Capitalist economic theory holds that a completely liberalized global market is the most efficient way to foster growth, because each country specializes in producing the goods and services in which it has a comparative advantage. Yet, in practice, cutting trade barriers and opening markets do not necessarily generate development. Rich countries and large corporations dominate the global marketplace and create very unequal relations of power and information. As a result, trade is inherently unequal and poor countries often experience not rising well-being but increasing unemployment, poverty, and income inequality. An additional problem is that free trade is not equally free. Agricultural subsidies and other trade barriers in the US and the EU prevent poor countries from gaining access to the most important markets, while they open up their own markets to US and EU exports. Critics of free trade point out that many of the world’s richest countries sheltered their economies by protection when they were at the start of their own growth. Further, trade is so dominated by transnational corporations that new trade rules mainly benefit those companies. A number of NGOs have started to promote “fair trade,” arguing that trade can promote development if it is environmentally sustainable and includes respect for human and labor rights. COURSE DESCRIPTION
This course will address some of the issues associated with the governmental regulation of international trade, through a problem oriented approach. At least two regulatory systems will be considered in almost every problem, one being the regulatory regime embodied in the domestic law of the country of import or export, and the other being the system of international agreements (such as WTO/GATT and NAFTA) that are intended to limit the actions which may be taken by individual governments. The impact of "globalization" within this framework will also be considered. Three major areas will be explored (1) tariffs and non-tariff barriers to trade, (2) domestic responses to import competition, and (3) trade regulation and international economic relations. These are topics which potentially concern any business dealing internationally, from global multinational corporations to small start-up ventures desiring to expand abroad.

It was established in 1948 as an interim measure pending the creation of the International Trade Organization. However, plans for the latter were abandoned and GATT continued to exist until the end of 1995. Members of GATT were pledged to work together to reduce tariffs and other barriers to international trade and to eliminate discriminatory treatment in international commerce. The most important service of GATT was to negotiate multilateral extensions of tariff reductions through the application of the most-favored-nation clause . GATT also provided for regular meetings to consider other problems of international trade. An important GATT principle was that protection of domestic industries was to be done strictly through tariffs and not measures such as import quotas. The only exceptions permitted to GATT rules were those dealing with balance of payments difficulties, and these exceptions are carefully supervised. GATT provided the framework for most important international tariff negotiations from 1947 until 1994. The eighth, or Uruguay round, of GATT negotiations, which began in 1986 with 15 negotiating groups, was long stalemated by the issue of agricultural subsidies maintained by the European Community. The agreement that resulted (1994) from the Uruguay round led to the creation (1995) of the more powerful

International Trade Law Center in-depth training of individuals in government, in business, and in professional practice with respect to the WTO rules, procedures, and practices. Each course and consultation program especially those relating to compliance and law reform is built by reference to the specific legal institutions and level of legal development of the country for which the services are being provided, as well as the specific needs and challenges faced by that country in participating effectively in the rule-oriented trading system. There are many potential sources of funding for this type of program, including the international financial institutions, agencies of the United Nations, and bilateral aid agencies, such as the US Agency for International Development. ILI has worked on a large number of projects supported by these organizations. Complying with the International Rules on Trade and Investment Every country expecting to gain the benefits of WTO membership will in turn be expected to comply with its obligations under the WTO agreements and to implement them effectively through changes in its domestic laws, institutions, and administrative practices. Each country will also want to take steps, when necessary, to insure compliance by other countries. Indeed, the success of the WTO system, with its benefits for all member countries, will depend on a high level of general compliance, achieved through widespread understanding of the rules and through harmoniously-shaped institutions which encourage routine compliance.

ITO INTERNSHIP PROGRAM The ITO internship program offers opportunities to work with area Trade Specialists or Deputy Directors. During their stay with the ITO, interns will be assigned specific projects. The nature of the projects will vary and be discussed in more detail during interviews. Typical projects include general market research on behalf of Colorado exporters and identification of Colorado companies for participation in ITO programs (trade shows, trade missions, etc.) Interns will also assist in preparation for incoming delegations and meetings with the Governor. An understanding of or interest in learning about the export process and entities involved would be helpful. The ITO is an office of the Governor, and as such, interns must be mature and professional. Interns are a vital part of our team and we seek the following backgrounds:
  • Strong interest in international business/relations Interest in/experience with overseas work or travel Dependability (commitment to weekly schedule through end of internship period) Ability to work independently Strong written and verbal communication Foreign language skills

WTO Logo The World Trade Organization WTO ) is an international organization which oversees a large number of agreements defining the "rules of trade" between its member states (WTO, 2004a). The WTO is the successor to the General Agreement on Tariffs and Trade , and operates with the broad goal of reducing or abolishing international trade barriers WTO headquarters are located in Geneva Switzerland . On May 13 Pascal Lamy was elected the Director-General . He took over from Supachai Panitchpakdi on September 1 . As of August 19 , 2005, there are 148 members in the organization (WTO, 2004a). All WTO members are required to grant one another most favoured nation status, such that (with some exceptions) trade concessions granted by a WTO member to another country must be granted to all WTO members (WTO, 2004c).
