Defendant. ) No oral argument having been requested, the State's motion to reconsider was considered by the Court on August 13, 1997. Defendant's alleged probation violation is not that he possessed or was trafficking in marijuana, which are criminal offenses, but that he was using marijuana without a prescription, which is not a criminal offense although it is contrary to one of the terms of Defendant's probation. Defendant's treating and consulting physicians have previously testified that they would give him a prescription but for threats of prosecution under federal law. Nonetheless, the Court would have revoked or modified defendant's probation if the assistant county attorney had introduced any medical testimony at all that, given defendant's allergy to morphine, the chronic pain associated with his fibromyalgia and other ailments could be effectively managed without marijuana were he to be placed in treatment for his drug dependency. The Court would also have revoked or modified defendant's probation if the Iowa Code did not provide that marijuana can be prescribed for medicinal purposes as long as its use is in compliance with any rules adopted by the state board of pharmacy examiners.

Lowenberg Major General Lowenberg is a distinguished graduate of the Air Force Reserve Officer Training Corps (ROTC). He received his commission in 1968 concurrent with a Bachelor of Arts degree in Political Science from the University of Iowa. He earned a Doctor of Jurisprudence degree from the University of Iowa College of Law in 1971. In 1971 General Lowenberg entered active duty at McChord AFB, Washington. While at McChord AFB he was the installation’s Junior Officer of the Year and was twice honored as the most outstanding Judge Advocate in the Military Airlift Command (MAC). During this active duty tour, General Lowenberg was also appointed an Adjunct Professor of Law at the University of Puget Sound School of Law in Tacoma, Washington. There are five types of non-criminal cases most commonly seen in Iowa: n civil lawsuits for money damages n dissolution of marriage (divorce) n probate, including guardianships and conservatorships, and estates following death n involuntary commitment proceedings, both for mental impairment and substance abuse n adoptions Dissolution of marriage proceedings are discussed in detail in a separate chapter of this guide (Chapter 6) because they are so different from other civil cases and have direct bearing on so many people's lives. The other areas of non-criminal law are discussed in turn in this chapter. Civil Lawsuits for Money Damages As discussed in Chapter 1 of this guide, the court in which a civil lawsuit for money damages will be tried depends on the dollar value of the damages sought. If the claim is clearly computable with a value of less than $4,000.00, it is filed in small claims court. Small claims courts were originally designed to allow persons to seek monetary recovery without the need to hire a lawyer. The pleading forms, available at each county clerk's office, are basic and easy to understand. While lawyers may represent parties in small claims actions, it is common for individuals to appear

CHAPTER 10: Judicial Selection and Retention Magistrates, judges and justices in Iowa are each appointed through slightly different processes, depending on the level of the trial court or appellate court. Magistrates are appointed by a county nominating committee, the Judicial Magistrate Appointing Commission, made up of three laypersons, two lawyers and a judge. Magistrates are appointed for two year terms and have jurisdiction within a single county, although they may handle cases in other counties when the magistrate there is on vacation or has a conflict of interest. While anyone can serve as a magistrate, the nominating committees are instructed to give preference to those who are lawyers. Judges at other levels are appointed per district. There are thirteen judicial election districts. A map of the judicial districts is included at the end of this chapter. District associate judges are selected by the district judges of each judicial district. District associate judges must be lawyers. When a vacancy occurs, a call is put out to the lawyers in that district to apply. The Judicial Magistrate Appointing Commission then selects three names to forward to the district judges, who then select the actual appointee. District associate judges are generally based in a single county, but may have a schedule that takes them to several counties within a judicial district.

Vaughan, Commissioner of Insurance Re: Sales Practices and Advertising Trends Date: October 1, 1997 Over the past twelve months, the Iowa Insurance Division has observed that many persons and business entities are testing the limits of acceptable sales and advertising practices. The purpose of this bulletin is to remind insurance marketers of their responsibilities under Iowa insurance laws and regulations. Although we are providing general guidelines here, each situation provides specific circumstances which may affect how Iowa law is applied. A. New regulations. First, let us remind you of two new sets of regulation regarding insurance marketing:
  • In January 1997, thoroughly revised insurance regulations governing advertising, sales practices and unfair trade practices were adopted; i.e. Iowa Administrative Code Chapter 191-15. These regulations give specific guidance as to acceptable advertising and marketing practices. Also in January 1997, Iowa adopted the new NAIC model life insurance illustration disclosure regulation, Iowa Administrative Code Chapter 191-14. This regulation imposes new and specific requirements on persons or companies selling most life insurance products to Iowans. An NAIC working group is currently drafting a similar illustration model that will cover annuity products. Producers and insurers should be monitoring the development of the annuity illustration regulation and anticipating its eventual adoption in Iowa.

      This article connects standard research methodology concepts with the complexities of evaluating disability policy using national data sets. The purpose of the article is to help policymakers and others recognize unwarranted cause-and-effect policy conclusions based solely on existing national survey data and demand better data and stronger research designs to complement the potential over-reliance on correlational studies using problematic survey data to estimate policy impacts.
