    Introduction
    International Treaties and Agreements Treaties can be referred to by a number of different names: international conventions, international agreements, covenants, final acts, charters, protocols, pacts, accords, and constitutions for international organizations. Usually these different names have no legal significance in international law. Treaties may be bilateral (two parties) or multilateral (between several parties) and a treaty is usually only binding on the parties to the agreement. An agreement " enters into force " when the terms for entry into force as specified in the agreement are met. Bilateral treaties usually enter into force when both parties agree to be bound as of a certain date.

    There was a time when it was not necessary to pay much attention to trade treaties. But those days are gone The time has come for public health advocates to make sense of the seemingly incomprehensible 'alphabet soup' of treaty acronyms, and to demand greater public involvement in negotiations that are already well underway. What do the latest international trade treaties have to do with efforts to minimize alcohol-related harm? Plenty. As we shall see, the two are frequently in conflict. Recent impacts on alcohol regulation International treaties have already impaired government efforts to control alcohol availability and alcohol-related harm. Taxes One of the most common and effective ways to prevent alcohol-related problems is to tax alcoholic beverages so that they become more expensive and hence less accessible. Under the very broad 'national treatment' provisions of many trade treaties, governments are prevented from taxing alcohol or anything else in ways that even unintentionally or incidentally protect domestic production from foreign competition. For example, governments that seek to discourage citizens from developing a taste for new, foreign alcohol products having a higher alcohol content than local products may run afoul of national treatment rules. In 1999, a WTO panel ruled that Chile could not tax foreign spirits with a high alcohol content at a higher rate than low alcohol pisco, a Chilean liquor.

    • Start with LEXIS or WESTLAW (both have the full text of U.S. treaties available, selected major treaties via International Legal Materials and Basic Documents of International Economic Law , as well as specialized collections of key treaties on trade, taxation, intellectual property, etc.).
    • Check Oceana's U.S. Treaties Researcher (TIARA) database on the World Wide Web or the United Nations Treaty Collection database on the Internet (if you don't have access to LEXIS and WESTLAW or the costs are prohibitive).

    One of the ABA’s primary goals is to advance the rule of law in the world. In support of that goal, the ABA supports the ratification and implementation of numerous treaties that would provide for universal legal standards and structures to deal with a myriad of issues from human rights to free trade. During the 106th Congress, several ABA-supported treaties received action in the Senate. The House passed H.R. 2909, implementing legislation for the Hague Convention on Intercountry Adoption , on September 18, 2000. The Senate gave its advice and consent to ratification of the Hague Convention and passed the implementing legislation by voice vote on September 20. President Clinton signed the legislation on October 6, 2000. In addition, the Senate passed the resolution of ratification for the Inter-American Convention Against Corruption on July 27, 2000. Links Background Status of Selected Treaties UN Convention on the Law of the Sea The 1982 United Nations Convention on the Law of the Sea (LOS) provides an essential universal legal framework within which issues respecting the stewardship of our common oceans may be equitably resolved and which preserves customary freedom of navigation vital to ocean powers such as the U.S. for both strategic and commercial reasons. The Senate Foreign Relations Committee voted unanimously to approve a resolution of advice and consent on February 25, 2004. However, the resolution must now receive a vote by the full Senate.     Convention to Eliminate All Forms of Discrimination Against Women In spite of the fact that the U.S. made ratification of the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW) by the year 2000 one of its public commitments at the U.N. Conference on Women in 1995, the Senate has not yet taken a vote on ratification of the treaty. The Senate Foreign Relations Committee held a hearing on the CEDAW on June 13, 2002, and approved a resolution of advice and consent to ratification of the treaty by a vote of 12-7 on July 30, 2002.
