The Temple of Karnak: An Unexpurgated History of the Supreme Court Our founders designed a government with three independent branches, each with a limited role to play. The role of the judicial branch was limited to deciding "cases and controversies" in accordance with laws made by elected representatives of "We the People." As Alexander Hamilton explained the constitutional design in Federalist Number 78, The Judiciary, on the contrary, has no influence over either the sword or the purse; no direction either of the strength or wealth of the society, and can take no active resolution whatever. It may truly be said to have neither force nor will but merely judgement; and must ultimately depend upon the aid of the executive arm even for the efficacy of its judgements. Hamilton went on to assure his fellow citizens in Federalist Number 81 that they could rely on Congress to punish "judiciary encroachments on the legislative authority" by impeachment and removal of the encroaching judges. There never can be danger that the judges, by a series of deliberate usurpations on the authority of the legislature, would hazard the united resentment of the body intrusted (sic) with it (the power of impeachment and removal), while this body was possessed of the means of punishing their presumption, by degrading them from their stations.

California Supreme Court to Hold Special Outreach Session in Shasta County

The California Supreme Court will reach out next month to Redding, in Shasta County, when it holds a special oral argument session and public education program there, one of the largest collaborative educational events of its kind in Northern California. Chief Justice Appoints Domestic Violence Task Force
A new Judicial Council task force appointed last week will develop best practices for domestic violence cases in California courts. The task force will focus on improving protective order forms, developing guidelines in domestic violence cases, and ensuring the accurate and timely entry of restraining orders into the statewide database. Nominations Sought For Facilities Task Force
The Judicial Council seeks nominations for three vacancies on its Court Facilities Transitional Task Force. The task force offers advice and recommendations on issues related to appellate and trial court facilities, including acquisition, maintenance, and transfers from the counties to the state. Vacant positions are for an appellate court judicial administrator; trial court administrator from a large, metropolitan county; and an architect. Deadline to apply is October 17. Chief Justice Presents Awards For Exemplary Court Service and Leadership
Chief Justice Ronald M. George has presented special awards for exemplary service and leadership in the judicial branch to Tressa Sloan Kentner, Court Executive Officer of the Superior Court of San Bernardino, and Michael Bergeisen, General Counsel and Deputy Administrative Director of the Administrative Office of the Courts (AOC)—and to the Office of General Counsel, which he leads.

    Governor Phil Bredesen has named Cornelia “Connie” Clark to serve as the newest justice of the Tennessee Supreme Court, where she will fill a vacancy created by the retirement of Justice Frank Drowota. The governor appointed and swore in the newest member of the court on September 19. “Each day in her work, Judge Clark displays the qualities required in a Supreme Court justice. She’s knowledgeable of the law, hard-working, articulate, and always conducts herself with the highest of moral standards,” Bredesen said. “I’m confident that in Judge Clark we’ve chosen the best person to fill this important position.” “I am honored that Governor Bredesen has selected me to serve the people of Tennessee in this position that holds such a high degree of public trust,” Clark said. “I promise to discharge my duties to the best of my ability and to always put the public good first in my work.”

    Separation of powers is the idea that the powers of a sovereign government should be split between two or more strongly independent entities, preventing any one person or group from gaining too much power.

    Criticisms
    The categories of the functions and corresponding powers of government are inclined to become blurred when it is attempted to apply them to the details of a particular constitution. Some hold that the true distinction lies not in the nature of the powers themselves, but rather in the procedure by which they are exercised. There is no current constitutional system which adopts a complete separation of powers, in the sense of a distribution of the three functions among three independent sets of organs with no overlapping or coordination. Some of the early American States and the French Constitution of 1791 tried strictly to give effect to this doctrine but failed. edit
    Checks and balances
    The phrase " checks and balances " was also coined by Montesquieu. In a system of government with competing sovereigns (such as a multi-branch government or a federal system), "checks" refers to the ability, right, and responsibility of each power to monitor the activities of the other(s); "balances" refers to the ability of each entity to use its authority to limit the powers of the others, whether in general scope or in particular cases.
