardized tests and the purchasing power of a large public school. "Public schools need to recruit those kids back into public education," said David Pendleton, the district's superintendent, noting that its virtual school started with barely 60 students in 1997 and will likely grow to 400 this fall. "Our state recognizes the importance of working with home school kids." The district, located just west of Kansas City, developed its Virtual Charter School as a means to entice families who had abandoned the state school system to once again become involved in public education, Pendleton said. It is the only school district running such a model in the nation, though Basehor-Linwood school officials are helping educators in three other Kansas communities to establish similar programs. Charter schools are independent public schools operated by educators, parents, consumers and non-profit companies. While state laws vary, most charter schools operate under the general auspices of state or local education officials but remain free of some education regulations. In the case of the Basehor-Linwood initiative, the district operates the virtual school. "You're at your own discretion of how you pursue your coursework."

Riley Announces 2nd Year Goals 2000 Funds for Kansas and Names Kansas Ed-Flex State; says Education Improvement is "Critical to Nation's Future"
Kansas will receive $3,193,916 in federal Goals 2000 support, U.S. Secretary of Education Richard Riley announced today. The state also has been named the second state authorized to waive federal education regulations and statutory requirements that affect local school districts under an historic new Ed-Flex state/federal partnership that gives Kansas the power to waive rules that can limit local and state efforts to improve teaching and learning. The Goals 2000: Educate America Act, passed by Congress last year with bipartisan support, helps states and communities advance their own school improvement efforts, based on the results of local decision making. Kansas has developed a school improvement plan tied to challenging academic standards, waived state requirements that apply to education and pledged to hold schools and districts accountable for students academic performance. Kansas will receive second-year Goals 2000 funds and is one of six states that will earn Ed-Flex status for the next five years. The second year of Goals 2000 support $362 million for state and local grants in fiscal year 1995 will help states and communities implement school improvement plans to raise student academic achievement, involve parents in schools, bring technology into the classroom, upgrade teacher professional development, and create partnerships with business and community groups.

  • Head Start/Early Head Start staff: Early Head Start staff must obtain a Child Development Associate (CDA) for Infant and Toddler Caregivers or an equivalent credential that addresses comparable competencies within 1 year of the effective date of the final rule, or thereafter, within 1 year of hire as a teacher of infants and toddlers (Federal Head Start Performance Standards 1304.52(f)). For Head Start, the Head Start Act 648(a) says that the HHS Secretary shall ensure that not later than September 30, 2003, at least 50% of all Head Start teachers nationwide in center-based programs have
      an associate, baccalaureate, or advanced degree in early childhood education; or
  • Title I Paraprofessionals: Under new Federal legislation, Elementary and Secondary Education Act (ESEA) or "Leave No Child Behind," paraprofessionals in Title I programs are now required to have a 2-year degree or its equivalent, including paras in Kansas Title I preschools.
  • Future possibility for Special Education Paraprofessionals: When the Individuals with Disabilities Education Act (IDEA, the Federal special education law) is revised, it is likely to mirror ESEA requirements, including the requirement for special education paras to have a 2-year degree. As of FY02, more than 11,000 FTE paras work in Kansas special education programs, with 6% having a 2-year degree. Of that total, 720 FTE paras are assigned to early childhood teachers. Again, it is likely a phase-in time will apply.

    A 50 State Survey of Requirements for the Education of Language Minority Children

    Ms. Garcia is also a scholar at the University of California at Berkeley for the Foundation for Teaching Economics.
    Ms. Morgan is also an Ashbrook scholar at Ashland University. Introduction Schools around the United States are now faced with education a growing number of children who lack basic English skills. According to the National Clearinghouse for Bilingual Education , there are 2,437,723 Limited English Proficiency students in the U.S.1 Only a few years ago, many schools had never dealt with a language minority child. Today, an increasing number do. The challenge of providing a quality education to all students is doubled when schools must also teach a child an entire new language as well as academic courses. Over the last 30 years, elected officials, education agencies, and the courts have established guidelines for the education of these students. Federal requirements allow states a wide deal of latitude in selecting the most effective programs for their limited-English-proficient (LEP) students. Many states have enacted their own laws governing the management and style of programs for LEPs. These laws have been developed in cooperation with, or under coercion from, federal agencies and/or activist organizations. The result has been a patchwork of laws and regulations that can vary greatly from state to state.

  • Appointment, term of office.
  • The governor shall appoint a board consisting of 11 members of which six shall be registered professional nurses, two shall be licensed practical nurses, one shall be a licensed mental health technician and two shall be members of the general public, which shall constitute a board of nursing, with the duties, power and authority set forth in this act.
  • Upon the expiration of the term of any registered professional nurse, the Kansas state nurses association shall submit to the governor a list of registered professional nurses containing names of not less than three times the number of persons to be appointed, and appointments shall be made after consideration of such list for terms of four years and until a successor is appointed and qualified.
  • On the effective date of this act, the Kansas federation of licensed practical nurses shall submit to the governor a list of licensed practical nurses containing names of not less than three times the number of persons to be appointed, and appointments shall be made after consideration of such list, with the first appointment being for a term of four years and the second appointment being for a term of two years. Upon the expiration of the term of any licensed practical nurse, a successor of like qualifications shall be appointed in the same manner as the original appointment for a term of four years and until a successor is appointed and qualified.

Specifically, you ask whether the provisions result in an unlawful delegation of legislative powers. In 1994, the Kansas legislature authorized through adoption of K.S.A. 1994 Supp. 72-1903 et seq. the establishment and operation of charter school programs, school programs that operate within the structure of a unified school district, but independently from other school programs of the district. See K.S.A. 1994 Supp. 72-1903. Establishment of a charter school program is achieved by following the procedure set forth in K.S.A. 1994 Supp. 72-1906, and essentially involves submitting a petition to a local board of education and the state board of education for review and approval.

    Disclosure of Student Academic Records
    In accordance with the Family Educational Rights and Privacy Act and the regulations promulgated thereunder (34 C.F.R. Part 99, Regulations), the University will permit inspection and review of education records of students upon the following conditions:
  • The University will notify students of their rights to review records by referring to this policy; An eligible student will be allowed to inspect and review his/her education records. Requests for copies of the records should be made in the office of the Registrar, in writing, on the forms provided, and signed by the student. Records will be released in a reasonable time, and, in any event, no more than 45 days from the date of the request;
  • E ducation records include all transcripts, confidential letters and confidential statements of recommendation, receipt of an honor or honorary recognition, letters of reprimand and all letters from the Promotion and Graduation Committee to the student;
