Roma Rights and Access to Justice in Europe
The RrAJE programme is a three-year programme (2001 - 2004), funded by the British Government's Department for International Development, which tackles the social exclusion of Roma in Central and Eastern Europe. It aims to make a significant contribution to the development of social and economic policy to promote Roma integration. The RrAJE programme provides support for local Roma NGOs to build formal partnerships with municipal authorities to address the lack of access for Roma communities to employment, education, health care and welfare services, and criminal justice; to develop innovative social policy which delivers an integrated strategy at local level to address discrimination and to deliver equality of opportunity; and to implement a sustainable multi-agency response to Roma deprivation. RrAJE began work in 'pilot projects' in the Czech Republic in the municipalities of Brno and Pardubice , and in Bulgaria in Lom and in the Fakulteta District of Sofia . On Aug. 22, 1992, on a remote ridge in northern Idaho, aweeklong standoff between white supremacist Randy Weaver andfederal agents ended in a shootout in which an FBI sniper shot andkilled Weaver's wife, Vicky. The Ruby Ridge confrontation began aweek earlier when federal marshals tried to arrest Weaver forfailing to appear in court on weapons charges. At that time, a gunbattle erupted between marshals and Weaver's 14-year-old son,resulting in the deaths of Weaver's son and a marshal. The incident led to one of the most intensive internalreviews of an FBI investigation ever. Attorney General Janet Renoestablished a Justice Department task force to investigate theevents at Ruby Ridge. The task force concluded in a 1994 reportthat the FBI's Hostage Rescue Team overreacted to the threat ofviolence and instituted a shoot-on-sight policy that violatedbureau guidelines and Fourth Amendment restrictions on policepower. The FBI disciplined 12 agents and employees, includingLarry Potts, then the head of its criminal division and now itsdeputy director, for their roles in the operation. The following document, which is contained in theattached files, is the full text of the task force's unreleased542-page report, which was obtained by LEXIS COUNSEL CONNECT.

Cases such as these, which resulted in the identity thieves being sent to prison, are precisely the types of cases for which the federal identity theft offense was designed. Section 1028(a)(7), which was enacted as part of the Identity Theft and Assumption Deterrence Act of 1998, prohibits anyone from knowingly transferring or using, without lawful authority, someone else’s "means of identification" with the intent to commit, aid, or abet any unlawful activity that constitutes a violation of federal law or that constitutes a felony under state or local law. [18 U.S.C. § 1028(a)(7)] Under this section, a "means of identification" includes a wide range of identifying information: a person’s name, date of birth, Social Security number, driver’s license number, passport number, bank account number, and credit-card data, to cite just some examples. Even biometric data – digitized data uniquely linked to physical characteristics such as fingerprints, voiceprints, and retinal images – can be a "means of identification" covered by the Act. The Department has actively fostered closer interagency cooperation on identity theft in three significant ways. First, federal prosecutors in a number of states are making use of multiagency task forces and working groups that can share resources to investigate identity theft and related white-collar crimes.

Lewis The confidential memorandums, several of which were written or co-written by John C. Yoo, a University of California law professor who was serving in the department, provided arguments to keep United States officials from being charged with war crimes for the way prisoners were detained and interrogated. They were endorsed by top lawyers in the White House, the Pentagon and the vice president's office but drew dissents from the State Department. The memorandums provide legal arguments to support administration officials' assertions that the Geneva Conventions did not apply to detainees from the Afghanistan war. They also suggested how officials could inoculate themselves from liability by claiming that abused prisoners were in some other nation's custody. The methods of detention and interrogation used in the Afghanistan conflict, in which the United States operated outside the Geneva Conventions, is at the heart of an investigation into prisoner abuse in Iraq in recent months. Human rights lawyers have said that in showing disrespect for international law in the Afghanistan conflict, the stage was set for harsh treatment in Iraq. One of the memorandums written by Mr. Yoo along with Robert J. Delahunty, another Justice Department lawyer, was prepared on Jan. 9, 2002, four months after the terrorist attacks in New York and Washington. The 42-page memorandum, entitled, "Application of treaties and laws to Al Qaeda and Taliban detainees," provided several legal arguments for avoiding the jurisdiction of the Geneva Conventions.

    (CBS) There are credible complaints that Arab and Muslim immigrants were beaten in federal detention, says an internal Justice Department report obtained by a newspaper.
    Over the six-month period that ended in June, the Justice Department's inspector general found 34 complaints of rights violations that appeared credible, reports The New York Times. Some of the charges have yet to be fully investigated. Not all the complaints concerned physical abuse.
    The report has been provided to Congress and will soon be publicly released. The complaints concern the way the Justice Department has enforced the 2001 Patriot Act, a law passed in the immediate aftermath of the Sept. 11 attacks that granted wider powers to federal law enforcement officers to conduct surveillance and detain immigrants. It follows another report by the inspector general that found "significant problems" in the Bush administration's actions toward 762 foreigners held on immigration violations after Sept. 11. The FBI took too long to determine whether they were involved with terrorism, as dozens endured "lock-down" conditions 23 hours each day and slept under bright lights, the report found.

Attorney General Eric Holder, at podium, and FBI Director Louis Freeh WASHINGTON (CNN) U.S. Attorney General Janet Reno said goodbye to her Justice Department staff in a ceremony at the department Thursday and thanked them for their commitment to civil service. "I love the law, I love good and caring lawyers, but never have I loved people as much as I do you for what you do for this country," Reno said. She said serving the government and suffering "the slings and arrows of a free press" and the political process takes courage, but she urged them not to quit. "Yes, I've been cussed at, fussed at and figuratively beaten around the ears, but after eight years in this job, after seeing America, I know two things... I have never believed so strongly in this nation's future, in the righteousness of its ways as I do and I have never believed so strongly that we must continue to fight so that the law issues from all of the people and not just some," Reno said.

    What Is Internet Fraud?
    The term "Internet fraud" refers generally to any type of fraud scheme that uses one or more components of the Internet - such as chat rooms, e-mail, message boards, or Web sites - to present fraudulent solicitations to prospective victims, to conduct fraudulent transactions, or to transmit the proceeds of fraud to financial institutions or to other connected with the scheme. If you use the Internet with any frequency, you'll soon see that people and things online tend to move, as the saying goes, on "Internet time." For most people, that phrase simply means that things seem to happen more quickly on the Internet business decisions, information-searching, personal interactions, to name a few - and to happen before, during, or after ordinary "bricks-and-mortar" business hours. Unfortunately, people who engage in fraud often operate in "Internet time" as well. They seek to take advantage of the Internet's unique capabilities for example, by sending e-mail messages worldwide in seconds, or posting Web site information that is readily accessible from anywhere in the world - to carry out various types of fraudulent schemes more quickly than was possible with many fraud schemes in the past.
