Classification of Residents and Nonresidents for Admission and Tuition Purposes
  • General: A person enrolling at one of the three state universities shall be classified as a resident or nonresident for admission, tuition and fee purposes by the Registrar or someone designated by the Registrar. The decision shall be based upon information furnished by the student and other relevant information. In determining resident or nonresident classification, the issue is essentially one of why the person is in the state of Iowa. If the person is in the state primarily for educational purposes, that person will be considered a nonresident. For example, it may be possible that an individual could qualify as a resident of Iowa for such purposes as voting or holding an Iowa driver's license and not meet the residency requirements as established by the Board of Regents for admission, tuition and fee purposes.

    Regulation in Iowa for Child Care
    Registered Child Development Homes Iowa law limits the number of children a home may provide child care for, whether the home is registered or not. A nonregistered child care home may care for up to five children. A home caring for six children must be registered. Under registration a provider self-certifies in writing that they do and will meet the minimum requirements in all areas of child development home operation. In issuing a registration certificate, the Department of Human Services is stating that you have certified that you comply with these requirements. Responsibility for making sure the requirements are met rests primarily with the provider, the parents of children in the provider's care and the community. Licensed Child Care Center and Preschool Iowa law limits the number of children a center may provide child care for without a license or registration as a child development home. A provider caring for six or more children must be registered and when a center cares for seven or more children it must be licensed. Under licensing a provider applies for a license and the facility is visited and evaluated by a professional staff person who determines if the minimum regulatory requirements are meet or if there is an acceptable plan to meet all the standards before a license is issued. In issuing a license, the Department of Human Service is stating that the provider meets the necessary requirements.

    Regulations and Programs Assistance Meetings
    August 22-25, 2005
    The Iowa Pork Producers Association (IPPA) is coordinating a series of producer meetings around the state to share critical information about Iowa's livestock regulations. Topics include an overview of current and emerging state livestock regulations, as well as a presentation on Natural Resources Conservation Service (NRCS) programs aimed at assisting producers with soil, air and water conservation efforts. Manure Management Plans (MMPs), Comprehensive Nutrient Management Planning (CNMPs) and the Phosphorus Index will also be addressed. Producers who attend the meeting will be informed on complying with the current Iowa environmental requirements for livestock producers, including new rules on commercial fertilizer recordkeeping for MMPs, new construction permit requirements, and implementing the Phosphorus Index into existing MMPs. Producers will also learn how to participate and obtain funding for NRCS programs, including the Environmental Quality Incentives Program and the Conservation Security Program.

    Legal Requirements/Court Cases The most current language of the federal mandate concerning inclusive education comes from the 1997 Amendments to the Individuals With Disabilities Education Act (IDEA). These federal regulations include rulings that guide the regulation. The IDEA r equires that children with disabilities be educated in regular education classrooms unless "the nature and severity of the disability is such that education in the regular classes with the use of supplementary aids and services cannot be achieved satisfac torily." This means that schools have a duty to try to include students with disabilities in the regular general education classes. http://www.ed.gov/offices/OSERS/IDEA/q_and_a.html. The IDEA states:
    "Each State must establish procedures to assure that, to the maximum extent appropriate, children with disabilities ... are educated with children who are not disabled, and that special education, separate schooling, or other removal of children with disa bilities from the regular educational environment occurs only when the nature or severity of the disability is such that education in regular classes with the use of supplementary aids and services cannot be achieved satisfactorily." 20 U.S.C. 1412(5)(B). Dr. Susan Etscheidt, professor of special education at UNI and one of five Iowa administrative law judges, notes that in one of the first court cases to question the legal interpretation of the 1990 IDEA the Supreme Court said no one is excluded from t his requirements; everyone is entitled to a free and appropriate public education (FAPE).

    The Iowa Insurance Division supervises all insurance business transacted in the state, including health maintenance organizations and mutual hospital and health service corporations. The insurance commissioner grants permission to companies wishing to sell insurance in Iowa and has general control over all aspects of their business, from the forms they use to the rates they charge.     Before your child receives special education services, the Individuals with Disabilities Education Act (IDEA) requires that he or she have an evaluation. An evaluation includes information from parents, any special medical concerns, interviews with parents and school staff, and may include specific tests. The results of an evaluation will be used to see if your child needs special education help in school. You must give your consent in writing before the first evaluation can take place. The evaluation:
