Order 45 issued on November 2003 by Governor Bremer requires all organisations of Iraqi civil society and the international NGOs to register and undergo forms of control and scrutiny. This order is a serious impediment which violates the right of freedom of association. The Order : 1) Declares illegal all activities undertaken by organisations which are not registered under the guidelines of Order 45. 2) States that the organisations which are required to register include all bodies operating in the following fields:
-humanitarian aid
-defence of human rights
-community rehabilitation
-charity work
-education and health
-environmental protection and conservation
-economic reconstruction and development -promotion of democracy -development of civil society -promotion of women's rights -any other no-profit activity 3) Order 45 violates the right of privacy of the organisations and intrudes into their internal affairs. The order requires the organisations to release information about their finances; a three-year history of the donations received; the names of their main donors, including private individuals; information about ongoing and future projects; information about their boards of directors.

The Interim Constitution provides for individual freedom of religion, provided that it does not violate "morality and public order;" however, the Government severely limits freedom of religion in practice, represses the Shi’a religious leadership, and seeks to exploit religious differences for political purposes. Islam is the official state religion. Other religions are practiced in the country, but the Government exercises repressive measures against any religious groups or organizations that are deemed not to provide full political and social support. There was no change in the status of respect for religious freedom during the period covered by this report. Although Shi’a Arabs are the largest religious group, Sunni Arabs traditionally have dominated economic and political life. Sunni Arabs are at a distinct advantage in all areas of secular life. The Government also severely restricts or bans outright many Shi’a religious practices. The Government for decades has conducted a brutal campaign of killings, summary execution, arbitrary arrest, and protracted detention against the religious leaders and followers of the majority Shi’a Muslim population and has sought to undermine the identity of minority Christian (Assyrian and Chaldean) and Yazidi groups. The regime systematically has killed senior Shi’a clerics, desecrated Shi’a mosques and holy sites, interfered with Shi’a religious education, and prevented Shi’a adherents from performing their religious rites.

The Baathist regime of Saddam Hussein was militarily overthrown by a U.S.-led Coalition in Operation Iraqi Freedom on April 9, 2003. UN Security Council Resolutions 1483, 1500, and 1511 provide that the Coalition Provisional Authority (CPA) administer the country, working closely with the Iraqi Governing Council (IGC), until "an internationally recognized, representative government established by the Iraqi people is sworn in and assumes the responsibilities of the Authority." This report covers religious freedom under the Saddam Hussein regime, which was in control of Iraq for most of the reporting period. Under the former regime, an interim constitution provided for individual freedom of religion if it did not violate "morality and public order." However, in practice, the Saddam regime severely limited freedom of religion, repressed the Shi'a religious leadership, and sought to exploit religious differences for political purposes.[1] Islam is the majority religion in Iraq, though other religions are practiced. The Government exercised repressive measures against any religious groupings or organizations that were deemed as not providing full political and social support to the regime.

The American-Arab Anti Discrimination Committee (ADC) says that the Patriot Act and related regulations adopted in the post September 11 era pose a serious challenge and curtailment of civil rights and drastically undermine the foundation of American democracy. This came in resolutions the ADC passed at its 21 st annual convention held in Arlington, Virginia from 10 th to 13 th June, 2004. The ADC condemned terrorism and all forms of violence against innocent civilians regardless of the source of such violence and added that effective eradication of terrorism requires a comprehensive approach including dealing with the political motivations and root causes of terrorism. The ADC resolutions pointed out that the U.S. should assume its leadership role in the world through the promotion of the values that are reflected in our Declaration of Independence, Constitution and Bill of Rights; and the ADC would like our great nation to be perceived in the world as a credible champion of the international rule of law. The ADC said that the invasion of Iraq and its continuous occupation has caused and continue to cause irreparable damage to the U.S. and Iraq in addition to further compromising the U.S. stand in the Arab world and beyond. The ADC called for an end to the occupation of Iraq, the full restoration of the Iraqi sovereignty and a free internationally supervised election of a democratic government for the Iraqi people.

Today marks the 50th anniversary of Brown vs. Board of Education, a 1954 Supreme Court decision that was a turning point in civil rights in America even if the "all deliberate speed" order adopted in a subsequent decision a year later ordering school integration was anything but deliberate or speedy. Most of the debate and discussion - in the New York Times or on Tavis Smiley's town meeting with black leaders seen on CSPAN - discussed the resistance to change, the disappointment with the outcome, accelerating resegregation and the slow pace of educational improvements in inner city schools. The focus, properly, is on what Brown means for America and people of color. The New York Times has a video discussion between two black scholars, Henry Louis Gates and Cornell West, worth viewing.

Hagopian), newly co-published by Pluto Press and Haymarket Books By Susan M. Akram and Kevin R. Johnson It is in the context of a particular historical and legal environment that the post—September 11 targeting of Arabs and Muslims must be understood, as this context both explains Arab and Muslim fears in time of crisis and permits such targeting to be acceptable in the public eye. Such government, public, and private acts as the unjustified FBI investigations of Arab- or Muslim-owned businesses, or the closing of Muslim and Arab bank accounts, or the shutting down of Muslim charities, or FBI visits to mosques and Muslim/Arab academics, or "special registration" and other targeted monitoring of persons only of Arab origin or Muslim faith have become quite an accepted part of the "war on terrorism." Yet, should either the government or others target white Irish Catholics or Jews or another racial/"ethnic minority in such a sustained manner, they would doubtless face significant and vociferous challenge for racial or religious profiling. Commentators have observed how popular perceptions of racial and other minorities influence their treatment under the law. As with other minority groups, this seems true for Arabs and Muslims. on TV, Truth, and Technomania According to a USA Today report [12/10/2002], one of the effects of post-9/11 war on terrorism is a significant rise in the membership of American Civil Liberties Union (ACLU), an organization that defends civil rights in many cases, popular and unpopular. It has been a one year surge of 22%, an unprecedented rise in ACLU’s 82 year history. While terrorism has been a global reality, with which the rest of the world more or less is all too familiar with, United States has been quite successful as well as fortunate in keeping terrorism off its shore. While its streets might have plenty of crime and violence, news of terrorism was primarily heard in the context of other continents, including major countries of Europe, such as United Kingdom, Germany, Spain and so on. We in America have enjoyed a prolonged period of domestic security, save for its thugs, gangs and criminals.

    Draft of Iraq charter looks to Islam
    By Edward Wong The New York Times THURSDAY, JULY 21, 2005 BAGHDAD A working draft of the new Iraq constitution cedes a strong role to Islamic law and could curb women's rights, particularly in personal matters like divorce and family inheritance. The document's writers are also debating whether to drop a measure enshrined in the interim Constitution, written last year with American officials, that requires at least a quarter of the Iraqi Parliament to be made up of women. The draft obtained by The New York Times on Tuesday says that the government would guarantee equal rights for women, as long as those rights do not "violate Shariah," or Koranic law. American officials and secular Iraqis had kept religious language like that from appearing in the interim Constitution. If the working draft holds, the shift away from the more secular and equitable language of the interim Constitution would represent a victory for Shiite clerics and religious politicians, who now wield enormous power and had chafed at the influence exercised by the United States over the interim Constitution.

    Rights groups alarmed as FBI builds vast files
    By Eric Lichtblau The New York Times TUESDAY, JULY 19, 2005 WASHINGTON The FBI has collected at least 3,500 pages of internal documents in the past several years on a handful of civil rights and antiwar protest groups in what the groups allege is an attempt to stifle political opposition to the Bush administration. The FBI has in its files 1,173 pages of internal documents on the American Civil Liberties Union, the leading critic of the Bush administration's antiterrorism policies, and 2,383 pages on Greenpeace, the environmental group, which has led acts of civil disobedience in protest of the administration's policies, the Justice Department disclosed in a filing this month in a U.S. court in Washington. The Justice Department filing came as part of a lawsuit under the Freedom of Information Act brought by the civil liberties union and other groups that maintain that the FBI has engaged in a pattern of political surveillance against critics of the Bush administration.
