It will introduce you to the basic concepts, institutions, texts, and research tools and give you a framework to knit these together as needed to solve individual problems. Underlying the guide is the principle that in order to understand what you need to find, you have to understand the institutions which are in a position to "create" international law. The guide is not intended to teach substantive law, but the framework within which the law is disseminated.
BACKGROUND The background material provides a context for learning about the specific tools used in International Law research. Definitions of International Law Public International Law is the law of the political system of nation-states. It is a distinct and self-contained system of law, independent of the national systems with which it interacts, and dealing with relations which they do not effectively govern. Since there is no overall legislature or law-creating body in the international political system, the rules, principles, and processes of international law must be identified through a variety of sources and mechanisms. This can make international law appear difficult to pin down. Students and scholars in the United States often use the

With the increasing globalization of world trade, tourism, the breaking down of language barriers, and improvements in international relations, international law has emerged as a further important influence. International law has traditionally focused on governing relations between independent nation states. However, in the aftermath of the Second World War, the United Nations was formed on the basis of a Charter which committed the members of the UN to "take joint and separate action in cooperation with the Organization" to achieve "the purposes set forth in Article 55 [of the Charter]". Article 55 committed the UN to promote "universal respect for, and observance of, human rights and fundamental freedoms for all without distinction as to race, sex, language, or religion." One important consequence of this major development in international relations has been the "demise of Oppenheim's doctrine that 'States solely and exclusively are the subject of International Law' ... [I]t is [now] ... the case that inter-state treaties are increasingly concerned with the 'trans-national' affairs ... of private individuals and companies."

Charlemagne consolidated his empire under the influence of Christianity Louis XIV ; the "Consolato del Mare", a collection of rules applicable to questions arising in commerce and navigation both in peace and war, probably drawn up in the twelfth century and founded upon the Roman maritime law and early maritime customs of the commercial cities of the Mediterranean; the "Guidon de la Mar", which dates from the close of the sixteenth century and deals with the law of maritime insurance, prize, and the regulations governing the issue of letters of marque and reprisal. In addition to these there were various bodies of sea laws, notably the maritime law of Wisby, the customs of Amsterdam, the laws of Antwerp, and the constitutions of the Hanseatic League. All of these codes contained provisions extracted from the earliest known maritime code, the Rhodian Laws, which were incorporated into the general body of Roman law, and were recognized and sanctioned by Tiberius and Hadrian.

The United Nations Office for Outer Space Affairs is the Secretariat for the Legal Subcommittee of the United Nations Committee on the Peaceful Uses of Outer Space (COPUOS) , which is the primary international forum for the development of laws and principles governing outer space. In addition to providing parliamentary services, the Office prepares legal studies and background documents on various aspects of space law to assist member States in their deliberations. In accordance with the Action Plan endorsed by the General Assembly in its resolution 55/122 , the Office provides information and advice, upon request, to governments, non-governmental organizations and the general public on space law in order to promote understanding, acceptance and implementation of the international space law agreements concluded under United Nations auspices. I. Introductory Remarks
Is general international law customary law only? At first glance this problem seems to be of purely academic interest. However this is not so. It is gratifying that the twentieth century has seen enormous leaps forward in international law. However, these gains far from satisfy the needs of the international community for legal regulation. The decade of international law proclaimed by the United Nations General Assembly testifies that the international community is aware of an urgent need for further progressive development of international law, and that measures need to be taken to ensure its effectiveness. This means first of all the further development of general international law, which is the foundation of the whole system of international law. The problem is whether we should rely on the development of general international law by custom only, or if it may also be achieved by multilateral treaties. The second important problem is whether, in attempting to create a new world order based on the rule of law, we should exclude the possibility of an international treaty becoming a kind of constitution of the international community. It is hoped that these two questions suffice to illustrate that the problem I am going to discuss is also of great practical political importance.
