Salmon Portland Chase (1808-1873)
Impeachment trial of President Andrew Johnson
Previous Chapter Next Chapter Quote Fourth Circuit Court of Virginia was the jurisdiction Andrew Johnson wanted for the treason trial of Confederate President Jefferson Davis Military officials wanted to try him in their courts. The authorities debated over the jurisdiction for two years while Davis was imprisoned. Johnson knew a military trial would make Davis a martyr. Chase refused to hear cases in the Virginia Circuit while the State was still under the military government and not until the writ of habeas corpus was restored. When Chase finally sat at the Davis trial in November 1868 he approved Davis' lawyer's argument that the 14th Amendment that had recently gone into effect applied to Davis. In December Johnson issued a general amnesty. At the next session of circuit court, Chase discharged Davis on the grounds he was included in the pardon and could not be tried ex post facto.
Impeachment trial of President Andrew Johnson
At the only impeachment trial of a president in history, the Impeachment of Andrew Johnson for High Crimes and misdemeanors, (1868), Chase refused to let the Senate turn the hearings into a mockery of the law when he faced an angry mob of radical senators who wanted to limit the Chief Justice's power in the trial. Chase insisted and by cleverly out maneuvering the senators, he insured that the trial would be conducted with impartially and with the proper character of judicial process assuring the President a fair trial. The Senate knew if Chase didn't have his way, the Chief Justice could refuse to preside over the trial thereby violating the Constitution.

68. The Politics Of Andrew Johnson
Examines the bitter political battle that caused the only impeachment of an American president.

The Politics of Andrew Johnson
From: Eric Foner,
Reconstruction America's Unfinished Revolution, 1863-1877

Harper and Row Publishers, New York, 1988
Detail, Thomas Nast cartoon, Harper's Weekly , September 1, 1866 For Republican moderates, the Civil Rights veto ended all hope of cooperation with the President. In a biting speech, Trumbull dissected Johnson’s logic, especially the notion that guaranteeing blacks civil equality impaired the rights of whites. Underscoring the intensity of Republican feeling, the Senate expelled Democratic Sen. John P. Stockton shortly, before the vote on repassage, on the questionable grounds that the New Jersey legislature in 1865 had illegally altered its rules in order to elect him. Early in April, for the first time in American history, Congress enacted a major piece of legislation over a President's veto. A headline in one Republican newspaper summed up the political situation: "The Separation Complete." Johnson’s rejection of the Civil Rights Bill has always been viewed as a major blunder, the most disastrous miscalculation of his political career. If the President aimed to isolate the Radicals and build up a new political coalition around himself, he could not have failed more miserably. Moderates now concluded that Johnson’s policies "would wreck the Republican party.” They also believed the Civil Rights Bill, as Sherman put it, was "clearly right." Whatever their differences, virtually all Republicans by now endorsed the view expressed by the Springfield Republican after the veto: Protection of the freedmen's civil rights "follows from the suppression of the rebellion....” The party is nothing, if it does not do this the nation is dishonored if it hesitates in this."

Vice President of the United States
In June 1864 the Republicans met in Baltimore, Maryland, and renominated President Lincoln. The convention was known as the National Union Convention to attract the support of the War Democrats. To reward the Southerners who had remained loyal to the Union, Johnson, a War Democrat, was nominated as Lincoln’s running mate in place of Vice President Hannibal Hamlin . In November the Lincoln-Johnson slate was elected. On inauguration day, March 4, 1865, Johnson felt weak and sick. He was ill with typhoid fever and had taken some brandy before the ceremony. He made a long, rambling speech, boasting of his rise from humble origins. His friends were embarrassed, and his enemies used the unfortunate incident to label him a ruffian and an alcoholic. However, Lincoln defended Johnson by stating, “I have known Andy Johnson for many years; Andy ain’t a drunkard.”

United Church of Christ Keep in mind that in the table above, the % of the U.S. population for religious groups are current figures. Religious groups have had much different proportions at various time in U.S. history. One of the most over-represented religious groups among U.S. presidents is Unitarianism. Despite merging with Universalism in the 1960s, the combined proportion of Unitarian Universalists in the U.S. population is just 0.2% of the population (one in every 500 Americans). Yet there have been 4 Unitarian presidents. Another over-represented religious group among U.S. presidents is Dutch Reformed, by virtue of having two U.S. presidents, yet having only a small number of people left in the country who identify themselves as Reformed. The contemporary heir to the Dutch Reformed churches is the "Reformed Church in America," which has about 300,000 members in the U.S. and Canada. (Alternatively, one might count only a single president as Dutch Reformed, if Theodore Roosevelt is counted as an Episcopalian sources differ on this subject . Even just one Dutch Reformed president would constitute statistical over-representation.) After that, Disciples of Christ, Episcopalians, and Quakers have also had representation in the White House far outstripping their proportion of the U.S. population.

Johnson was born into extreme poverty. He was apprenticed to a tailor at 14, and eventually owned a successful business. He had learned to read a little, and his wife taught him to write. His Presidency: Johnson became president when Lincoln died. He disagreed with the North and opposed Congress so often that he was eventually impeached. Johnson had been highly regarded by Lincoln because he had risked his life working to preserve the Union serving as military governor in Tennessee. Andrew Johnson
17th U.S. President About President Johnson: He was a self-educated man of humble origin who was Abraham Lincoln's vice president during his second term and became President upon the assassination of Lincoln in April of 1865. Born to a poor family in Raleigh, North Carolina, as a boy Johnson never attended school. He was apprenticed to a tailor but ran away at age 16 and later settled in Greeneville, Tennessee, where he eventually set up his own prosperous tailor shop. He married Eliza McCardle, the daughter of a shoemaker, who helped him improve his reading, writing and math. They had five children. Johnson discovered a flair for public speaking and entered politics, championing local farmers and small merchants against the wealthy land owners. He enjoyed a rapid rise, serving as a mayor, congressman, governor, and senator. Although he was a slave holder, he remained loyal to the Union and refused to resign as the U.S. Senator from Tennessee when the state seceded at the outbreak of the Civil War, which brought him to the attention of President Lincoln. In 1862, Lincoln appointed him military governor of Tennessee. In an effort to win votes from Democrats, Lincoln (a Republican) chose Johnson (a War Democrat) as his running mate in 1864 and they swept to victory in the presidential election.
