Conclusion: Need for Multi-Level Constitutionalism Protecting Human Rights More Effectively
The universal recognition and protection of inalienable human rights at national, regional and worldwide levels requires a new human rights culture and a citizen-oriented national and international constitutional framework different from the previously prevailing state-centered conceptions and functionalism. In Europe, the emergence of "multi-level governance" has led to "multi-level constitutionalism" and "divided power systems" that have succeeded in overcoming Europe's history of periodic wars and of "constitutional failures" of nation states to protect human rights and peaceful division of labor across frontiers. Just as within federal states "the federal and state Governments are in fact but different agents and trustees of the people, instituted with different powers, and designated for different purposes" , international law and international organizations must be understood as parts of the constitutional limitations on abuses of foreign policy powers necessary for protecting human rights more effectively. National constitutional law and human rights cannot achieve their objectives unless they are supplemented by international constitutional law and by effective protection of human rights in the economy no less than in the polity.

8. Can a "United Nations Action Program" Succeed in Integrating Human Rights into the Law of Worldwide Organizations?
The incorporation of human rights into European integration law reflects effective protection of human rights in both the national and European economy and polity of EU member countries. UN human rights law, by contrast, has not succeeded so far to protect human rights effectively in the national and increasingly globalized economy and governance systems of all UN member states. Initiatives for integrating human rights into the law of worldwide organization are unlikely to come from specialized economic organizations like the WTO. More than 50 years after the Universal Declaration on Human Rights, it is time for a comprehensive UN program for integrating human rights in a coherent manner into the law of worldwide organizations so as to "constitutionalize" the world economy and global governance. Are the powers of the UN (e.g. under Articles 62-64 of the UN Charter) sufficient for bringing about the needed "human rights revolution"? In contrast to the anti-market bias of earlier UN recommendations for a "New International Economic Order" , the recent UN Secretary-General's report on "Globalization and its impact on the full enjoyment of all human rights" is characterized by a balanced attempt at reconciling human rights, market competition and globalization. The Center has operated since 1976 in Salzburg. The Center for International Legal Studies has a close cooperation with the Salzburg Seminar, Suffolk University Law School, Boston, Massachusetts, the Faculty of Law of the University of Salzburg, the Faculty of Law of the University of Amsterdam, The Netherlands, the Faculty of Law of the University of Durham, England, the National University of Chile, and numerous other universities and educational organizations in Europe and the United States. June 30, 2004 WASHINGTON, June 29 - A Supreme Court decision on Tuesday kept federal courts open to lawsuits by foreigners who allege that they were victims of serious human rights violations anywhere in the world. The decision interpreting the Alien Tort Statute came as a relief to human rights organizations that had feared the court would accept the Bush administration's invitation to narrow the application of the 215-year-old law. At the same time, the result was a sharp disappointment to international business interests, which have been alarmed by increasing use of the law to sue multinational corporations for human rights violations and had looked to the Supreme Court to curb the trend. The case before the court did not involve a corporate defendant, and the 6-to-3 decision did not conclusively resolve the status of such cases. That opportunity may come soon, because lower courts with corporate cases on their dockets have been deferring decisions while waiting to see how the Supreme Court would rule in this case. A case brought on behalf of residents of Myanmar charging the Unocal Corporation with human rights violations in connection with a gas pipeline project has already been argued before the federal appeals court in San Francisco and could reach the Supreme Court quickly.

Take action to urge Madagascar to ratify the Rome Statute of the International Criminal Court If the twenty first century is to avoid the brutality that was a hallmark of the twentieth, a legal system that ends impunity to the perpetrators of the worst crimes known to humanity - genocide, crimes against humanity, war crimes, torture, extrajudicial executions and disappearances - must be established and implemented worldwide. Such a system is essential to deter people contemplating such crimes, to allow victims to obtain justice and redress and to support reconciliation between the groups or states involved in a conflict.
The twentieth century was perhaps the bloodiest in history. Millions of people were victims of genocide, crimes against humanity, war crimes, torture, extrajudicial executions and "disappearances." These crimes were committed throughout the world during international and civil wars and in conditions of "peace."
Despite the extent and horrific nature of the crimes witnessed in the 20th century, shamefully only a handful of perpetrators have ever been brought to justice. The majority of prosecutions were for crimes committed in World War II, and, more recently, in the former Yugoslavia and Rwanda. In these situations the international community established international tribunals to prosecute the most serious cases. In the cases of the former Yugoslavia and Rwanda, the national courts are also conducting some prosecutions. In a small number of cases, national courts in other countries have investigated and prosecuted individuals accused of the crimes who entered their territory .

To mark the 50th anniversary of the 1949 Geneva Conventions
From November 1998 to August 1999, the International Committee of the Red Cross (ICRC) will be gathering the opinions of thousands of people in a dozen countries who have been directly affected by armed conflict. They will be asked to share their views on the limits to warfare set by international law and on how to improve compliance with the Geneva Conventions and other humanitarian treaties. These will be published along with the results of a parallel survey conducted in countries at peace. The participants’ personal stories will be portrayed in publications, the media and on an interactive web site. The project is intended to increase awareness around the world of the rules that already exist to protect people in wartime and to encourage discussion of humanitarian law in the context of modern-day conflict.
In Colombia, the first round of the study is currently being conducted among displaced civilians, former hostages, soldiers, guerrillas, security detainees, medical personnel and members of the general public. The interviews conducted so far have yielded a fascinating insight into how people perceive the conflict in Colombia and its consequences for their country, as well as their views on the limits set by humanitarian law and the dilemmas that arise in practice.

The London-based human-rights organization, Amnesty International, says respect for human rights across the world is on the slide, and the group says U.S. policy has a lot to do with that. The 308-page annual report highlights the state of human rights in nearly 150 countries. Last year was not a good one as far as human rights goes. That is the conclusion of Amnesty International. Based on detailed information from 145 countries, the organization says governments are betraying their promise of a world order based on human rights. Amnesty's Secretary General Irene Khan delivered her gloomy assessment.

The purpose of the letter was to urge President Wolfensohn to recognize and advocate for the independence and integrity of the Inspection Panel in the upcoming Board review. While the Panel structure and process has remained largely untouched thus far, several proposals to be presented at the Board review suggest that this may not be the case in the near future.
