Why US courts look overseas
June 5, 2005 Earlier this year, the US Supreme Court found Missouri's planned execution of Christopher Simmons unconstitutional because he was 17 years old when he broke into a woman's home, tied her up, dragged her to a bridge, and threw her to her death in the waters below. Writing for the court, Justice Anthony Kennedy pointed out that the laws of no other countries permitted the execution of juveniles. Consequently, he observed that ''the express affirmation of certain fundamental rights by other nations and peoples . . . underscores the centrality of those same rights within our own heritage of freedom." The Supreme Court's willingness to look to foreign and international law when interpreting the US Constitution is not unusual. In recent cases on the death penalty, affirmative action, privacy, and due process, the court has reviewed statutes and case law in other countries, as well as treaties and the decisions of international tribunals. Yet not everyone is happy about using foreign and international law to interpret a Constitution drafted by and for Americans. Supreme Court Justices Antonin Scalia dissented in the Simmons case, saying: ''Acknowledgment of foreign approval has no place in the legal opinion of this court . . . " Indeed, a bill has been introduced in Congress that would forbid US federal courts from using foreign and international law in their opinions, except for English law and other sources relied upon by the framers of our Constitution.

This publication is a collective work by a group of persons closely associated with the actual making of the Rome Statute. It covers the substantive and procedural issues raised during the preparatory stages as well as the Conference. These active participants in the Conference provide an account of the main contentions on each of the key issues, the divergent approaches put forward by the principal proponents, how differences were resolved, how groups of articles were prepared, and how the final text as a whole was assembled.     Summary of International and U.S. Law Prohibiting Torture and Other Ill-treatment of Persons in Custody

    International and U.S. law prohibits torture and other ill-treatment of any person in custody in all circumstances. The prohibition applies to the United States during times of peace, armed conflict, or a state of emergency. Any person, whether a U.S. national or a non-citizen, is protected. It is irrelevant whether the detainee is determined to be a prisoner-of-war, a protected person, or a so-called “security detainee” or “unlawful combatant.” And the prohibition is in effect within the territory of the United States or any place anywhere U.S. authorities have control over a person.     Canada's place in the private international legal order
    Canada's competitiveness in international trade depends on its participation in the private international legal regime.
    This can be achieved by step-by-step adoption of existing and future conventions.
    This in turn requires dedicated action on the part of several jurisdictions.
    SUMMARY
    Governments and businesses wish to help make Canadian business competitive in foreign trading. A certain and acceptable legal regime for foreign trade is part of what makes business competitive.
    Provincial and territorial action is often needed for Canada to become a party to international conventions on commercial or personal matters.
    Governments should agree to a concerted effort to implement conventions for which the Uniform Law Conference has adopted or will adopt enacting legislation.
    Issue:
    How can Canada improve its participation in international legal regimes on private law matters?
    Proposal: The federal, provincial and territorial governments should commit themselves bringing forward regularly legislation to implement international conventions for which the Uniform Law Conference of Canada has prepared harmonized statutes from time to time.

    I. Introduction Most legal scholars agree that a recognizable body of international criminal law does exist. However, the precise parameters of this body of law are often unclear, perhaps due to the rapid and complex developments of our global society. In its widest context, the source of international criminal law might be derived from the general principles of international law recognized by civilized nations; and therefore, found in the customary law accepted by states, the general criminal law recognized by nations, and the treaties which govern particular conduct. International criminal law can also be categorized according to whether the conduct in question is international, constituting an offense against the world community, or whether the act is transnational, affecting the interests of more than one state. For example, international crime would encompass acts that threaten world order and security, crimes against humanity and fundamental human rights, war crimes, and genocide; whereas the transnational crime category would include drug trafficking, transborder organized criminal activity, counterfeiting, money laundering, financial crimes, terrorism, and willful damage to the environment. This chapter provides information on the major electronic sources for researching international and transnational crime, as well as current issues common to both categories, such as efforts to codify international crimes, activities aimed at crime prevention, cooperation in law enforcement, jurisdictional questions, international judicial cooperation, and the effects of bilateral and multilateral treaties.
