THE HAGUE CONFERENCE ON PRIVATE INTERNATIONAL LAW
Private international law is that part of the law of any State which comes into operation when a court is called upon to determine a suit containing a foreign element. Such an element may exist for instance because a contract has been made or is to be performed in another State or because the recognition of a divorce obtained by persons domiciled abroad may arise. Because the courts of the other State may also be asked to exercise jurisdiction in the suit, or because the laws of that other State may be different to those of Ireland , in determining the suit before it an Irish court may be confronted with a conflict of laws. Such conflicts are resolved by applying the rules of private international law. To varying degrees the rules of private international law which have been developed in Ireland will be different to those developed in other States and indeed there are probably as many systems of private international law rules as there are States and therefore national legal systems.

Students created the ILO as a vehicle to increase the scope and depth of international scholarship at the law school. Before too long, students in the group began to explore ways to create a journal. They enlisted the aid of Trustee Professor of Law Geoffrey C. Hazard, Jr., submitted a business plan, elected an editorial board, and recruited a staff of thirty, led by Editor-in-Chief Matthew Brady. (The current editor is Joseph Wheatley.)

    COURSE DESCRIPTION
COURSE DESCRIPTION COURSE CONTENT COURSE REQUIREMENTS ... USEFUL LINKS COURSE DESCRIPTION
International Law is a vast and dynamic field of law that increasingly permeates all other fields. It is a discipline which regulates the international community and states interactions with other states, and with individuals and institutions. International law provides the means to address relations and issues which individual States cannot regulate efficiently. This is the law of an international community of States, essentially administering relations amid states and with other entities comprising the individual as holder of human rights. It is an area of law continuously evolving echoing the development of the international community. Recent developments include various issues of the Geneva Convention, the use of force, terrorism, and the increasing relevance of the human rights protection system.
    COURSE OBJECTIVES
The objective of the course is for students to develop their analytical thinking about how international law might apply in a given situation, and to stimulate and motivate the students while exploring the interaction between international law and problem solving in foreign relations.

The Editorial Advisory Board consists of members who are eminent international lawyers in international law drawn from all over the world. Recent articles have dealt with topics such as outer space, East Timor and self determination, human rights and children, sea piracy, the Sandline affair, African organisations, the European Community and the United Nations. In addition to articles, shorter comments and notes on recent developments, surveys of recent decisions of the International Court of Justice and book reviews appear regularly. 2002 Australian International Law Journal: Table of Contents 2001 Australian International Law Journal: Table of Contents 2000 Australian International Law Journal: Table of Contents

The Legal Status of Palestine Under International Law

By Paul J.I.M. de Waart Table of Contents Introductory remarks In close consultation with the Arab Thought Forum in East Jerusalem and the International Center for Peace in the Middle East in Tel Aviv, the Netherlands Organisation for International Cooperation NOVIB sent a special fact-finding mission to the Palestinian Occupied Territories in February 1988 in order to inquire needs for emergency assistance, to which the 1987 intifada might have given rise. The mission was also asked to consider structural aspects of the situation, including the role of international law in bringing about a lasting peaceful solution of the protracted Israeli-Palestinian conflict. As a member of the NOVIB mission I submitted to that end an informal paper on international law as a framework for a peaceful solution of the dispute between Arab states and Israel as a basis for discussion with Israelis and Palestinians. The discussions revealed at the time a remarkably new sense of realism on both sides, i.e. the acceptance of the existence of the State of Israel and of the right of self-determination of the Palestinian people in the Palestinian Occupied Territories as a legal and political fact of life. For that very reason NOVIB was recommended the organization of a meeting of relevant, representative persons from the Israeli and the Palestinian side on neutral grounds and under the auspices of a scientific institution for studying ways and means for future coexistence and cooperation between Israel and Palestine.
