You indicate that some of your constituents who are engaged in private business are concerned that education service centers may be involved in activities that are in competition with private business and are beyond the scope of their statutory authority. Specifically, you ask whether an education service center is authorized to do the following:
  • Purchase a private business for the purpose of providing accounting, internet, and support services to school districts and other governmental entities; provide services to school districts and other governmental entities that are not members of the education service center;

    Topeka, Kansas 66605-1357 Re: Constitution of the State of KansasEducationState Board of Education; Local Public Schools; General Supervision; Maintenance, Development and Operation of Local Schools; Edison Project; Constitutionality Synopsis: Dear Senator Hensley: As State Senator for the 19th District, you request our opinion regarding the constitutionality of an agreement between a unified school district and a private, for-profit corporation regarding management and operation of designated schools within the unified school district. Specifically, you ask whether the agreement between Unified School District No. 259 and the Edison Project, L.P., entered into January 23, 1995, violates Sections 2 and 5 of Article 6 of the Kansas Constitution. Our review of the agreement, therefore, is limited to determining whether the concept set forth in the agreement would comply with Sections 2 and 5 of Article 6 of the Kansas Constitution. The clerk for the Board of Education for Unified School District No. 259 (USD 259) has provided a copy of the agreement between USD 259 and Edison Project, L.P. (Edison). The agreement is 22 pages long. Attached to the agreement are 13 appendices, which are incorporated into the agreement by reference, and one addendum. References in the following paragraphs are to particular provisions of the agreement as provided by the clerk, unless otherwise noted.

    In this milestone decision the Supreme Court ruled that separating children in public schools on the basis of race unconstitutional. It signaled the end of legalized racial segregation in the schools of the United States, overruling the "separate but equal" principle set forth in the 1896 Plessy v. Ferguson case. Oliver Browns name appears first on the most famous desegregation case in the nations history, Brown v. Board of Education. He was a welder for the Santa Fe Railroad and a part-time assistant pastor at St. John African Methodist Episcopal Church. George E.C. Hayes, left, Thurgood Marshall, center, and James M. Bush’s hallmark education reform law that was signed into law over a year ago. During a visit today to Jefferson Elementary School in Wichita, Kansas, United States Department of Education General Counsel Brian Jones announced that Kansas’s No Child Left Behind accountability plan has been approved by the United States Department of Education. Kansas was required to outline specific steps for ensuring adequate yearly progress in reading and math for public school students - the cornerstone of the No Child Left Behind Act. Kansas now joins seven other states - Colorado, Indiana, Maryland, Massachusetts, Mississippi, New York, and Ohio - as states whose accountability plans have been approved by the U.S. Department of Education. “The education reform movement gains another champion today as Kansas joins seven other states whose accountability plans have been approved,” Boehner said. "Kansas education leaders are to be applauded for embracing high standards and accountability for results to ensure that every child in America has the chance to learn and succeed.”
