Judicial Branch The judicial branch hears cases that challenge or require interpretation of the legislation passed by Congress and signed by the President. It consists of the Supreme Court and the lower federal courts. Appointees to the federal bench serve for life or until they voluntarily resign or retire. The Supreme Court is the most visible of all the federal courts. The number of Justices is determined by Congress rather than the Constitution, and since 1869, the Court has been composed of one Chief Justice and eight Associate Justices. Justices are nominated by the President and confirmed by the Senate. The United States Supreme Court The Federal Judicial Center The U.S. Federal Courts The United States Code ...

Vote Transfers Responsibility of Sheriffs to Judicial Branch HARTFORD - On Tuesday, November 7, citizens voted to amend the Constitution of the State of Connecticut and eliminate the Office of the High Sheriff. As a result, the responsibility for court security, custody of prisoners and prisoner transportation is transferred to the Judicial Branch. As of December 1, 2000, Special Deputy Sheriffs will become employees of the Judicial Branch as "Judicial Marshals". On the same date, Deputy Sheriffs performing service of process functions will become "State Marshals" under the direction of an independent State Marshal Commission, made up of seven members appointed by the Governor, Chief Justice and Legislative leaders. "The goal of the Judicial Branch is to ensure a smooth transfer of all County Sheriff functions," said Judge Robert C. Leuba, Chief Court Administrator. "I want to assure members of the public and the Bar, as well as the County Sheriff staff, that the Judicial Branch is committed to a seamless transition of these functions, and that the services provided by the Sheriffs will continue uninterrupted."

JUDICIAL DUTIES Appeal Process The New Hampshire Supreme Court, composed of the Chief Justice and four associate justices, sits in Concord and is the state’s only appellate court. The Supreme Court has jurisdiction to review appeals from the State trial courts and from many State administrative agencies. It also has original jurisdiction to issue writs of certiorari, prohibition, habeas corpus and other writs. The duties of the Supreme Court include correcting errors in trial court proceedings, interpreting case law and statutes and the state and federal constitutions and the administration of the courts. Since January 2004, the Supreme Court has accepted the vast majority of appeals from the State’s trial courts: the family division and the district, probate and superior courts. With a few exceptions (which are listed in the definition of “mandatory appeal” in Supreme Court Rule 3), a timely appeal from a final decision of a trial court is a “mandatory appeal,” meaning that the appeal is automatically accepted by the court.
