It will introduce you to the basic concepts, institutions, texts, and research tools and give you a framework to knit these together as needed to solve individual problems. Underlying the guide is the principle that in order to understand what you need to find, you have to understand the institutions which are in a position to "create" international law. The guide is not intended to teach substantive law, but the framework within which the law is disseminated.
BACKGROUND The background material provides a context for learning about the specific tools used in International Law research. Definitions of International Law Public International Law is the law of the political system of nation-states. It is a distinct and self-contained system of law, independent of the national systems with which it interacts, and dealing with relations which they do not effectively govern. Since there is no overall legislature or law-creating body in the international political system, the rules, principles, and processes of international law must be identified through a variety of sources and mechanisms. This can make international law appear difficult to pin down. Students and scholars in the United States often use the

What is torture?
Torture cannot be defined by a list of prohibited practices. Human rights treaties define it in a number of different ways, reflecting the different contexts in which they were drafted and the purposes of each particular treaty. The Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment was adopted by the United Nations General Assembly in 1984 and entered into force on June 26, 1987.
It defines torture as any act by which:
severe pain or suffering, whether physical or mental; is intentionally inflicted on a person;
for such purposes as:

when such pain or suffering is inflicted by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity.*
*Amnesty International believes that acts of violence by private individuals constitute torture when they are of the nature and severity envisaged by the concept of torture in international standards and when the state has failed to fulfill its obligation to provide effective protection against such acts of violence.

Is International Law Really Law?
On September 25, 1997, the International and National Security Law Practice group co-hosted a debate with the ABA Standing Committee on National Security Law on the subject of the binding force of treaties. We have excerpted the remarks of the two speakers, John Bolton and Robert Turner.
John R. Bolton* Treaties have no special or higher status than other legislative acts, or the U.S. Constitution. I have been surprised, in conversations even with knowledgeable and sophisticated foreign policy analysts, to hear repeated reference to treaties as possessing some special status in the American legal system. I believe that the confusion stems from the misreading both of the Supremacy Clause of the Constitution, and of the well-known opinion by Mr. Justice Holmes in Missouri v. Holland, 252 U.S. 416 (1920). The Supremacy Clause provides: "This Constitution, and the laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding."
