Des Moines, IA 50319 Dear Mr. Voy: This responds to your request for an interpretation regarding the use of 12 to15-passenger vans by child day care providers to drop off and pick up school children from school. You asked three questions, which are addressed below: Question 1. Do the federal motor vehicle safety regulations relating to the sale and lease of school buses apply to vehicles [new buses] sold or leased to publicly or privately owned day care facilities who use these vehicles to transport school-aged children to and from school as a part of their day care services? As explained below, the answer depends on whether the new buses will be "significantly" used to transport school children "to or from" school or related events. If the bus will be used for such purpose, a school bus must be sold, regardless of whether such transportation is provided by a school or a day care facility. The National Highway Traffic Safety Administration (NHTSA) has the authority to regulate the first sale or lease of a new vehicle by a dealer. Our statute at 49 U.S.C. §30112 requires any person selling or leasing a new vehicle to sell or lease a vehicle that meets all applicable standards. Under our regulations, a "bus" is any vehicle, including a van, that has a seating capacity of 11 persons or more. Our statute defines a "school bus" as any bus which is likely to be "used significantly" to transport "preprimary, primary, and secondary" students

L aws R egulation U pdate Massage on the move May 2005 In the field of massage, each therapist brings a unique style to the table. That style, in some cases, varies radically from one practitioner to another. In other instances, it may differ only in the pressure of touch or the scent of a lotion. Similarly, massage-license requirements can vary from state to state by as much as 750 hours of education, or by as little as a background check or an oral exam. But while diversity of technique among touch therapists keeps the field fresh, diversity in massage-licensing laws can pose obstacles for those moving to another state. Making reciprocity a reality should be one of the primary goals of massage regulation, according to ABMP. The massage association lists reciprocity among its recommendations for massage-and-bodywork legislation. According to Dolly Wallace, national government-relations committee chair for the American Massage Therapy Association (AMTA), more than half of AMTA members surveyed online says they had to meet additional requirements to get a massage credential in another state. Forty-four percent says it took more than three months to get the credential; 70 percent says they were required to sit for additional testing; and 47 percent says the process cost more than $200.

A 50 State Survey of Requirements for the Education of Language Minority Children

Ms. Garcia is also a scholar at the University of California at Berkeley for the Foundation for Teaching Economics.
Ms. Morgan is also an Ashbrook scholar at Ashland University. Introduction Schools around the United States are now faced with education a growing number of children who lack basic English skills. According to the National Clearinghouse for Bilingual Education , there are 2,437,723 Limited English Proficiency students in the U.S.1 Only a few years ago, many schools had never dealt with a language minority child. Today, an increasing number do. The challenge of providing a quality education to all students is doubled when schools must also teach a child an entire new language as well as academic courses. Over the last 30 years, elected officials, education agencies, and the courts have established guidelines for the education of these students. Federal requirements allow states a wide deal of latitude in selecting the most effective programs for their limited-English-proficient (LEP) students. Many states have enacted their own laws governing the management and style of programs for LEPs. These laws have been developed in cooperation with, or under coercion from, federal agencies and/or activist organizations. The result has been a patchwork of laws and regulations that can vary greatly from state to state.

The petition must be for an uninterrupted two year period. The petition must be filed no later than 30 days prior to the first practice date. The petition must be signed by the Superintendent of Schools and Board of Education President. Each petition will be evaluated on a case-by-case basis. The petition must address the following: Purpose of the petition. Effect that grant of the petition will have on the applicant's current class. Nearly all 1,200 community colleges in the U.S. offer some type of environmental courses. While the environmental industry did not exist before 1970, it now accounts for more than a million jobs and $180 billion in annual revenue. Born of U.S. legislation designed to clean up pollution, environmental jobs were among the fastest-growing for almost two decades (Miller, 1997). The demand for environmental technicians is constant and surpasses the ability of postsecondary education to supply adequately trained personnel. Much of the training is driven by the certification requirements of governmental agencies, and there are many more jobs in the U.S. than there are certified workers to fill them. The market for environmental products and services is evolving from pollution control, waste management, and remediation to those associated with resource productivity and environmental improvements (Canning, 1999). Introduction The Iowa Historic Preservation Office (SHPO) reviews all projects that are federally funded, licensed, or permitted and may affect historic properties. The law and regulations governing this review are Section 106 of the National Historic Preservation Act of 1966 , as amended, and its implementing regulations, 36 CFR Part 800 Federal Education Grants
Although the US Department of Education is ultimately responsible for compliance with Section 106 of the National Historic Preservation Act, they delegated their duties to the Iowa Department of Education. By signature on the federal grant application, the grant recipient agrees to assist the Iowa Department of Education in assuring compliance with the National Historic Preservation Act. Once a grant is awarded, the grant recipient should:
2. submit the collected information and appropriate forms, including a Request for SHPO Comment on a Department of Education Project form to IAED. Please do not submit any information on your project for official comment until the grant has been awarded. This will eliminate unnecessary project reviews by SHPO. If, however, you have questions about how to take care of your historic school, SHPO will be more than happy to assist you.

Speakers presented information on the required components of pollution plans. Joe Griffin, IDNR Storm Water Coordinator for the state, along with IDNR (Iowa Department of Natural Resources) field staff provided information on the requirements of the storm water regulations and on-site annual inspections. Wayne Petersen, Urban Conservationist with NRCS (Natural Resource Conservation Service), Coralville, discussed best management practices to prevent on-site soil erosion and sediment loss and Lynn Pitts of IDNR discussed good housekeeping practices for on-site storage and handling of chemicals, along with spill containment and vulnerability assessments. All speakers were available to provide direct assistance to wastewater system managers when discussing the individual components of pollution prevention plans. IAMU will continue to provide training and guidance on storm water issues in Iowa.
