Iowa updated 2/3/05 Contact Person: Iowa Sex Offender Registry - Division of Criminal Investigation: Phone (515/281-4976) Fax (515/281-4898) Offenders Required to Register: On or after July 1, 1995, an individual who has been convicted or adjudicated of a criminal offense against a minor, sexual exploitation, or a sexually violent crime or who was on probation, parole, or work release status, or who was incarcerated on or after July 1, 1995 is required to register. Registration includes individuals that have received a deferred sentence or deferred judgments and can include convictions from other jurisdictions such as other states and/or federal convictions. Information Collected: Fingerprints, social security number, photograph, current address, telephone number and additional relevant information not including information identifying the victim. Administrating Agency: Iowa Department of Public Safety, Division of Criminal Investigation Timeframe for Registration: An individual required by law to register with the Iowa Sex Offender Registry must report any change of address or telephone number within 5 days of the change for the entire registration period. When moving within the same county, the current county sheriff must be notified. When moving to a different county within the state of Iowa, the registrant must report a change of residence to both the sheriff of the county in which the residence has been established and to the sheriff of the county in which they were registered. November 25, 2003 Legislation that our union has promoted for nearly 12 years in Canada became law earlier this month when Bill C-45, the "Westray" Bill, was given Royal Assent in the Senate. The legislation amends the Criminal Code of Canada to hold corporations, their directors and executives accountable for criminally negligent acts in the workplace. The law is known as the "Westray" Bill after a 1992 explosion that killed 26 miners at the Westray Coal Mine in Stellarton, NS. The USW has fought long and hard for justice for the Westray victims and their families, including supporting and testifying at a Public Inquiry held in the mid-1990s. That inquiry put forward a recommendation calling for changes to the Criminal Code and we have kept up pressure on federal politicians with rank-and-file Steelworker lobbyists ever since. The campaign really started before the mine blew up, in an organizing drive in which workers signed Steelworker union cards in the hope that the union would force Westray's owners to operate a safe mine. Most of the men who died in the early hours of May 9, 1992 were already Steelworker members.

"The transaction and the evidence is so vile and nauseating that we shall refer to it as briefly as possible, and in such language as that a reading between the lines may be necessary at some points." The Post-Revolution Period, 1776-1873 When the Iowa Territory was organized in 1838, it received the laws of the Wisconsin Territory. Wisconsin itself had received all Michigan laws when it was organized in 1836, so Iowa ended up with the Michigan sodomy law that provided a penalty of up to three years in prison, with the common-law definition. In 1840, the Iowa Territory adopted a law abrogating all laws received from Michigan and Wisconsin, which included the Wisconsin/Michigan sodomy law. Also, when Iowa passed its first criminal code in 1843, there was no mention of sodomy. Thus, Iowa made a decision to keep sodomy legal, and this freedom remained for almost a half-century. Criminal Identity Theft and Assumption Deterrence Act
In October 1998, Congress passed the Identity Theft and Assumption Deterrence Act of 1998 (Identity Theft Act) to address the problem of identity theft. Specifically, the Act amended 18 U.S.C. § 1028 to make it a federal crime when anyone: knowingly transfers or uses, without lawful authority, a means of identification of another person with the intent to commit, or to aid or abet, any unlawful activity that constitutes a violation of Federal law, or that constitutes a felony under any applicable State or local law. Violations of the Act are investigated by federal investigative agencies such as the U.S. Secret Service, the FBI, and the U.S. Postal Inspection Service and prosecuted by the Department of Justice.

Federal Driver's Privacy Protection Act
The Federal Driver's Privacy Protection Act and Iowa Code Section 321.11 prohibits the release of personal information when the request is submitted by plate number except to a law enforcement officer or law enforcement agency; licensed private investigation agency; Iowa security service or licensed employees of either, and employees of a Federal or State agency or political subdivisions and contract employees of the Department of Inspections and Appeals in the conduct of their investigations. Personal information means information that identifies a person, including a person's photograph, social security number, driver's license number, name, address, telephone number, and medical or disability information. The Federal law has further restricted the release of some personal information as being "sensitive" (Public Law Number 106-69, section 350(b) and Title 18 U.S.C. 2721). This "sensitive" personal information includes the social security number, medical or disability information, and the photograph. Social security numbers are not released unless being used as a driver license number and the requestor is a specified authorized recipient. Iowa law requires strict confidentiality of medical and disability information. Iowa law also limits the release of a photograph only to law enforcement agencies, law enforcement officers, or a governmental agency with a legitimate use for the photograph.

    Responsibilities
    The Simpson College Security staff consists of both student and non-student adult personnel. The Security Staff has regular patrols on campus from 4 p.m. - 8 a.m. seven days a week. Staff members respond to a variety of requests and regularly patrol the campus grounds, parking lots, and housing units. Along with other College offices, the Security Department is responsible for enforcing College policies and regulations on College property. Members of the Simpson Security staff are not official law enforcement officers with arrest authority. The department works closely with the City of Indianola and Warren County law enforcement agencies when incidents of a criminal nature arise. Other duties of the Simpson Security department include securing and monitoring campus buildings, assisting the residence life staff, providing escorts for students and staff, enforcement of campus parking regulations, and educating members of the campus community regarding their responsibilities for security and safety at Simpson. All students and employees are provided annually with a copy of the Simpson College Security brochure. At the beginning of fall and spring semesters, security policies and procedures are reviewed with all resident students through meetings in housing units. The Security Department sponsors periodic security and safety programs for the campus. All members of the Simpson community may attend these events. Members of the campus community are encouraged to contact the Security Office with any questions or concerns which they might have about security and safety at Simpson.

    It would be very convenient if all state and federal codes, statutes, and caselaw were available on the World Wide Web. This would give lay people easy access to the laws that they must follow and it would allow attorneys to do legal research without having to leave their office to go to a law library, or pay for expensive collections of casebooks. Unfortunately, economic realities dictate that we may never see all of the substantive law of all the states on the Web. Several states receive quite a bit of income by selling the exclusive rights to publish that state's caselaw. In addition, it is quite expensive to publish and maintain a web site, and money for such a project is not available in all states. Caselaw on the Web ideally would include decisions from at least the last 30 years, a sophistocated search engine for locating relevant law, case summaries, headnotes, etc. Providing all of these on a Web site would be very expensive. Given the above, it is impressive how much substantive law
