International Treaties: Their Impact On Australia
September 4, 1995 This is the full text of a Keynote Address by Senator the Hon Gareth Evans QC, Minister for Foreign Affairs, to the International Treaties Conference, Canberra, 4 September 1995. This conference on international treaties is certainly timely. Australia's involvement in treaty making is currently being examined in a number of forums; there is now a Senate Committee looking at the operation of the external affairs power in the Constitution; and there is legislation currently before the Parliament dealing with the effect of treaties on administrative decision making. I think there can be no doubt that treaties do have an important and developing influence on many aspects of Australian society and I want to examine their impact in a little detail. But first I think it would be useful to spend a few moments in considering what treaties actually are, and perhaps more importantly, what they are not . I feel constrained to do so because of the misinformation, some of it quite deliberately spread, which has clouded the whole issue of treaty-making over the last couple of years.

I. The Status of Treaties in Polish Law
The status in domestic law of international treaties ratified by Poland under the 1952 Constitution had its origins in Poland's policy toward international cooperation after 1945. The Polish Government shared with other socialist states a desire to keep a measure of distance from international law and its enforcement machinery, and this was reflected in the silence of the Polish Constitution as to the binding force of international law in the domestic legal order. The only provision of the 1952 Constitution which mentioned international law was Article 30(1)(8) which vested competence to ratify and terminate treaties with the Council of State, which was at the time the collegial head of state. This silence was not carried through to Polish legal theory which developed the concept of the ex proprio vigore binding force of international treaties within the domestic legal order. I am presenting on behalf of my colleague Keith Locke. The International Treaties Bill was drafted by him and is being considered by the Foreign Affairs, Defence and Trade Select Committee of which he is a member.
It is a pleasure to be able to explain the interim report and the second interim report on the International Treaties Bill.
The Bill itself is a very important bill, and I congratulate the Foreign Affairs, Defence and Trade Select Committee for dealing with it in such a constructive manner.
Essentially the bill deals with a “democratic deficit” in our legislative system, in that international treaties are approved, not by the Parliament, but by the government of the day.
What we are engaged in with this bill is a process of democratisation. Executive authorities have been slow to devolve treaty making powers to the people. In earlier centuries, when the King or Queen gave powers over the Parliament, he or she kept treaty making powers. Now many governments are reluctant to pass those powers over to the Parliament.
However, several European parliaments have a treaty approval process, so it can be done. With MMP we have become more of a European-style proportional system of government, so why not follow the Europeans in approving treaties?

I am disappointed that this bill will probably be voted down after this second reading debate, although I am optimistic that members will be convinced during the debate to change their minds, just as I am optimistic that Team New Zealand will probably come back from three down. I am very pleased that the bill has received serious consideration by the House and by the Foreign Affairs, Defence and Trade Select Committee.
Several proposals for improving Parliamentary oversight of international treaties were contained in the first Interim Report on the International Treaties Bill, which was discussed in Parliament late last year and there was a very constructive atmosphere in the Select Committee in producing these recommendations.
The Chairperson of the committee in the last Parliament, Graham Kelly, said the bill was ahead of its time, a comment I welcome, because I think it recognises the moral and principled case underlying this bill.
It is what one might call a “democratic deficit” when Parliament can debate and vote on everything else, bar international treaties and agreements.

International Trade and Investment
In much of the Asia and Pacific region, economic growth has occurred in parallel with increasing economic integration into the global economy through foreign trade and international investment. In East Asia, export-led industrialization was the leading edge of the region's development strategy, and this is now the development model of most DMCs. Private investment sourced internationally is the dominant basis of capital for such development. International initiatives on trade and investment within the context of the General Agreement on Tariffs and Trade (GATT) and the WTO focus on further liberalization of trade and investment regimes. A parallel set of initiatives for trade liberalization is also slowly taking root under the auspices of ASEAN and other regional organizations. In this context of economic globalization, policy integration for trade and investment implies an open trade and investment regime, not necessarily an unregulated regime (see Box 4-5). Policies that encourage open trade and investment do not contradict policies that require all investors (foreign and domestic) to meet national environmental performance standards. Typically, this will involve developing in accordance with a “master” plan supported by EIA of all new investments. An approach of combining national environmental performance standards with support of open trade and investment will (in most cases) provide the best route to securing improvements in economic and environmental performance.

Further to our last alert on the International Treaties Bill, 3 November 2000, the Bill has passed its first reading in parliament and has been sent to the Foreign Affairs, Defence and Trade Select Committee for consideration. All parties except National voted in favour of the Bill going to Select Committee. The purpose of the Bill is to ensure that the NZ government will not be able to enter into international treaties without parliament’s approval. This is in part to replace the existing Standing Orders which since 1998 have resulted in some international treaties (not bilateral treaties except at the Minister’s discretion) being ‘referred’ to parliament. Among other things, the International Treaties Bill 2000 provides for the Minister of Foreign Affairs and Trade to present to parliament the text of draft treaties which are under negotiation - this would assist in preventing the type of secrecy around some international agreements, such as the MAI which the then NZ government could have become a party to without anyone else knowing of its existence.     There are five principal international treaties in force today that provide protection for musicians and producers of recorded music. Under the international treaty system, a creative person or company that resides or releases a recording in any country that has ratified the treaty, is protected in all other countries that have joined the treaty. 1. Berne Convention for the Protection of Literary and Artistic Works The Berne Convention, last revised in 1971, is the principal treaty protecting authors and composers of music. This treaty provides a list of rights enjoyed by these authors-such as the right to authorise or prohibit reproduction, public communication, or adaptation of these works. It also allows treaty countries to provide certain exceptions to protection. Some countries also protect producers of sound recordings as "authors" with Berne-type protections.     protect the environment agreed after years of negotiation are
    themselves at risk, the World Wide Fund for Nature (WWF) warned on
    Tuesday. The threat comes in the form of World Trade Organisation
    rules that can invalidate provisions of the treaties by declaring
    that they are a restraint on international trade. The development of new treaties to tackle world wide environmental problems is inhibited by these rules and by the spectre of legal challenges, the WWF said from its headquarters in Gland. World attention is now turning to the World Trade Organisation (WTO) in advance of a new round of trade negotiations due to start with a high level Ministerial meeting November 30 to December 3.     CTSF is a non-profit 501(c)(3) organization dedicated to helping international wild living resources conservation agreements. Over 150 nations, representing most of the peoples of the world, have adhered to these treaties, pledging their best efforts to ensure the maintenance of our natural heritage, for its own sake and the benefit of people. But these treaties still need help to achieve their mission and full potential. CTSF promotes awareness and understanding of conservation treaties and their goals, to enhance public support, compliance, and funding. CTSF supplies educational and informative products, including the CITES Endangered Species Book; the CITES Brochure; endangered species posters, prints, cards, jigsaw puzzles and birdbooks; and CITES and wetland videos.
